ORDINANCE D-2161-13
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDI A
"CITY" AMENDING CARMEL CITY CODE CHAPTER 6 ARTICLE 4 SECTIO'' 6-65
WHEREAS, it is widely known that firearms, which expel projectiles by means e an explosion,
annually cause thousands of injuries in the United States, it is less well known that d, gerous weapons
that propel projectiles by other means annually cause tens of thousands of such injuries; and
WHEREAS, it is in the public interest and will foster the health, s.fet,, and well-being of the
City's residents and guests to now amend the City Code to prohibit the poi , aiming, and discharging
of not only firearms, but of these other dangerous weapons within the 6,it eorporate limits as well.
NOW, THEREFORE, BE IT ORDAIN , by e Commo ouncil of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are i orpo ted h rein-.y this reference.
Section 2. Chapter 6, Article 4, Sectio 665 of e .rmel City Code should be and the same is
hereby amended to read as follows:
"Sec. 6-65 Use of Firearms and other D ngero s Wea ons P shibited.
(a) It is declared to b, u'lawful or any rerson to, purposely and deliberately point, aim, or
discharge any ,near or th-r da ero.s weapon within the corporate limits of the City. Such
firearms and/4r sang: ous ,..'eapons s all include, but not be limited to, pistols, revolvers, rifles,
shotguns, i •chine gun:` 1,1-1 :t gu• , BB guns, cross-bows, bow and arrows, slingshots, or any
other sim'.ar devices tha\discha .e or propel a projectile by means of an explosion, the release
of comp essed gas, force, o\, by any mechanical system or movement.
(b) Any person\ o iolates y provision of this Section shall be fined not less than Fifty Dollars
($50) nor mor- 'tan $5.70 for each offense, in addition to which the weapon may be ordered
confiscated.
(c) This Section shal not affect the otherwise lawful possession, display and/or use of firearms and
dangerous wea,ons in the protection of human life or property, or by public safety personnel in
the perfonnaRce of their official duties.
Section 3. All prior ordinances or parts thereof inconsistent with any provision of this
Ordinance are rereby repealed, to the extent of such inconsistency only, as of the effective date of this
Ordinance. .owever, the repeal or amendment by this Ordinance of any other ordinance does not affect
any rights e~ liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this
Ordinan,•. Those rights, liabilities and proceedings are continued and penalties shall be imposed and
enforce. under such repealed or amended ordinance as if this Ordinance had not been adopted.

Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
Section 5. This Ordinance shall be in full force and effect from and after the date of its passage,
execution by the Mayor, and publication as required by law.
