HomeMy WebLinkAboutPacketTo Carmel Board of Zoning Appeals From Bill Lambert of Perma Pools Corp., builder and agent for Applicant Re Weldy Pool Variance- Statement in Support Dated February 26, 2014 Project- The Applicant wants to build a swimming pool as an amenity for her home. However, land in her backyard is at a premium. Therefore, the Applicant (i) chose a small pool (15'x34' maximum outside dimensions; however, the pool averages 13'6 "x 32' due to the pool being a freeform -see diagram included with Application.) (ii) has proposed to abut the pool very close to her house and (iii) has proposed some minor variances (varying the 3' buffer to a drainage easement requirement to 1' and varying the 10'side set back to 6'). With these 3 accommodations, the pool proposed is aesthetically correct for this house and the neighborhood. Drainage- There is a 15' drainage and utility easement at the back of the Applicant's property. No construction is proposed in this easement and no regrarding is proposed either. The easement does carry water to a beehive drain to the south but the proposed construction does not impact the current water flow. Landscaping. The Applicant is currently in the process of developing a landscape design. The final design will include screening to the north in the remaining 6' side set back such as arborvitae bushes or comparable screening. To the west in the drainage easement, we have made contact with engineering (Fred Glazier) to see what landscaping would be acceptable in the first few feet of the easement. The Applicant would like to do some screening there also consistent with not impeding the flow of water in the easement. The Applicant understands that any landscaping placed in the easement will be at risk of being ripped out if any beneficiary of the easement needs to do so and that the cost of such demolition would be on the Applicant. Conclusion. The Applicant has selected a small pool and pulled it fairly close to her house in order to minimize the requested variances. There is no adverse impact on drainage or the aesthetics of neighboring properties. Absent the grant of these variances, the Applicant would be deprived of the ability to construct a common residential amenity on her property NOTICE OF PUBLIC HEARING BEFORE THE CARMEL /CLAY ADVISORY BOARD OF ZONING APPEALS DOCKET NO 14030001 V; 14030002 V Notice is hereby given that the Carmel /Clay Board of Zoning Appeals will meet on the 24`x' day of March, 2014 at 5:15 pin in the City Hall Caucus Rooms, 1 Civic Square, Carmel, Indiana 46032 and hold a Public Hearing upon a Development Standards Variance application to permit the construction of an in ground pool and concrete deck on Applicant's property. To facilitate such construction, Applicant has requested variances from Carmel /Clay Zoning Ordinance Chapter 25.01.01 C.8.a.i. to permit a side yard setback of 6' instead of the required 10' and Chapter 25.01.01 C.8.a. to permit the building of a concrete pool deck within l'of a drainage and utility easement instead of the required 3' and to permit construction within 16' of the rear property line notwithstanding a 20' building setback line in the rear. The subject property affected by the application is owned by Abe and Jennifer Weldy and is known as 14482 Smickle Lane, Carmel, Indiana 46033 and has a legal description of Lot 14, Cherry Tree Grove, Carmel, and County of Hamilton, Indiana. The application is identified as Docket No. 14030001 V; 14030002 V.
