March 18 , 1986 at the City Meeting Hall. The meet- ing opened with the Pledge of Allegiance. Roll was called and members present were: Henrietta Lamb, Jim O'Neal, Sr. , Sue McMullen, Minnie Doane , Paul Ayers, Sandra Long, Ila Badger, Bob Boone, Jim Schneider, Max Moore and Vaughn Story. Absent were: Richard Albright -- and Jeff Davis. Staff members present were: Chuck Kiphart, Dave Rickard, Gordon Byers and Rosalind McCart. There were no additions or corrections to the minutes of the February 18 , 1986 meeting and Mr. Boone moved that they be approved as submitted. Seconded by Miss Doane . Motion carried. On April 29, 1986 there will be a Special Plan Commission Meeting at 7: 30 P.M. at the City Meeting Hall on the topic of drainage with Mr. Tom Schell- enberger, Mr. John South and Mr. Kent Ward. The Land Use Committee is to look into the parking space requirements for shopping centers and restaurants. An updating of the ordinance is necessary. G . Public Hearings lg. ?: 30 P.M. , Public Hearing on Docket No. 15-86 P. P. , Primary Plat Appli- cation for Woodfield Subdivision, Sections 4 & 5, consisting of 71 lots on 45.03 acres of land zoned R-1. Project is located N.E. of present Woodfield Subdivision, south of 146th St. and east of Gray Rd. in Carmel, IN. No variances requested. Area zoned R-l. Filed by Bob Langston. The public hearing opened at 7 :40 with Mr. Langston making the presentation. Mr. Stan Neal of Weihe Engineering was present. The plat was shown and copies were passed to members. Mr. Langston related that a discussion of streets , right-of-ways, cul-de- - sacs etc. will begin following the next Subdivision Committee meeting on April 1, 1986 at the City Meeting Hall. Mr. Mike Moroney, 5307 Woodfield Dr. , questioned the service entrance and a new exit to 146th St. and spoke of concern for additional exits on Gray Rd. and traffic problems. Esther Tharp, adjacent property owner, asked if there will be sewers. Mr. Langston said there will be sewers and water. Letters in opposition from Genvieve Noble , 1685 Clinton St. , Noblesville , IN. , and Robert White, R.R. 6, Box 379, Noblesville, IN. , were read by Mrs.. McMullen and are a part of the official minutes and attached to the master copy. The public hearing closed at 7 : 58. Mr. O'Neal asked if they plan to conserve any trees. Mr. Langston said they plan to preserve as many trees as possible. Mr. Langston requested that they not have to put in sidewalks on 6 lots that are totally wooded. The petitioner is also asking for private streets at this time . This item will be reviewed by TAC at 9: 15 A.M. Thursday, March 20 , and by the Subdivision Committee at 7 : 30 P.M. , April 1 , 1986 at the City Meeting Hall. 2g. 7: 30 P.M. , Public Hearing on Docket No. 16-86 D.P./ADLS, For a B-7 Development Plan and Architectural Design, Lighting and Signage review for renovation of existing church building located at 531 S. Guilford in Carmel , IN. Building is converted from church to office use. Size of parcel is 6.07 acres. Filed by Indiana Assn. Church of God: O .W. Dickinson. The public hearing opened at 8: 07 with Mr. Dickinson making the presentation for the conversion of the church to an office use for the church administration. The petitioner intends to provide a hard surface parking lot. J., •MEL PLAN COMMISSION MINUTES - MARCH 18, 1986 Page'2 There will be landscaping across the front and Mr. Dickinson related that they are aware of the green belt requirement around the north and east sides of the property and that they do plan to develop that in stages. Dick Vogt, Oak Dr. , spoke'in favor of the ' petition. The building development plan was shown. There will be a ground sign that 'meets ordinance requirements. The public hearing closed at 8: 12. --- Twenty three parking spaces will be provided. 500 sq. ft. will be added to the 2800 sq. ft. existing building. The lighting plan was explained for a standard in the parking lot and a light at the building entrance. The refuse will be inside the new addition to the building. This item will be reviewed by TAC on Thursday, March 20 , at 10:00 A.M. and by the Industrial and Commercial Committee on April 1 , 1986 at ?: 30 P.M. at the City Meeting Hall. 3g. 7: 30 P.M. , Public Hearing on Docket No. 17-86 P.P. , Primary Plat Appli- cation for Ironwood Subdivision (one section only) consisting of 31 lots on 57 .83 acres of land in an S-1 Zoned District. Project is located on the south side of 106th St. and 1000 ft. west of Ditch Rd. in Clay Twp. Petitioner is requesting a variance from Sec. 6. 