Time: 9:00 a.m. 9:00 a.m. (SU) Verizon Wireless Cell Tower, at City Center Dr. & Pennsylvania St. The applicant seeks the following BZA special use approval for a new cell tower in a business district: Docket No. 14010002 SU (ZO Chptr 25.13) Towers are Permitted as Special Uses in Business Districts. The site is located northeast of City Center Dr. and Pennsylvania St., and is zoned B-3/Business. Filed by Dave Coots of Coots Henke & Wheeler on behalf of Verizon Wireless. Dave Coots and Daniel Coots with Coots, Henke & Wheeler Law Office, and Chris Britt with Verizon Wireless presented on behalf of the petitioner. This project is a 100-foot cellular tower on real estate owned by KB Investments. This property does not have an address yet, but it is located north of City Center Drive and east of Pennsylvania Parkway. It will be on an 88’ by 88’ square tract and will access off Hancock Street, through the Atapco parking lot area. The tower will co-locate three additional potential users. The Department of Community Services has requested the tower be colored white, which the builder is willing to do. The perimeter of this tower will be fenced and landscaped with Norways. Mr. Coots said a revised landscape plan has been submitted, and he will provide a .pdf file soon. David Lucas – Hamilton County Highway Department - No comments. Ryan Hartman – Clay Township Regional Waste District - No comments. Angie Conn – City of Carmel Planning & Zoning - No comments. Amanda Foley – City of Carmel Engineering Department - Comments sent. Department is just trying to understand the drainage, since there is an easement near the tower location. Mr. Dave Coots said the developer actually moved the tower 30 feet south to accommodate a 30-foot drainage easement along the north border of the TD Investment property, and this was done through negotiation with Page 2 of 7 WWW.CARMEL.IN.GOV ONE CIVIC SQ. CARMEL, IN 46032 (317) 571-2417 the land owner, so this easement is now depicted on the drawings. 9:15 a.m. (SUA & V) Bethlehem Lutheran Church of Carmel, Expansion. The applicant seeks the following BZA special use amendment and development standards variance approvals for a church expansion: Docket No. 14010015 SUA - ZO Chptr 21.05: Greater than 10% expansion of approved Special Use. Docket No. 14010016 V - ZO Chptr 6.04.03.F: Max Lot Coverage 35%, 38.5% requested. The site is located at 13225 Illinois Street, and is zoned S-2/Residential. Filed by Paul Reis of Krieg DeVault on behalf of Bethlehem Lutheran Church of Carmel. Mike Terry with Roger Ward Engineering and Scott Schutz with Equiteam presented on behalf of the petitioner. Mr. Terry said this is not the first time this project has been before TAC. The developer previously presented a parking lot addition, and is now back to present a building addition. Mr. Terry said this addition will almost double the footprint of the existing facility. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. No further comments. Joanie Clark – Vectren Energy - Asked if gas would be requested on this project. Mr. Schutz said there will be none required for this project. Nick Redden – City of Carmel Engineering Department - No comments. Shirley Hunter – Duke Energy - Asked if an upgrade would be needed for additional service. Mr. Schutz said an upgrade would be required. Ms. Hunter requested additional load information and an AutoCAD file of the new footprint of the building. Dan Davenport – Indianapolis Power & Light - This project is in Duke’s service area. Chris Ellison – City of Carmel Fire Department - Updated drawings will be required on this project. Mr. Terry asked for specific dimensions, more specifically the width of the driveway that is being requested. Mr. Ellison said the driveway width must be at least 20-feet, must accommodate fire apparatus of at least 75,000 pounds, and must be an all-weather surface. Mr. Schutz said this addition will be 6,000 square feet, and this will be a pre-engineered building, which will be non-combustible. Daren Mindham - City of Carmel Urban Forestry - Comments sent. Two minor details are remaining. David Lucas – Hamilton County Highway Department - No comments. Ryan Hartman – Clay Township Regional Waste District - Questions have been answered. The only remaining issue is a new permit will need to be issued due to the additional usage. Angie Conn – City of Carmel Planning & Zoning - Comments sent. Mr. Terry said the parking stall has been set based on the front of curb rather than the back of curb. Alexia Donahue-Wold with Carmel Planning & Zoning said a parking stall would measure from the front of a parking bumper, instead of all the way to the curb. This issue will be discussed internally. Amanda Foley – City of Carmel Engineering Department - Project reviewed. Letter will be sent within a few days. Most of the department’s concerns regarding the right-of-way, as well as issues with INDOT. Mr. Terry said