Subject:330 2nd Street SW- Studebaker Residence- Docket No. 14030010 SDR
Mike,
Good morning.
I left you a voice mail earlier this morning. I believe you spoke with the property owner, Mark Studebaker around the
same time I was leaving a message for you. Per the property owner, you said you would be able to get an emergency
demo permit issued today… I am not sure if you were aware, but Nick Mishler from the permitting office issued a demo
permit (permit # 14030088) yesterday and then called me this morning revoking the permit. I didn’t know if the original
one can just be reinstated. Nick mentioned voiding the check that was dropped off at the permitting office today… if
that check can no longer be used, we will have another one brought to the permitting office today.
Please let me know what you need from us to get his accomplished today. We have equipment that was brought on site
first thing this morning to start the demolition and I need to notify our contractor with a status.
Also, Angie Coon had sent me a list of comments from the Planning department (Docket No. 14030010 SDR) that we will
have a response to by the end of the day. Her original request on 3/11 for this did not make it to my inbox, but to my
junk folder instead, but will promptly address these for the board today. Since she is out on vacation, should I send
these to your attention?
Your prompt attention to this matter is greatly appreciated.
Thank you,
Joe Willing

Subject:RE: 3-17-14 toMikeH RE: 330 2nd St. SW demo request
Hi Carol,
Thank you for your note. I understand your interest here, and appreciate what you are asking. It is my sense the Council
expects the Department to be even handed when dealing with property owners, including those residents in Old Town
where a unique framework of restrictions apply. This is one of those instances where I wish DOCS could help, but find
the ordinance to be clear that this house is not a contributing building that would allow further study prior to its
demolition. The rules in place today do not allow DOCS to hold this demolition up, since the restrictions only apply to
those buildings designated as contributing.
The owners of 330 2nd Avenue have met with DOCS staff to go over the ordinance and discuss options for property,
including the possibility of replacing the existing 1920’s home with a new structure that will meet the ordinance. While
the plans remain under review in DOCS, I am confident the results will be a home which respects the character of old
town and meets the ordinance for new construction in the character sub-area.
Sincerely,
Mike H.

Mike,
I'm sorry, but this won't come up on my city email.
Could you ask for commission input on this one?
It is in the Old Town Character area, but NO buildings in this area are listed on the map as contributing, including the
Depot which is on the National Register!

Nick,
it sounds like Carol wants it to be held up a bit. However, this site is not labeled as a Contributing Building, so they
could potentially get a demolition permit today.

Ok. Just to clarify, would this be OK to potentially release for demo if the new structure is not approved yet, or would you want us to hold it up for
that?

No, it is not labeled as a Contributing Building.
Also, we are reviewing the SDR Application for a new house w/ attached garage for this site, now in our office, and we
are close to approving it, after they make a few changes to the elevations.
