December 5, 2005 LAU ~ames Ochs, C.B.O. epartment Of Community Services, City of Carmel One Civic Square Carmel, IN 46032 RE: North Meddian Medical Pavilion- Permit{~ 04110113~/ Temporary Certificate of Occupancy Dear Mr. Ochs: Dudng the walk-through for the Certificate of Occupancy at the North Meridian Medical Pavilion located at 12188-A North Meddian Street on November 29, 2005 it was cted that the bud ng required protection of the structural steel which supports the stair shaff~ The citation that was made referred to the 2000 International Building Code, Section 707.5, The supporting construction shall be protected to afford the required fire-resistance rating of the element supported**." In this situation the stair shafts ara the 1-hour rated fire barrier in which case the pd~ary structural steel which supports the stair shafts for floors 2 and 3 need to also be rated in a 1 .hour fire barrier. As discussed during our meeting on December 2, 2005, it is the intention of Lauth Construction LLC to apply for a vadance to this code, This variance is being pursued due to the financial hardship caused by the requirement to Comply with this code at this point in the construction process. In addition, it is clear that this code has not been previously required in the past on Similar pro. iects. And finally, from past experiences a building of this type is evacuated in such a short pedod of time we feel that this is not a life safety issue. Ifthe applicatien for a variance is unsuccessful, it is the intention of Lauth Construction, LLC to complete the required work to provide a 1-hour rating of the structural steel supporting the stair shafts I~or floors 2 and 3. Given the need to complete this additional work we will require three weeks from the time the variance is denied to complete this work. Since the vadance meeting will take place during the first week of January, we will need the following three weeks to complete the work. Until that time, it was agreed that a Temporary Certificate of Occupancy will be granted. We ask that this Temporary Certificate of Occupancy be granted until the end of January 2006 pending the resolution of the variance. Thank you for your assistance with this issue.