3.20 , Carmel Subdiv- ision Regulation, to allow for private streets , and Sec. 6.3.6 to allow for 18 ft. street/driveways. Filed by R.J. Klein for 106th Street Development, Inc. The public hearing opened at 8:20 with Mike Terry of Mid-States Engineering making the presentation. Mr. Klein was present. The site plan was shown. The entrance will be off of 106th St. There are two variances requested: 1) private drives and 2) a waiver on street width from 26 ft. down to 18 ft. Mr. Charles Whitsitt , V. Pres . of Indianapolis Horse Patrol (neighboring property) , spoke of concern for the future of the Indianapolis Horse Patrol when it becomes completely surrounded by homes. Mr. Whitsitt said they have horse shows and gun shoots and there is noice and traffic. Mr. Whitsitt said that they do plan to expand and they do not want complaints regarding their facility coming in to them as a result of this residential development so nearby. A letter from Steven R. Young, M.D. , 1700 W. 106th St. , was read by Mrs. McMullen (which is a part of the official minutes and attached to the master copy) . Mr. Young stated 3 issues concerning Ironwood development that need to be addressed: 1) density, 2) acceleration and deceleration lanes and 3) drainage . Mr. Whitsitt commented further that they would have to register a complaint about this project at this time until their concerns are satisfied. Perry Meek, 1731 W. 106th St . , made remarks in support of the project. The public hearing closed at 8:40. This item was sent to TAC for 10: 30 A.M. Thursday, March 20 , and to the Subdivision Committee for review on April 1 , 1986 at the City Meeting Hall. H. Old Business lh. Commission to consider Docket No. 7-86 P.P. , Primary Plat Application for Smoky Ridge Subdivision, containing 26 lots on 12.703 acres of land, located at the N.W. corner of 136th St. and Carey Rd. in Clay Twp. Existing zoning is R-1 , single family residential. Filed by Paul Lipps. Mr. Boone requested to abstain from voting and comment on this item due to a possible conflict of interest. Mr. Davis was not present and there were no committee minutes submitted for this item. CARMEL PLAN COMMISSION MINUTES - MARCH' 18 , 1986 Page 3 3 Mr. Schneider gave an oral report stating a recommendation of approval by the Subdivision Committee and Mr. Schneider so moved. Seconded by Miss Doane. Mr. Lipps was present and Mr. Davis Coots made a presentation showing the Primary Plat. Mr. Coots explained the street installation and problems that will arise. Mr. Coots said the only concern is how the street construction is to be funded by the petitioner and how is that money to be guaranteed to be there for future use when the Dinkelacker property is developed. Mr. Story said he feels that the developer should put in the stubbed street when building the area or else he should not get approval. Mr. Kiphart read from the ordinance concerning extending streets. Mr. Lipps related that the reason he does not wish to stub the street now is that they can become unsightly. Mr. Lipps said that he would like to work it out in another manner by putting money aside in some manner, perhaps in escrow. The petitioner is also asking for a variance to permit the private streets and that is a part of the motion. Mr. Ayers moved to amend the previous motion to include provision for a 50 ft. right-of-way between lots 8 and 9. The right-of-way shall remain for the use of the property owners and for 8 and 9 until such time that the property to the north is developed and that someway the Commission or the city receive a renewable irrevocable letter of credit to establish enough funds so that it will be available when the road needs to go through. Mr. Byers said that this would be one way of doing it, but in general cities do not want to get in the escrow business or