This e-mail is intended to clarify the decision the Special Study Committee made at their December 7, 1999,
meeting.
First, the Committee has requested a new Landscape Plan incorporating both the DOZ (Phase I) and Meadowlark
(Phase II) sites. The Committee has requested that this new Plan incorporate the following features:
• buffering of the residential areas to the north of Phase II and south of Phase I;
• a park -like treatment along the eastern part of the project;
• landscaping sufficient to buffer the parking lot proposed south of the Phase I buildings should it become
necessary for the
parking lot to be installed; and,
• a return to the native species that were the key feature of the originally approved Landscape Plan for Phase I.
Second, the Committee has required the landbanking of the parking proposed south of the Phase l buildings. This
will require your clients to apply fora Variance of Section 27.5: Amount of Parking Spaces Required of the Zoning
Ordinance. As this Variance petition is made necessary by a requirement of the Plan Commission, the filing fee of
$450.00 will be waived.
Third, this petition was continued to the January 4, 2000, Special Study Committee meeting and will not be on the
December 21, 1999 Plan Commission agenda. The Landscape Plan should be prepared and the Variance petition
filed prior to the. January 4, 2000, Special Study Committee meeting.

RE: Landscape Audit of D.O.Z. Office Complex
Dear Special Study Committee,
Attached is a copy of the, original landscape plan approved for the D.O.Z. office building.
Also attached is a copy of the existing landscaping for the D.O.Z. office building. Red
indicates landscape material that matches both the species and location indicated on the
original plan. As you can see, there is little similarity between the approved landscape
plan and the existing landscaping.
From homeowner correspondence in the file, Plan: Commission minutes and the specifics
of the landscape plan itself, :it is clear the original intent, of the, landscape plan was to
utilize native plant material to integrate-the office buildings into' the surrounding natural
wooded environment, to help screen the' surrounding residents from the buildings and to
support wildlife in the area. The majority of the plants installed are non -native plants and
therefore have little or no, wildlife value. The plant matenal that was to be installed in the
back of the building was not installed, leaving no buffering or screening for the adjacent
homeowners.
The health of the plant material installed varies. With the exception of a few, the
majority of shrubs appear to be healthy; however, many of the trees appear to be of poor
quality and many of the evergreens indicate poor vitality.
Overall, the current landscaping was installed with little regard to the landscape plan
approved by the Plan Commission, and it is the Department's opinion that this matter
should be weighed carefully when evaluating the Meadowlark Park project.

There are two (2) utility fees involved as follows_:
1. Sewer Connection: Commercial based upon type of usage; i.e. office, warehouse, etc.. In
addition, the base unit is.300 gallons per day /9,000 gallons per month. This base unit is called an
E.D:U.: 300 gallons per day /9;000 gallons per month equals 1.0 E.D,.U: One (1.0) E.D.U. of
Sewer equals $795.00 Sewer Connection Fee. Examples of some of the Average User Factors in
our Ordinance include:
Offices = 0.5 E.D:U:s per 1,000 sq. ft,.
Retail = 1.0 E:D.U.s per 1,000 sq. ft.
2. Acreage Fee. Based upon acreage of property. 1 For Sewer; this charge is $1,365.00 per acre.
Will require a legal description of the property listing the total acreage.
*Will require Commercial Curb Cut approval from our Board of Public Works and Safety. If
approved, a Street Cut/Right-of-Way .permit must be completed And.a $2,000.00 Street Cut Bond
(License and Permit) Bond must be provided.