INDOT has taken the developer’s CAD file and integrated it with theirs. Mr. Terry also said the developer has met via teleconference with INDOT, as well as the engineering project manager, and also the concrete pavement contractor Milestone, and dirt contractor Gradex. Ms. Foley said there is a storm inlet within the driveway. Mr. Terry said the casting has been revised to make a flat casting. Mr. Terry also said the new plan was to knock down the back half of the curb to essentially make a gutter. Page 3 of 7 WWW.CARMEL.IN.GOV ONE CIVIC SQ. CARMEL, IN 46032 (317) 571-2417 Mr. Schutz said the walkway will also need to be coordinated. Ms. Foley said one of the other concerns was the size of pipe to be used. Mr. Terry said INDOT had proposed a 6-inch pipe to carry the flow of water, but he said he didn’t know why this size was suggested since Carmel’s requirement for right-of-ways is 12-inches. Ms. Foley said there are still many issues up in the air which will need to be clarified. 9:25 a.m. Docket No. 14010009 TAC: Hazel Dell Christian Church Vestibule & Parking Expansion. The applicant seeks administrative approval to add a vestibule and additional parking area to the site, based off the original- approved master plan previously approved by the BZA-Board of Zoning Appeals in 2002. The site is zoned S-1/Residence and is located at 14501 Hazel Dell Pkwy. Filed by David Lach of Cripe Architects & Engineers, on behalf of Hazel Dell Christian Church. David Lach with Cripe Architects and Engineers, and Russ Love with Hazel Dell Christian Church presented on behalf of the petitioner. Mr. Lach said this project is a piece of the overall master plan for the church which was completed back in the 1990’s. The church has done two additions to date, and this will be the third. The children’s ministry wing was the last project to be done, back in 2010. Mr. Lach said when the church was originally built, Hazel Dell Parkway was still under construction, so there was a lot of coordination going on with the City due to the road dedication. Mr. Lach said the site was master planned for the entire build out, but there are some grade challenges due to some low areas that will be redirected to the detention basin per the master drainage plan. Mr. Lach said this drainage discharges to the subdivision to the northeast, and then ultimately to the regulated drain. The church would like to leave as much parking as possible around the front door for guests and visitors. Mr. Lach said there will be a temporary door leading into the vestibule, but this door will go away when the next phase of the project is complete. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. This is all part of the master plan so no further comments. Joanie Clark – Vectren Energy - This project is mostly parking lot so there are no comments. Nick Redden – City of Carmel Engineering Department - Letter sent. No further comments at this time. Shirley Hunter – Duke Energy - Project has not yet been reviewed. Ms. Hunter asked if the grade of the parking lot will be changed. Mr. Lach said the grade will be reduced 2-3 feet on the drive from the current parking lot. Ms. Hunter said Duke will need to discuss this because Duke has a line coming in from the transformer at this location. Dan Davenport – Indianapolis Power & Light - This project is in Duke’s service area. No comments. Chris Ellison – City of Carmel Fire Department - Mr. Ellison asked if there will be any relocates of utilities or fire hydrants. Mr. Lach said there will not be any changes, with the exception of the water line at the children’s ministry which will need to be lowered due to the reduced grade. Mr. Ellison asked if there will be any plans for future hydrants on the site. Mr. Lach said at the construction of the children’s ministry addition, there were T’s installed for future hydrants in the sanctuary area. Daren Mindham - City of Carmel Urban Forestry - Review comments sent. No issues. David Lucas – Hamilton County Highway Department - No comments. Ryan Hartman – Clay Township Regional Waste District - This project is outside CTRWD’s territory. No comments. Angie Conn – City of Carmel Planning & Zoning - Review comments sent. Amanda Foley – City of Carmel Engineering Department - Comments sent. The major items are the Right-of-way location and the thoroughfare plan commitment for future improvements to Hazel Dell Parkway. CARMEL, IN 46032 (317) 571-2417 driveway, and whether this will be used for something else in the future. Mr. Lach said this is currently being used as a maintenance entrance but when the sanctuary is complete the south driveway must be a full dedicated entry access point. There will need to be significant modifications required due to retaining walls and other items. Mr. Lach said David Littlejohn, the City’s Alternative Transportation Coordinator, had required a walkway from the door to the sidewalk, but the developer is requesting an exception to be made for this since this doorway is actually temporary. Mr. Lach said he will contact David Littlejohn directly. 