Public Hearing:
1. (V) 201 W 103rd Street, Bufferyard
The applicant seeks the following development standards variance approval for a reduced bufferyard:
Docket No. 14020004 V ZO CH 33.05.A: 15 ft Min. Front Bufferyard, 0 ft requested
The site is located at 201 W 103rd St and is zoned B-1/Business within the US 31 Overlay. Filed by the
Carmel Department of Community Services on behalf of the owner, Virtu Meridian Associates LLC.
Present for Petitioner:
Drew Rosenbarger, City of Carmel, Department of Community Services
• Illinois Street expansion causes need for variance
o Proposed roundabout and widening of road
o After construction, no room for bufferyard
o Expansion also taking some of parking area
o Proposed right-of-way fronts against parking lot
• Variance relieves owner of any undue hardship for lack of 15-foot bufferyard
Public Hearing closed.

• Once road construction finished, right-of-way will go up to parking lot
• Not due to any fault of property owner

Discussion:
® Underlying Zoning is B-1 within US 31 Overlay Zone
o B-1 requires 15-foot front yard
• 15 feet from new property line is for building setback
o Is parking allowed in front yard or will it become an issue?
• Alexia Donahue-Wold will check
® Believes it is allowed for commercial buildings
• John Molitor believes only Handicap parking permitted in front
® May need a variance for parking in front
o Purpose is to accommodate landowner
• Parking will now be in front yard through no fault of owners
o Petitioner requested variance
• Otherwise would be a legal non-conforming use
• Any future lender/bank may want documentation
o City does not want to hinder the owner because of construction
o Department will investigate the parking
• May be taken care of with this variance
• City had issued letter discussing their compliance
o City would apply for variance for landscape area
o Front yard was not mentioned in letter
Action: Mr. Lockwood APPROVED Docket No. 14020004 V,201 W. 103" Street, Bufferyard,for 15-foot
front bufferyard, zero feet requested.
