CARMEL PLAN COMMISSION MINUTES - APRIL 15, 1986 -- 7
The regular meeting of the Carmel Plan Commission was called to order by
the president, Richard Albright, at 7: 36 P.M. April 15, 1986 at the City
Meeting Hall. The meeting opened with the Pledge of Allegiance.
Roll was called and members present were: Richard Albright, Sandra Long,
Max Moore, Ila Badger, Vaughn Story (arrived 7:40) , Jeff Davis, Minnie Doane,
Henrietta Lamb, Jim O'Neal, Sr. , Sue McMullen, Paul Ayers, Bob Boone and Jim
—" Schneider.
Staff members in attendance were: Chuck Kiphart, Dave Rickard, Gordon
Byers and Rosalind McCart.
There were no additions or corrections to the minutes of the March 18, 1986
meeting and Mrs. Badger moved that they be approved as submitted.
Seconded by Mr. Moore.
Motion carried.
Mr. Kiphart announced that Dave Rickard is now the Assistant Director of -
the Dept. of Community Development in place of Kurt Woerner who has moved
to Fishers, IN. as Planner.
Mr. Albright related that the Plan Commission will have a Special Meeting.

G. Public Hearings
lg. 7: 30 P.M. , Public Hearing on Docket No. 20-86 P.P. , Primary Plat Appli-
cation for Bridlebourne Subdivision consisting of 65 lots on 164.53
acres zoned S-1. Project is located on Snelbourne Rd. approx. 1300 ft.
north of 106th St. in Clay Twp. Subdivision variances requested for
private streets (sec. 8. 3. 20) and for non-paved connecting roads over
pipeline (sec. 8.3.2) .

The public hearing opened at 7:42 with Mr. Cordingly making the presentation
for a new subdivision to be approximately 1300 ft. nortn of 106th St. The
petitioner wishes to subdivide 164 acres into 65 mini-estates of at least an
- acre each.
The primary plat and site plan were shown.
The site and development concept plan as prepared by David Klauba, land-
scape architect, was presented and explained by Mr. Cordingly.
There will be two lakes and bridal paths and the entrance way will be stone.
An architect' s rendering of the aquestrian center and a cross section of
the exterior mounds were shown.
The petitioner wishes to encourage 4 to 6,000 s,1. ft. homes and private
roads are requested for an estate type aevelopment.
About 20 acres is in wooded buffer.
The petitioner requests that the connecting roads be of a stone material.
Regarding the stubbing of streets , they hope that the Commission will find
it unnecessary to do so as the petitioner wants c.n interior road system that
is not penetrated at any of its borders.
There are two entrance ways to the development and no cul-de-sacs.
Mel Pearlman, 3030 W. 116th St. , questioned drainage.
Mr. Cordingly said that there will be a reconstruction of the Osborne
Drain and the lakes in place will solve the problems as well as be attractive .
Chester Clingerman, ?55 Alwyne Rd. , asked if any of the drainage from this
property would penetrate the property to the north.
Mr. Cordingly explained the drainage pattern.
The public hearing closed at 8: 20.
Mrs. Badger questioned the riding stable and stated that that will have to
go before the Board of Zoning Appeals for a Special Use.
The horse stalls will only be used by the owners and the petitioner is
_.._..willing to covenant to that.
Regarding horse trailers, Mr. Cordingly said they do not want them to
appear anywhere and this can be addressed. They want no outside storage of
such and this can be included in the covenants.

Mr. Cordingly said the development will not actually be fenced around
but mounded and landscaped with trees.
The petitioner will widen Shelbourne Rd. to 22 ft. wide in front of their

A.M. on Thursday, April 17 , 1986 and by the Subdivision Committee on May 13,
1986 at 7: 30 P.M. at the City Meeting Hall. ----
H. Old Business
lh. Commission to consider Docket No. 7-86 P.P. , Primary Plat Application
for Smoky Ridge Subdivision containing 26 lots on 12.703 acres located
at the N.W. corner of 136th St. and Carey Ra. in Clay Twp. Existing
zoning is R-1 single family residential.

2h. Commission to consider Docket No. 8-86 S.P. , Secondary Plat Application
for Smoky Ridge Subdivision containing 26 lots on 12.703 acres located