9:35 a.m. Docket No. 14010010 SP: Silvara, Section 1A - Secondary Plat. The applicant seeks administrative secondary plat and construction plans approval for a residential subdivision of 79 lots on 51.15 acres. The site is located at 12115 Clay Center Rd., northwest of 116th St. and Springmill Rd. It is zoned Silvara PUD/Planned Unit Development and is partially in the Special Flood Hazard Area. Filed by Brett Huff of Stoeppelwerth & Assoc., for Silvara Development Company, LLC. Brett Huff with Stoeppelwerth & Associate, and Matt Harlan and Doug Wagner with Republic Development presented on behalf of the petitioner. Mr. Harlan, the project manager, said this is Silvara Section 1-A, the first section of a brand new subdivision. This section contains 79 lots out of a total of 422. Mr. Harlan said the subdivision has a lot of frontage on Spring Mill Road, but this particular section is coming in off Clay Center Road. Mr. Harlan said there will be three different lot sizes for three different products, built by three different builders. Mr. Harlan added that there are two separate electrical providers in this area, which is something the developers will need to work through. Mr. Harlan said this project will use a sustainable type Best Management Practice (BMP) design. He added that there will be no lakes in the community, and plenty of landscaping incorporated into the BMP design. Mr. Harlan said the first lots that will be done are the single family homes, and as the project moves to the Spring Mill Road side, those homes will be more for empty-nesters, so the lots will be somewhat smaller. Greg Hoyes – Hamilton County Surveyor’s Office - This project is still being reviewed. Mr. Hoyes met with Williams Creek already, and his office will finalize a comment letter and have it sent out. Joanie Clark – Vectren Energy - Asked when this project would be started. Mr. Harlan said the developers would like to break ground mid to late summer, and if things go well, the developer would like to try to get the site paved by the end of the year. Ms. Clark said since the developer is requesting gas service as part of this project, Vectren will need an AutoCAD file. Nick Redden – City of Carmel Engineering Department - Project is still being reviewed. Comment letter will be sent as soon as possible. Shirley Hunter – Duke Energy - Ms. Hunter said Duke and IPL are in the process of moving electrical boundaries so service doesn’t cut off in the middle of a lot. Mr. Huff said the change he proposed was intended to divide the boundaries so they didn’t need to cross Williams Creek. Ms. Hunter said if this suggestion is used, the entire phase of the project would be under Duke Energy. If not, the boundary would cut off around common area 12. Ms. Hunter said the boundary would be along Silvara Boulevard. Ms. Hunter said the decision on the boundary will be made by both Duke and IPL, because it will need to be IURC approved process. Ms. Hunter asked what type of builders will be constructing in this subdivision. Mr. Wagner said off Clay Center Road will be custom homes, and then David Weekley homes and Drees Homes will be building in the back section, as these are more high-end production homes. Mr. Wagner asked if Ms. Hunter would like CAD files now, knowing that from the technical side these may change with comments from engineering. Ms. Hunter said she is fine waiting for these until they are complete and won’t be changing. Mr. Wagner said if Duke gets to the point where they need these files, they can provide them. Dan Davenport – Indianapolis Power & Light - No comments. Chris Ellison – City of Carmel Fire Department - No comments. Angie Conn – City of Carmel Planning & Zoning - Review comments sent. Department is awaiting a response. Amanda Foley – City of Carmel Engineering Department - These plans are being reviewed. The biggest issue is the amount of distributed storage areas. Ms. Foley said there is only about one foot of freeboard, so there are definitely flood protection issues, but overall the plans look good. 9:45 a.m. Docket No. 14010011 OA: The Bridges PUD Ordinance Amendment. Docket No. 14010012 DP: Market District & GetGo at The Bridges. Docket No. 14010013 ADLS: Giant Eagle Market District Grocery Store. Docket No. 14010014 ADLS: GetGo Convenience Store & Gas Station. The applicant seeks approval to amend The Bridges PUD Ordinance Z-550-11. The applicant also seeks site plan and design approval for a grocery store/supermarket and a convenience store with fuel/gas station and canopy. The site is located at 11405 Springmill Rd., within The Bridges PUD Commercial Amenity Use Block. The site is zoned PUD/Planned Unit Development. Filed by Charlie Frankenberger of Nelson & Frankenberger, LLP, on behalf of G.B. Managers, Inc. and The Bridges