RE: Newark, lots 17pt-18pt: Restaurant (#05070004 UV) - Use Variance Application
Dear Mr. Attiyeh:
This letter is in response to your Use Variance Application for Newark, lots 17pt-18pt: Restaurant. Others
will make additional comments at the TAC Meeting on July 20. It is highly suggested that you submit an
ADLS Amendment application by July 18, so that you will be placed on the August 2 agenda of the Plan
Commission Special Studies Committee to review all exterior modifications to the property, as required in the
B-7/Business District and the Carmel Dr-Range Line Rd Overlay. The BZA may feel more comfortable
approving your Use Variance request, if they know that the Plan Commission has approved your exterior
modifications. Please complete the following:
TT~e Variance Application Review
1. Please provide a filled out and notarized Public Notice Affidavit, within the application.
2. Provide the building square footage (total and per floor) and proposed interior layout (kitchen,
seating, restrooms, etc).
3. Provide a copy of the official adjoining properties list for the Hamilton County Auditor's Office.
4. Provide a filled out Notice of Public Hearing form (found within application).
5. Provide a copy of the written parking agreement with the owner to the north.
6. Please show/label the half right of way on Range Line Rd and Nappanee Drive. Additional road
right of way may need to be dedicated; consult with the Carmel Engineering Dept. at 571-2441.
7. Coordinate with the Urban Forester, regarding plantings and buffer yards (The overlay requires that
street shade trees must be planted in the R/W, 1 every 30 feet (Chapter 23F.ll); please show).
8. Please provide a tree preservation site plan, showing the trees you will preserve.
9. Provide a parking breakdown chart. Parking required is one parking space for every 2.5 seats plus 1
space for every employee in the largest shift.
10. Explain how patrons will know to park in the lot to the north.
11. Please provide photos of the site.
12. Product/material storage must be stored in the primary or accessory building. No outside storage is
allowed within the Overlay, per Chapter 23F.16.
13. Call the Building & Code Enforcement Dept at 571-2444, who may require inspections for the
interior of the building.

14. The primary entrance must face a public street and the must be apparent as a prominent
architectural features. Please show.
