2. Mailed and Published Public Notice needs to occur no later than Thursday, September 29, 2005.
Published notice is required within the Indianapolis Star. Note: the Regular BZA meeting will begin at 6 pm.
3. The Proof of Notice will need to be received by this Department no later than noon, Friday, Oct. 21,
2005. Failure to submit Proof of Notice by this time will result in the tabling of the petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie Tingley
no later than NOON, Friday, Oct. 14, 2005. Failure to submit Informational Packets by this time will result in
the automatic tabling of the petition to the Monday, Nov. 28,2005 agenda of the BZA.
5. This Item will appear on the October 24, 2005 agenda of the Board of Zoning Appeals under Public
Hearings.
6. The petitioner will need to provide a fully filled-out Findings-of-Fact sheets for each petition the night of
the meeting for the Board's use (Sheet 8). On Ballot sheets, only fill out docket number, petitioner, and date
(Sheet 7). Ballot sheets must be collated.

ACTION PLAN FOR NOISE ABATEMENT
RITZ CHARLES GARDEN PAVILION
1. Contracted Unger Technologies, noise control specialist,
Mr. Jeff Unger , president. 744-1900~ Phase I of noise
abatement solutions in progress and waiting for report.
This report will have recommendations for short term
noise abatement as the property is currently configured.
2. Will have face to face with DJ's and band using facility
remainder of year to control decibel level as proscribed
by Unger Technologies after Unger has run testing results
to determine what the level of conformity with codes
.needs to be. DJ's or bands not conforming to our
regulations will be unplugged and not allowed to do
business with Ritz Charles at any venue in the future.
3. Unger technologies in Phase II of study and
recommendations will suggest a plan that considers the
Illinois Street extension and affects the noise will have
with the road. Phase II will consist of long term
recommendations, these plans will coincide with our
Illinois Street construction plans.
4. Meet with the City engineer on Illinois Street mounding
and landscape plans for Illinois and offer Unger
recommendations for consideration as the plan for Illinois
progresses.
5. Ritz Charles will keep neighbors posted as to
developments with Unger, the City and any other items
that may affec,t Spring Lake Estates.