II, LLC. Jon Dobosiewicz and Jim Shinaver with Nelson & Frankenberger, Alen Fetahagic with StructurePoint, and Buzz Weisiger with CWC, presented on behalf of the petitioner. Mr. Dobosiewicz said this site is approximately 16-acres located in the Bridges PUD development, which was approved in 2011. Existing developments on the site today include a CVS Pharmacy, and an additional multi-tenant building along 116th Street. This development will be south of the existing buildings by a few hundred feet, but they will all be connected internally through a driveway network. Mr. Dobosiewicz said the proposed fuel station will be directly abutting and adjacent to Illinois Street, and the supermarket will be further south of that area. Mr. Dobosiewicz said in approximately 30 days, the developers will be in front of the Plan Commission for a public hearing, and after the public hearing they will go in front of the various committees, and will then be back in front of the full Plan Commission for approval, at earliest, in mid April. Mr. Dobosiewicz said along with the plans submitted, the developer has filed for a text amendment to the PUD, but the amendments do not relate to anything technical, but rather, they involve signage, the positioning of one of the district areas on the far southwest corner of the site, as well as a proposed right-in, right-out onto the existing Illinois Street. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. Mr. Hoyes said this complies with the master drainage plan. Joanie Clark – Vectren Energy - Ms. Clark asked when the developer would be starting the project. Mr. Dobosiewicz said they would like to start the project immediately upon receipt of the approvals, but also said if the Council approves this project in May, the developer would likely break ground sometime in the summer or fall of 2014. Mr. Dobosiewicz said the developers would not be back in front of the Technical Advisory Committee for construction plans, and this meeting will serve as the full development meeting. Nick Redden – City of Carmel Engineering Department - Plans are still being reviewed. No comments. Shirley Hunter – Duke Energy - This project is in IP&L’s service area. Dan Davenport – Indianapolis Power & Light - The engineer who did the pole relocation along Spring Mill Road will need to look at the entrances to see if there are any conflicts. Mr. Davenport said once IP&L determines the routing to get the primary cables into the transformer, they will be requesting additional easements to cover the cables. This easement will be a minimum of 15-feet. Chris Ellison – City of Carmel Fire Department - The drawing does not show a PIV for the water shutoff for fire sprinklers, and there is no Fire Department Connection Page 6 of 7 WWW.CARMEL.IN.GOV ONE CIVIC SQ. CARMEL, IN 46032 (317) 571-2417 (FDC). Mr. Ellison said he would prefer to see this away from the building, outside of the collapse zone. Mr. Ellison said the developer would need to sit down and discuss the location of the FDC, so to not obstruct CFD’s access in and out of the parking lot. Mr. Ellison said his recommendation would be that the FDC be located in the island between storm sewers #250 and #191. In this location, there is a small island that could house both a FDC and a fire hydrant. Mr. Ellison said it would be acceptable to have a wall-mounted Post Indicator Valve, but the FDC would need to be away from the building. Daren Mindham - City of Carmel Urban Forestry - Review comments have been sent. Awaiting a response. Mr. Dobosiewicz asked to be copied on all future comments. David Lucas – Hamilton County Highway Department - No comments. Ryan Hartman – Clay Township Regional Waste District - Waiting on plan review fees to finalize comments. Angie Conn – City of Carmel Planning & Zoning - Ms. Conn said she hopes to have review comments sent early next week. The large items of concern have to do with vehicular and pedestrian connectivity, traffic flow and access points, and the gas station signage and outdoor displays. Official review letter will be sent later. Amanda Foley – City of Carmel Engineering Department - Ms. Foley said this project is currently being reviewed. Mr. Dobosiewicz said the developer will need to provide plans to DOCS and Plan Commission on March 7, so it would be helpful to receive comments prior to this date so changes can be implemented. 