holding irrevocable letters of credit. The motion died for lack of a second. Mr. Kiphart said how about having the irrevocable letter of credit made out to the Homeowners Assn. for the specific purpose of installing this street. Mr. Schneider restated his motion to approve Docket No. 7-86 P. P. with provided for a possible stubbed street to the north. Mr. Coots said the developer will execute a performance bond running to the City of Carmel for purposes of installation of the paving of that street if and when required by the Plan Commission in conjunction with future dev- elopment to the north. Mr. Coots said this would be a better solution and would be a part of their amended petition. Mr. Schneider so moved that this be a part of the motion. Seconded by Miss Doane . The entire motion was restated by Mr. Schneider as follows: That the. Commission approve Docket No . 7-86 P.P. and providing for a performance bond to cover the possible improvement of a approximately 837 ft. plus street to the north at a future date. Findings of fact were completed by members. The vote was 6 For, 4 Against, 1 Abstaining (Mr. Boone. ) Seven votes are needed for approval and no decision was rendered. 2h. Commission to consider Docket No. 8-86 S.P. , Secondary Plat Application for Smoky Ridge Subdivision containing 26 lots on 12.703 acres of land located at the N.W. corner of 136th St. and Carey Rd. in Clay Twp. Existing zoning is R-1 , single family residential. Filed by Paul Lipps. • • As a result of the "no decision" vote on the above item, Docket No. 7-86 P.P this item was not considered. 3h. Commission to consider Docket No. 9-86 P.P., Primary Plat Application for Trues Dales Subdivision containing 11 lots on 6.80 acres of land located north of 136th St. 2000 ft. east of U.S. 31 (Meridian St. ) . Part of subdivision is located within the U.S. 31 Corridor Overlay Zone and will need approval variance by the Carmel Board of Zoning Appeals. Existing zoning is R-1, single family residential. Mr. Kiphart explained that more information regarding the flood plain was needed and that the flood plain information was presented to the Subdivision Committee, which does comply, and the Committee, decided to go ahead and vote on the matter. Seconded by Miss Doane. The primary plat was shown and explained by Mr. Coots. Mrs. Lamb asked if TAC requirements have been met. Mr. Kiphart explained. Mr. Story asked how the petitioner is avoiding the flood plain limit. Mr. Kiphart commented further. Findings of fact were completed by members. The vote was 3 For, 8 Against. No decision was rendered. 4h. Commission to consider Docket No. 10-86 S. P. , Secondary Plat Applicatior for Trues Dales Subdivision containing 11 lots on 6.80 acres of land located north of 136th St. , 2000 ft. east of U.S. 31 (Meridian St. ) . Part of subdivision is located within the U.S. 31 Corridor Overlay Zone and will need approval variance by the Carmel Board of Zoning Appeals. Existing zoning i R-1, single family residential. Filed by John & Max Truesdale. (REMAINS TABLED AT SUBDIVISION AND TAC COMMITTEES) This item remains tabled. 5h. Commission to consider Docket No. 36-85 P.P. (Amendment) , An amendment to the original Primary Plat for Woodgate Subdivision. This change deals with the relocation of the proposed recreational facilities from the center of Woodgate Subdivision to the west property line of the subdivision; four building lots will also be relocated as a result of relocating the recreational facilities. The site is zoned R-1 , single family residential , and located south of 146th St. between Carey Rd. and Gray Rd. in Carmel, IN. Filed by Bob Langston. Mr. Stan Neal of Weihe Engineering was present. Mr. Davis was not present and no committee report was submitted. Mr. Schneider summarized the committee meeting report orally. The Subdivision Committee recommended approval and Mr. Schneider so moved. Seconded by Mr. Moore. Mr. Neal explained the change in location of the recreation area. The vote was unanimous for approval. 6h. Commission to consider Docket No. 60-85 Z , Rezone Application for a parcel of ground 16. 