Dear Mr. Popovich:
The City of Cannel, Department of Community Services is in receipt of a letter dated
December 23, 2013,to Virtu Meridian Associates, LLC,requesting from Carmel a letter
addressing zoning conformance issues which result from the right-of-way purchase
associated with the Illinois Street Extension construction project(the Project) to the above
referenced real estate, commonly known as 301 103rd Street,Cannel,Indiana(the Real
Estate).
After review of the engineered plans for the Project, it is determined by this office that the
loss of parking spaces will have no meaningful impact on the 543 spaces required by
zoning for the Real Estate. However,the loss of landscape area between the parking lot
and Illinois Street right-of-way does affect the approved development plan for the Real-
Estate,per Docket 32-89 DP/ADLS which provides for a twenty(20)foot wide green
planting area between the street and parking lot. Additionally, the current landscaping
standards of the City requires a fifteen(15)foot wide landscape buffer between the edge
of parking and the right-of-way for parkway and arterial streets which will also be
impacted.
Because this impact is a result of actions by the City of Carmel and not by the property
owner, this office would not consider or classify the Real Estate to be out of compliance
with Cannel's Zoning Ordinance. Further, it is understood and agreed that any
landscaping disturbed by the Project is the responsibility of the City to replace or repair.
If the you or other affected party is sufficiently concerned about the impacts from the
Project that a variance from the landscaping standards is desired,the Department of
Community Services is pleased to assist with the application process as may be required.