Mr. Lipps was present.
Mr. Davis Coots made the presentation stating that this matter was before
t}e Commission at the March 18 , 1986 meeting receiving a vote of 6 For, 4 No
on the primary and secondary plat applications.
Mr. Coots said that subsequent to that meeting he met briefly with Mr.
Davis at the Subdivision Committee meeting on April 1 , 1986 and explaining the
issue to be whether or not the streets are to include the installation of a
stubbed street to the north of the subdivision into an undeveloped larger
parcel of real estate to the north or whether or not ti,at installation of
the stubbed street at some time in the future can be accomodated to the Plan
Commission and the cities satisfaction by securing in the form of an irrev-
ocable letter of credit or bond.
Subse,luent to the meeting Mr. Coots said he determined that the cost to in-
stall the road to be $5,420.00 and our proposal is th-t the petitioner irrev-
ocably bind himself to install that road to the tune of 120% of its cost for
( purposes of going forward with the development.
Mr. Kiphart stated .that they just don't want it deterred that a road comes
down from the north if it is ever needed.
Mr. Davis moved that Docket No. 7-86 P. P. be approved for primary plat with
• the petitioner presenting an irrevocable letter of credit for the completion of
the stubbing of the street to the north.
Seconded by Mrs. McMullen.
Mr. Story commented stating that he will vote against this if the street
stubbing is not installed as a part of this petition.
Much discussion followed.
Mr. Boone asked to abstain from participating in this matter.
Findings of fact were completed by members for the vote on the Primary Plat
which included the errevocable letter of credit for the stubbed street.
Motion carried 7 For, 5 Against, 1 abstaining.
Miss Doane moved approval of the Secondary Plat, Docket No. 8-86 S. P. , with
the petitioner presenting an irrevocable letter of credit for the completion
of the stubbing of the street to the north.
Seconded by Mrs. Badger.
The vote was 7 For, 5 Against, 1 abstaining.
Motion carried.
3h. Commission to consider Docket No. 15-86 P. P. , Primary Plat Application
for Woodfield Subdivision, Sections 4 & 5 consisting of 71 lots on
45.03 acres zoned R-1 . Project is located N.E. of present Woodfield

Subdivision, south of 146th St. and east of Gray Rd. in Carmel, IN.
No variances requested. Area is zoned R-1.

Mr. Schneider gave the Subdivision Committee report (which is a part of
the official minutes and attached to the master copy) .
The Committee recommended approval and Mr. Schneider so moved.
Seconded by Dr. Long.
The plat was shown by Mr. Langston for Sections 4 & 5.
Ballots were completed by members.
Motion carried 13 to 0.
At this time Mr. Kiphart reported that Mr. Albright and he have reviewed
the Comprehensive Plan from Woolpert Consultants. The large report will be
ready in 3 weeks and the brochure will be ready in about 4 weeks from Woolpert.
4h. Commission to consider Docket No. 16-86 D.P./ADLS, For a B-7 Develop-
ment Plan and Architectural Design, Lighting and Signage review for re-
novation of existing church building located at 531 S. Guilford in
Carmel, IN. Building is converted from church to office use. Size
• of parcel is 6. 07 acres.
Filed by Indiana Assn. Church of God: 0.W. Dickinson.
Mr. Dickinson was present.
Mr. Boone gave the Industrial and Commercial Committee report (which is a
part of the official minutes and attached to the master copy) .
The Committee recommended approval as presented with the petitioner to
have available for presentation on April 15, 1986 the alternative landscape
plan , whereby the full Plan Commission would have the opportunity to take
whatever action they felt appropriate . Further, that tne dimensions of tree
sign be added, and that the size thereof be in compliance with the ordinance .
Mr. Boone so moved.

An improved landscape plan will be presented to Yr. itiphart' s office and
a sign plan was presented at this meeting with dimensions indicated .
Motion carried 13 to O.
5h. Commission to consider Docket No. 17-86 P. P. , Primary Plat Application
for Ironwood Subdivision (one section only) consisting of 31 lots on
57 .83 acres in 'an S-1 Zoned District. Project is located on tne south
side of 106th St. and 1000 ft. west of Ditch Rd. in Clay Twp. Petition-
er is requesting a variance from Sec . 6. 3.20 , Carmel Subdivision Reg-
.
ulation, to allow for private streets , and Sec. 6. 3.6, to allow for
18 ft. street/driveways.
Filed by R.J. Klein for 106th Street Development , Inc.
Mr. Klein was present.
A letter was received from F. Boyd Hovde, a resident across from the subject
property, (which, is a part of the official minutes and attached to the master
copy) , and was read by Mr. Albright. The letter stated support of the proposal
with two reservations: 1) accel and decel are not of adequate length and 2)
the Commission should be satisfied that tne drainage proposed is adequate so
as not to infringe on the rights of the property owners both adjacent to the
subject property and on the north side of 106th St.
Mr. Davis gave the Subdivision Committee report (which is a part of the
official minutes and attached to the master copy) . .
The Committee recommended approval and Mr. Davis so moved.
Seconded by Mr. Schneider.
_ Mr. Klein explained the decel lane length.
Mr. Klein said the reason for no sidewalks is because of the topography of
the property. Sidewalks in front would be useless on 106th St. and would
serve no purpose.