38 acres in size located at the S.E. corner of Pennsylvania St. and 116th St. in Clay Twp. The zoning change is from the existing R-1 to R-3 and B-3 zones with proposed covenanted use. Filed by Lenard Wolfson; property owner-Albert & Adele Lowe. (TABLED BY PLAN COMMISSION 2/18/86) Mr. Wolfson and Mr. Mike Kias were present. This item was tabled by the Plan Commission last month for one month. The February 4, 1986 Land Use Committee report was read by Mrs. Badger. Mrs. Badger gave the March Land Use Committee report (which is a part of the official minutes and attached to the master copy) . Mr. Boone moved to place this item on the table for consideration this evening. A low profile concept. Discussion followed by members regarding the request. Mrs. Badger suggested that the petitioner withdraw this item. Mrs. Badger stated that she did not ever say that she would never vote for anything other than office. The petitioner withdrew the petition. 7h. Commission to consider Docket No. 11-86 ADLS, For Green on Meridian Sign Package Change for multi-building complex located within the U. S. 31 Corridor Overlay Zone. Existing zoning is B-5. Project is located at the S.E. corner of 103rd St. and U. S. 31 (Meridian St. ) , 10291 N. Meridian St. in Clay Twp. Indiana. Filed by Cederwood Construction Co. Mr. John Jamison was present. Mr. Boone gave the Industrial and Commercial Committee report (which is a part of the official minutes and attached to the master copy) . The committee recommended approval per the presentation and Mr. Boone so moved. Seconded by Mr. Story. The vote was unanimous for approval. 8h. Commission to consider Docket No. 13-86 Z , Rezone Application for a parcel of ground 1.99 acres in size located at 839 N. Range Line Rd. , Carmel, IN. Request is to change the zone classification from an ex- ' isting R-1 , Residential District, to a B-3, Business District. Con- ceptual Development Plan is being presented by petitioner as a part of the rezone request. All uses in a B-3 district also require a Special Use approval by the Carmel Board of Zoning Appeals. Filed by Ron Young. (TABLED AT LAND USE COMMITTER 3/4/86) The' petitioner was not present. Mrs. Badger gave some of the committee ' s concerns: 1) a narrow strip of land between subject property and Jack' s Tool Rental , 2) 13 ft. wide access road going back to the property, 3) 20 x 22 ft. office area to be attached to a 40 x 60 ft. building and 4) multi-family use presently on property. Mrs. Badger said there was no vote taken at committee. Mr. Story said this item should be taken off the agenda until the petition- er gets in compliance. Mr. Kiphart made comments. Mrs. Badger moved that 13-862 , Rezone Application for a 1. 99 acre parcel of ground at 839 N. Range Line Rd. , be approved as presented. Seconded by Mr. Story. The petition was denied unanimously. Commission to consider Docket No. 14-86, Subdivision Sign Review re- quest for Hunters Knoll Subdivision located at Rohrer Rd. and 136th St. for two signs 19.5 sq. ft. in size located on brick walls 6 ft. high, using gold finish individual letters. Filed by C.P. Morgan Co. Mr. Jim Nelson made the presentation showing a rendering of the subdivision entry signage . Mr. Mark Boyce was present for C.P. Morgan Company. A brick wall will be on each side of the main entrance into the subdivision. Individual gold letters will be mounted on each wall spelling the sub- division name. (19.5 sq. ft. for each sign) . Each sign will be ground lighted. The light globes will be shielded. Five trees will be located behind each wall sign with a flower bed in front. Commission to consider Docket No . 18-86 D.P. , A request to amend the original Development Plan for the Ritz Charles Banquet facility by expanding the existing parking area by 82 spaces; this will also requirE an amendment to the drainage system for this facility. Facility is located at 12156 N. Meridian St. in the Corridor Overlay Zone in a B-6 District. Filed by Charles Lazzara. Mr. Lazzara was present. The plan was shown. This plan shows straight curbs. All the present curbs are rolled. This item will be reviewed by TAC at 11: 15 A.M. Thursday, March 20 ,. and by the Industrial and Commercial Committee on April 1 , 1986 at the City Meeting Hall.
