HomeMy WebLinkAboutMinutes PC 12-18-01 Special mtgCity of Carmel CARMEL /CLAY PLAN COMMISSION SPECIAL MEETING DECEMBER 18, 2001 5.00 p.m. The Special Session of the Carmel/Clay Plan Commission was called to order at 5:00 PM in the Council Chambers of City Hall, Carmel, Indiana. This Special Session deals with Old Business only. Members present were: Marilyn Anderson; Madeline Fitzgerald; Wayne Haney; Ron Houck; Nick Kestner; Dianna Knoll; Norma Meighen; Pat Rice; Paul Spranger; and Wayne Wilson, thereby establishing a quorum. Jon Dobosiewicz, Michael Hollibaugh, Laurence Lillig and Kelli Hahn were present representing the Department of Community Services. John Molitor, legal counsel, was also present. The minutes of the November 20 and November 27 meetings were approved as submitted. Jon Dobosiewicz announced that for this Special Meeting, Docket No. 122 -01, Fecitt Subdivision has been requested continued to the January meeting, at which time a public hearing can be held on the Subdivision Waiver request that is being required by the Department. Regarding Claybourne Estates, additional information that was requested by the Committee has been distributed to the members this evening. In addition, Item 11h is being removed from the Agenda due to faulty notice as well as Item 6h. John Molitor gave a brief report on pending litigation. A Motion for Judgment has been filed on Bonbar Subdivision. In regard to Leeper Electric, the Department and Counsel continue to work with the Mayor's office and opposing counsel as well as the Indiana Department of Transportation regarding the purchase of the Leeper property. If necessary, another Executive Session will be held. I. Old Business: 11. This Item Currently Tabled due to Pending Litigation: Docket No. 109 -99 DP /ADLS; Wingate Inn Development Plan and Architectural Design, Lighting, Landscaping Signage applications for Meridian Hotel Partners. The petitioner seeks approval to construct a 57,500- square -foot hotel on 4.066± acres. The site is located at 1460 West Main Street (northeast corner of East 131s Street and North Meridian Street). Docket No. 122 -01 PP; Fecitt Subdivision Primary Plat The applicant seeks approval to plat a two lot residential subdivision on 4.41 acres. The site is located at 14415 Cherry Tree Road. The site is zoned S- 1/Residence. Filed by Adam DeHart of Keeler -Webb Associates for Robert Fecitt. TABLED to January 3i. Docket No. 119 -01 PP; Claybourne Estates Subdivision Primary Plat The applicant seeks approval to plat a two hundred fifty -nine lot residential subdivision on 198.58 acres. The site is generally located at the northwest corner of Shelborne Road and West 131s Street and on the south side of 131s Street 1 /4 mile west of Shelborne Road. The site is zoned S- 1/Residence. Filed by James J. Nelson of Nelson Frankenberger for Boomerang Development, LLC. Jim Nelson, 12481 Medalist Parkway, Carmel appeared before the Commission representing the Thompson Company. Also present was Corby Thompson. The petitioner presented its request for Primary Plat approval in November. This Docket was reviewed by the Subdivision Committee on December 4th and a favorable recommendation was received, subject to certain changes and modifications. Mr. Nelson reviewed the changes and modifications in the Claybourne Estates plat. The previous street connection extending to the west property line has been removed and the area remaining by the vacated street was incorporated into the five or eight lots along the west property line, thus making them larger lots. The trail system in the center pocket of common area is being connected to the multi -use path that runs north/south along the main entry- boulevard. By way of commitment, the streetlights, if approved by the County and installed, will be down lighting. By way of commitment, the petitioner has accepted the most recent interpretation of the Subdivision Control Ordinance by the Department with respect to roadway improvements on the adjacent roadways, particularly 131s Street and Shelborne. Ron Houck reported that the Subdivision Committee had voted 5 -1 to recommend approval of this Docket. The concern was the growth in the western part of the township and what the County was going to do to improve 131s Street. Jon Dobosiewicz referred to a memo from the County Highway addressing their current status regarding 131s Street between the Township Line and West Road. The County is indicating that they plan on bringing this street up to current specifications in the 2002 program year. Madeline Fitzgerald asked about covenants for the subdivision and whether or not backyard fencing is allowed, especially for those lots along the western border. Mr. Lett has asked for a fence and the petitioner is willing to work with him. Norma Meighen moved for approval. Following a second by Ron Houck, the Commission APPROVED Docket No. 119 -01 PP, Claybourne Estates Subdivision by a vote of 10 -0. Side Note: Carl Mills, 13001 West Road, Zionsville was present and reported that concerns had been addressed, and he was glad the County is going to be doing roadway improvements to 131 Street. 4i. Docket No. 126 -01 DP Amend ADLS Amend Carmel Science Technology Park, Block 9 Carpenter GMAC Petitioner seeks to amend their Development Plan and Architectural Design, Lighting, Landscaping Signage approval for an office building. The site is located at 790 122n Street. The site is zoned M- 3/Manufacturing (Planned District). Filed by David Caveness of Carpenter Co., Inc. Note: The petitioner was not available at this time and there may have been some confusion as to the time of his appearance. Paul Spranger reported that the Committee had discussed the location of the additional building and asked that it be centered as opposed to two wings earlier proposed. The design is acceptable to the Committee and an issue outstanding is the additional landscaping requested. Madeline Fitzgerald moved to recess the meeting and continue with this particular item when the meeting reconvened. This motion was seconded by Ron Houck and unanimously approved. The Special Session reconvened at 7:00 PM. Dave Caveness of Carpenter GMAC explained the design of the additional building. The buildings are connected on the outside, but not the inside. The petitioner has been responsive to the Committee's request and is willing to commit in writing to a landscape plan, approved by the City Forester. Norma Meighen moved for approval of Docket No. 126 -01 DP /Amend, ADLS /Amend, Block 9 Carmel Science Technology Park, Carpenter GMAC, subject to a written commitment from the petitioner regarding the landscape plan, approved by Scott Brewer, City Forester. Following a second by Paul Spranger, the motion was APPROVED 10 -0 with conditions as stated.