= for our - proposed 'office building _located in the Pro -Med Office Park.. We are anticipating being on the
agenda for the November 20, 1996, meeting. The following is some brief information about our firm and
our plans.
. Dauby O'Connor &.Zaleski, LLC, is a certified public accounting firm which was formed in 1987. .
The firm is currently located at Keystone at the Crossing. The firm has had continued growth since it's
inception and is approximately the 19th largest accounting firm in Indianapolis according to the
Indianapolis ,Business Journal. The firm employs approximately 20. people: D & 0 had originally
planned to purchase an existing building in Marion County; however after many delays and unsuccessful
negotiations have elected to explore other options. Because of the delays, the firm now faces a critical
time schedule to relocate it's office.
Due to the lack of space available in the building, in which we are now located, our firm as been
forced to separate the office between floors. Our lease is expiring'in April 1997; and we have received a
verbal commitment that we can extend" until: August 1997; however our landlord has stated there can be
no assurance past this date. The partners Dauby & O'Connor have been involved in residential
developments located in Westfield (Beacon Pointe) and are currently' developing and constructing
homes in a subdivision located in Carmel (Bramblewood),. a 34 lot subdivision located at 96th and
Towne Road.
The proposed office building s will be developed and owned by Steven Dauby and Sean
O'Connor. Thee anticipated general contractor is Kevin Call, the architect is MECA Design and the
engineer is Civil Consulting (David Huffman). David, while employed at another firm, worked on the
development plan of the Pro -Med Office Park. As outlined in the enclosed information, D &O anticipates
to commence construction in January 1997 on Building 1,, which will consist of approx. 8,000 sq. ft.. We
expect to utilize this building for our accounting practice. We will construct Buildings 2 & 3; which will be
approximately 6,000 sq. ft. each, upon signing of leases or future expansion of our businesses.
The buildings will be managed by Steve Dauby & Sean O'Connor and will be 'well maintained .
We are not requesting approval for signage at this time. According to Bob Hughes (General Partner) of
Pro -Med Ltd., the office development will :request approval' for signage on a small tract of ground located
on Meridian Street. Upon receiving approval, our firm will incorporate our signage on the office park's
master sign.

The Architectural Design, Landscaping, Lighting, and Signage application for the DOZ
Office Building has been reviewed by our office. The following are comments that need to be
addressed and plans updated accordingly:
Application:
•The application needs to be updated to reflect the proposal for two buildings, instead of
three.
•The water and sewer utility needs to be filled in on the application.
',The lighting information needs to be filled in on the application, as well.
•An address for the site, if not already assigned, will need to be obtained from Lu Anna
Stephens, Carmel Communications Department (571- 2590).
Site Plan:
•The property is currently zoned B- 6/business. Please consult Section 17.0 of the
Carmel /Clay Zoning Ordinance for required setback, height, bulk and other requirements.
•Please the total number of splits that have taken place on the entire Pro Med parcel. This
information will be used to tell whether or not a subdivision has been created. If a
subdivision has been created, the platting process will be required.
•A statement of traffic impact needs to be filed stating the expected vehicular tnps this
facility will generate during peak hours. Based on that information, a traffic impact study
might be required.
.Please show how delivery trucks will maneuver the site.
•Specific comments on the landscape plan will be forthcoming from our office. The
B- 6/business dismct requires 30 feet of greenbelt where the property adjoins residential
properties.
•Please provide us information on how the 8,000 square feet building will be built within
the 100 year floodplain area.
•Tree preservation on this property is an essential part of the landscape plan. Please
provide details to how tree preservation will be accomplished on this site.
•As a reminder, the parking lot is required to be paved and curbed.

planned to purchase an existing building :in ,Marion County; however: _after many delays and unsuccessful
negotiations have elected to explore other options. Because of the delays, the firm now faces .a critical
time schedule to relocate it's office.
Due to the lack:of space available in the building in' which° we, are now located, our firm as been
forced to separate the office. between floors. Our lease is expiring in April 1997„ and we have received a
verbal commitment. that we can extend until' August 1997; . however our landlord has stated there can be
no assurance past' this date. The. partners Dauby & O'Connor have been involved in residential
developments located in Westfield (Beacon Pointe) and are currently developing and constructing
homes in a subdivision located in Carmel (Bramblewood), a 34 lot subdivision located at 96th and
Towne Road.
The proposed office buildings will be, developed and owned by Steven Dauby and Sean
O'Connor. The anticipated general contractor is Kevin Call, the architect is ;MECA. Design and the
engineer is Civil Consulting (David Huffman). David, while - employed at another .firm; worked on the
,development, plan of the Pro -Med Office Park. As outlined in the enclosed information, D&O anticipates
to commence construction in. January 1997 on Building 1, which will consist, of approx. 8,000 sq. ft.. We
expect:to utilize this building for out accounting practice. We Will construct Buildings 2, & 3', which will be
approximately 6,000 sq. ft. each, upon signing of leases or future expansion of our businesses.
The buildings will be managed by Steve Dauby & Sean O'Connor and will be well maintained .
We are not requesting approval for signage .at.this time. According to Bob Hughes (General Partner): of
Pro =Med Ltd., the office development will request approval for signage on a small tract of ground located
on Meridian Street. Upon receiving approval, our firm will incorporate our signage on the office park's
master.sign.
