The applicant seeks to rezone 12.72 acres from R1 to PUD for the purpose of developing
a site with 100 proposed townhomes. The site is located at 1940 E. 136th Street and is
zoned R1 - Residential.

The applicant is requesting approval of a Planned Unit Development to allow the construction of
single family townhomes. The public hearing for this item was held at the June 21 st Plan
Commission meeting. Opponents voiced concerns with the potential increase in traffic,
stormwater runoff, and with construction near the floodway/floodplain. At the July 5, Special
Studies Committee meeting all of these concerns were discussed, and the petitioner was asked to
return to the August 2nd meeting with additional information. At the August 2nd meeting a
revised traffic study was presented. This item returns to Plan Commission with a 0-3 denial of a
motion to approve from the Special Studies Committee.
The primary outstanding issue for this site is traffic generation. The updated traffic report
indicates that while this project will add to traffic on Smokey Row Rd, the additional trips
generated will not cause the level of service to drop at the Range Line Road or Keystone Ave.
intersections. Carmel Engineering has reviewed this report, and agrees with its findings, adding
that while this project will not cause a drop in level of service, it will create a modest increase in
traffic along Smokey Row Rd. (see attached letter from the Department of Engineering).
Engineering states that at the present time there is no need for the petitioner to make
improvements to Smokey Row Rd. between these intersections, but should be responsible in
offsetting the costs of future improvements along the segment/intersections - details of such to be
worked out with the petitioner and Engineering.
Providing a pedestrian trail link from the Cool Creek trail to Smokey Row Rd, and interior
amenities/usable green space were also mentioned as concerns during the committee meetings.
In response to the above issues, the petitioner has reduced the number of proposed townhomes
from 100 to 90 and has reconfigured the site to provide some additional greenspace and
amenities. As a result of the reduction in units, there is an increase in parking ratio and open
space ratio (see attached comparison chart).
At the Plan Commission meeting, the petitioner will present and the proposed site alterations. At
this time the petitioner should clarify their intent and involvement in the installation of a
pedestrian trail link from the Cool Creek Trail to Smokey Row Rd.
Note that this petition is for the rezone of this property from R1 to PUD for the development of a
townhome community. If approved, the proposed development would be required to return to
PCR-2005-0816.rtf6