10:00 a.m. Docket No. 14010019 SP: Overbrook Farms, Sections 2 & 3. The applicant seeks administrative secondary plat and construction plans approval for two sections of a residential subdivision, totaling 43 lots on 36.375 acres. The site is located at 3915 W. 146th Street. The site is zoned S-1/Residence- ROSO III. Filed by David Sexton of Terra Site Development, Inc. on behalf of Fischer Homes. Dave Sexton with Terra Site Development and Richard Henderson with Fischer Homes presented on behalf of the petitioner. Mr. Sexton said this project is located west of Shelborne Road, between 141st Street and 146th Street. Greg Hoyes – Hamilton County Surveyor’s Office - This project is still being reviewed. Comments will be sent by the end of the week. Joanie Clark – Vectren Energy - Ms. Clark asked the anticipated start date. Mr. Henderson said the developer would like to start the project as soon as they receive approvals, but regarding gas service, they will probably be ready by early summer. Nick Redden – City of Carmel Engineering Department - Project is still being reviewed. Comments will be sent as soon as possible. Shirley Hunter – Duke Energy - Project has not been reviewed. Developer will need to submit a service request form, as well as an AutoCAD file. Ms. Hunter said Duke will require an easement to get service in this location. Mr. Henderson said the property where the easement will be located does not currently belong to the developer. Ms. Hunter said she will need to be contacted if additional electrical service will be required for items such as a pond or streetlights, and she said if so, Duke would like to keep these items uniform. Daren Mindham - City of Carmel Urban Forestry - Review comments sent. The main comment was regarding section 2. Mr. Mindham said if anything was changing for this section, this was not included in the roll of plans previously submitted. Mr. Mindham said even if there are no changes, he would like a new set of plans submitted for this section showing the landscape plan. David Lucas – Hamilton County Highway Department - Mr. Lucas said regarding section 3, the deceleration lane will need to be 150-feet and the taper will need to be 100-feet. Mr. Lucas said since this is a temporary entrance, the Highway Department will not require anything more than that. Page 7 of 7 WWW.CARMEL.IN.GOV ONE CIVIC SQ. CARMEL, IN 46032 (317) 571-2417 Regarding the acceleration lane, this can be cut down to 100-feet as well. Mr. Henderson asked if the developer will need to install passing blisters. Mr. Lucas said this is something the department would like to have, but due to the temporary nature of this road, this could be waived since it would be torn out anyway. Mr. Lucas said regarding the secondary plat, there is currently an ingress/egress easement, over the next few months if the Highway Department purchases this property, they will grant the developer a permit, so there is no need for an ingress/egress easement. Mr. Lucas said this property will either be owned by the developer or the Highway Department, and the Highway Department will have the ability to grant access to this area. Because of this, Mr. Lucas said from the Highway Department’s standpoint, they would prefer that this easement not be shown on the plans. Mr. Lucas asked that it be noted on the plat that “This area is for future 146th Street improvement” or “The right-of-way shown on this plat is hereby dedicated to the public”. Ms. Hunter said Duke would be concerned with this area changing grade, since the power lines will be buried. Mr. Lucas said the process of buying this area is taking a long time because the purchase is being done with federal aid, so the Department must follow specific procedures as to not jeopardize this funding. Ms. Foley with Carmel Engineering asked if the detention was moved from this area. Mr. Lucas said there was some roadside detention for this area that was moved to the Bear Creek side, so it will be just west of Overbrook. The Highway Department has worked with Bear Creek to obtain an area that they cannot use as detention. Mr. Lucas said this area is located on the northeast corner of the parcel that cannot be accessed. Ryan Hartman – Clay Township Regional Waste District - Comments sent and revised plans have been received. No further comments. Angie Conn – City of Carmel Planning & Zoning - Comments sent and responses have been received. No further comments. Amanda Foley – City of Carmel Engineering Department - The large items of concern for section 3 are carryover comments from the primary plat review. Some of these issues are regarding direct discharges to the creek along the back of the development, as well as flood plain mitigation. Mr. Sexton said the flood plain mitigation will be provided on-site. Ms. Foley said there are some end sections of the storm water system currently shown on individual lots, and the storm water standards do not currently allow for this since they would often get covered up due to the fact that they are unsightly. Mr. Henderson asked if a low concrete box would be allowed instead of an end section. Ms. Foley said the department would need to look at this further. Mr. Sexton said if these are to be placed on common areas, there would need to be as much as 7-feet taken out to make sure the water can flow down to the end section. Ms. Foley said if the developer would like to deviate from the storm water standards, they would need to request variances.