Mr. O'Neal questioned interior sidewalks.
Mr. Klein said they are not in keeping with the estate atmosphere.
Findings of fact were completed by members.
Motion carried 9 to i(Mrt O'Neal , Dr. Long.., Mr ' Story and Mr. Boone vot-
ing NO) .
In addition, for R. J. Klein, Lot 6, Winterwooct Subdivision, regarding
encroachment into platted drainage and utility easement rear of lot 6 by
12' - 15 ' high concrete retaining walls for a tennis court.
Mr. Klein requested by letter, dated April 10 , 1986, to bring this matter
before the Commission this evening and the request was approved by Mr.
Albright and Mr. Davis.
Mr. Klein made the presentation showing the plat.
Mr. Byers, Commission attorney, said the Plan Commission does not have
the authority to authorize an enroachment and that this is not a Plan Com-
mission matter.
6h. Commission to consider Docket No. 18-86 D.P. , A request to amend the
original Development Plan for the Ritz Charles Banquet facility by
expanding the existing parking area by 82 spaces. This will ,also re-
quire an amendment to the drainage system for this facility. Facility
is located at 12156 N. Meridian St. in the Corridor Overlay Zone in a
B-6 District.

Mr. Lazarra was present.
Mr. Boone gave the Industrial and Commercial Committee report (which is
a part of the official minutes and attachea to the master copy) .
The committee recommended approval and Mr. Boone so moved.
Seconded by Mrs. McMullen.
Mr. Lazarra stated that he is going to put the plantings in and related
that the steel storage facility will be eliminated as soon as they get their
storage area added to the main facility.
After payment of the parking lot, Mr. Lazarra said he can consider squar-
ing off the building for this attached storage area.
Motion carried 13 to 0 .
I. New Business
li. Commission to consider Docket No . 19-86 ADLS, Architectural Design,
Lighting and Signage Application for Executive Plaza, a ten building
office/commercial complex containing 81,600 sq. ft. of lease space
on a 10 .1 acre site. Project is located at approx. 202 E. Carmel Dr.
and is zoned B-8.
Filed by D. H. Clark & Associates Inc.
Mr. Coots made the presentation showing the location map, site and land-
scape plans and an architect' s rendering of the building.
Signage was presented for the building.
There will be pine trees as a buffer around the property.
There will be 16 ft. high standards for lighting and on building down
lighting fixtures.
Parking spaces exceed ordinance requirements.
This item will be reviewed by the Technical Advisory Committee at 9:45 A.M.
Thursday, April 17 , 1986 and by the Industrial and Commercial Committee on
May 13 at the City Meeting Hall.
2i. Commission to consider Docket No. 21-86 S. P. , Secondary Plat Appli-
cation for Woodgate Subdivision, Section 2, containing 12 lots on
7 .09 acres zoned R-1 . Project is located west of Gray Rd. , south of
146th St. and just north of the existing Cool Creek North Subdivision
in Carmel , IN.

zoned S-1. Project is located N.E. of existing Woodfield Subdivision,
south of 146th St. and east of Gray Rd. in Carmel, IN.

4i. Commission to consider Docket No. 23-86 S. P. , A Replat of Lot 121
Newark Village in order to include as part of the lot the vacated
Napanee Dr. land to the north of the lot. Property is zoned R-2
and is located at 1015 Oswego Rd. in Carmel , IN.
Filed by John J. and Betty J. Morris.
Mr.' Morris made the presentation explaining the request for replat.
The request is to realign lots 121 and 122.
The petitioner is trying to develop an 80 ft. lot to either sell or build
a new home on for himself.
Mr. Davis moved to suspend the rules and act on this matter tonight.
Seconded by Mrs. McMullen.
Motion carried.
Mr. Ayers moved to approve the realignment request of lots 121 and 122,
Docket No . 23-86 S. P.
Seconded by Mrs. McMullen.
Motion carried.
Mr. Albright . read a letter to Mr. Kiphart from Richard Rembusch, dated
April 10 , 1986, regarding the proposed 3 story office building, Meridian
__._ Technology Center. Tney re,juest that this go to the Industrial and Com-
mercial Committee for review on May 13., 1986 and then come before the full
Plan Commission on May 40, 1986.
Mr. Story stated that a revision is needed of the Subdivision Control
Ordinance.
Mr. Albright concurred that it is necessary to start a review.
The Dept. of Community Development is to put on the Committee Agenda
that the Overlay Committee and Comprehensive Plan Committee are to lay out
' what is to be accomplished for the year and for the Subdivision Committee
to begin reviewing the Subdivision Control Ordinance and for the Land Use
Committee to look into the parking requirements for within shopping centers.
Mr. Albright announced a panel discussion to be held April 47, 1986 at
' 7:00 P.M. at the Noblesville Auditorium on the subject of county wide zoning.
There being no further business to come before the Commission, the meet-
ing adjourned.
