HomeMy WebLinkAboutTree preservation on lots s4 Glen Oaks 3 G Proposed written policies regarding tree preservation on Lots. We traditionally have two documents that govern the construction process within our communities, the Declaration of Covenants, Conditions, and Restrictions and the Design Guidelines. The Covenants are the recorded document that is cross referenced with the recorded plat(s) for the community. The Design Guidelines are intended to clarify and give a more detailed description of the Developer's intent of the standards stated in the Covenants. The Design Guidelines are more of a living document that is continually amended and updated as situations arise within the community that need to be addressed. Below is the verbiage we intend to include in the documents as they pertain to tree preservation, beginning with the Covenants. DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR GLEN OAKS DEFINITIONS. The following are the definitions of the terms as they are used in this Declaration: "Design Guidelines" shall mean the set documents established by the Developer and after the Applicable Date, by the Association, to establish minimum standards of design, construction and maintenance, which are consistent with the level of quality and character desired for Glen Oaks and the Covenants and to assist builders and homeowners in the planning, design, maintenance, and construction of all site improvements. Section 1. Lot Use and Maintenance. A. All Lots in this Development are reserved for residential use and no building other than a single family Dwelling shall be erected thereon. All plans, in accordance with the submittal requirements as set forth in the Design Guidelines, for all Dwellings are to be submitted to the Developer for approval prior to any construction. Section 14. Time Period to Commence and Complete Construction and Landscaping. All construction upon, landscaping of and other improvement to a Lot shall be completed strictly in accordance with the plans approved by the Developer or Committee and in accordance with the Design Guidelines. Section 19. Construction on Wooded Lots. Special care is to be taken when constructing residences on wooded Lots (Lots numbered 5 through 7 inclusive, and 9 through 31 inclusive) within Glen Oaks. Construction on these Lots shall occur in accordance with the Standards for Construction on Wooded Lots as set forth in the Design Guidelines. These Standards include but are not limited to a pre construction meeting with the Developer's designated Arborist, installation of protection construction fencing at locations determined by the Developer and Arborist at the pre construction meeting prior to Lot disturbance, and the fertilization and "Fr" watering of trees adjacent to construction activity if deemed necessary by the Arborist. Fenced locations are to be left undisturbed, free of construction material, construction debris, the parking of vehicles and grade changes. In the event the Builder /Lot owner take action(s) or fails to take action(s) that do not abide by the above andlor the Design Guidelines, and the result is the loss of a preserved tree, said Builder /Lot owner shall plant tree(s) of similar type and of caliper inch sizes that, in total, equal the caliper inch size(s) of damaged tree(s) upon the Lot or other area as designated by the Developer or Arborist. GLEN OAKS DESIGN GUIDELINES W\) oGS D. Standards For Construction on Wooded Lots. Careful consideration has been given to the existing trees throughout the d ssigiQ g gn� approval, and construction of the Glen Oaks Community. To ensure the continued preservation of existing trees, the builders/ lot owners constructing dwellings on Lots numbered 5 through 7 inclusive, and 9 through 31 inclusive, shall be required to perform the following in addition to the procedures outlined above. 1. Pre construction Conference with Developer and Developer's Arborist. After the home is staked and prior to any Lot disturbance, all Builders and or Lot Owner's shall meet with the Developer and Developer's Arborist to determine; 1) if any adjustments need to be made in the Dwelling's design or placement on the Lot, 2) locations for construction fencing, and 3) if any fertilization or watering is needed prior to, during, or after construction. 2. Construction Fencing. Prior to construction Builder and or Lot Owner shall have the construction fencing installed at locations and of the standards as discussed at the pre construction meeting. Throughout construction the fencing shall be maintained intact. Fenced locations are to be left undisturbed, free of construction material, construction debris, the parking of vehicles and grade changes. 3. Inspections and Compliance. Developer and/or Developer's Arborist will make periodic inspections of each construction site to ensure construction fencing is properly maintained and that preservation guidelines are being followed. In the event repairs need to be made or violations within preservation areas are incurring, Builder and or Lot Owner shall take steps to remedy the situation within 48 hour of notice. In the event Builder and or Lot Owner fails to remedy the violation within the stated time period, the Developer shall remedy the violation and the costs of said remedy shall be deducted from the construction deposit to be returned upon Dwelling completion. In the event the Builder and or Lot Owner take action(s) or fail to take action(s) that do not abide by the above and/or the Design Guidelines, and the result is in the dying of a preserved tree, said Builder/Lot owner shall plant tree(s) of similar type and of caliper inch sizes that, in total, equal the caliper inch size(s) of damaged tree(s) upon the Lot or other area as designated by the Developer or Arborist.
