AN ORDINANCE OF THE COMMON COUNCIL OF THE CIT OF CARMEL,
INDIANA AMENDING CHAPTER 2, ARTICLE 4 , SECTIONi131(b)(c)(d)(e)(f)
"CARMEL SUPPORT FOR THE ARTS FUND" OF THE CARRVIEL CITY CODE
WHEREAS, the Common Council of the City of m , Indiana is, pursuant toi Indiana
Code 36-4-6-18, authorized to pass ordinances and res u ns �e egarding the control of the City's
finances and the appropriation of money; and
WHEREAS, the City of Cannel has recogCed the importance of the arts by the creation
of a Support of the Arts Fund to encourage art• o r l.m tions in our community; and
WHEREAS, The Center f o r t e ng Arts (The Center) has an established and
functioning President/CEO and Board o it is s; and
WHEREAS, the Preside'n CE . d the Board of Directors have demonstrated their
dedication to the growth and suvcess of e investment that the citizens of Carmel made in The
Center for the Performing A'ts; a} 1
WHEREAS, e City .c owledges their dedication, experience and knowledge of the
widely diverse arts scen-; a •
WHEREAS, the Ci also acknowledges this expertise can best make an independent and
autonomous determinatio R of organizations to be funded for benefit of the City.
NOW, THEREFO ' , BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:/
Sectio : The foregoing Recitals are incorporated herein by this reference.
Secs ion 2: That Chapter 2, Article 4, Section 131 is hereby amended and shall read as
follows:
"Sect. 2-131. Carmel Support For The Arts Fund (#504)
(b) The Fund shall be administered by the Common Council.

(c) The City Council may budget and dedicate to the Support for the Arts Fund
#504, up to one per cent (1%) of the General Fund budget each year, with the final
amount to be determined by final budget approval. This money will be given to
The Center for distribution to those organizations, who by sole determination of
The Center's Arts Fund Committee, are deemed a vital and necessary part of the
arts community of Carmel.
(d) The President Pro Tempore of the Council shall account, by separate line item,
for the receipt and disbursement of all sums to and from the Fund."
Section 3. That the remaining provisions of Carmel City Code Chapter 2, Article 4, are not
affected by this Ordinance and remain in full force and effect.
Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional
or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so
long as enforcement of same can be given the same effect.
Section 5. This Ordinance shall be in full force and effect from and after its passage and
signing by the Mayor and such publication as is required by law.
ADOPTED by the Common Council of the City of Carmel, Indiana this day of
, 2014 by a vote of ayes and nays.
