1. Docket No. 186 00 Z; DePauw Rezone
Petitioner seeks favorable recommendation of a rezone from the S -2 /residence district to the
BS/bus
mess district on 1.87± acres. The site is located northwest of West 131 Street and
North Meridian Street. The site is zoned S -2 /residence.

Dave Coots of Coots Henke Wheeler represented the petitioner.
Jon Dobosiewicz said the Department is recommending voting on entire package and forwarding
to the City Council at the same time. The City Council should then decide to consider the entire
package or consider each case separately.
John Molitor suggested the City get a commitment from DePauw that the 10 acre tract would be

reserved for 6 years, thereby allowing the State adequate time to make a decision and the
installation of a roundabout. A letter was received from DePauw suggesting the City enter into
an agreement to purchase the property for $2 million (would be City Council's call). However,
there is a conflict of interest with DePauw 's attorney and the City's attorney. The petitioner
notified the State to make a P re- emptive buy; the State declined. At this time, DePauw is willing

to be tabled as far as item number 3 is concerned.
John Molitor spoke for the Department, saying that all three DePauw items should be considered
as a package and sent on to the Council at the same time. There is a question as to the timetable
for the Environmental Impact Study. Under the Thoroughfare Plan, the tract is suitable for the
proposed use under the rezone.
Nick Kestner suggested voting on items 1 and 2, and tabling item 3.
Dave Coots formally requested that the Committee consider petitions 1 and 2 for approval and
keep item 3 on the table.
Nick Kestner moved to recommend approval of items 1 and 2, and table item 3, seconded by
Dave Cremeans. RECOMMENDED FOR APPROVAL 5 in favor 2 opposed (Paul Spranger
and Leo Dierckman).
4. Docket No. 33 01 ADLS; Merchants Square, Carrabba's Grill
Petitioner seeks Architectural Design, Lighting, Landscaping Signage approval for a
restaurant. The site is located northeast of Keystone Way and Keystone Way East. The
site is zoned B- 8/business.

Jim Nelson present for the petitioner. Also present: Mark Wible, Bob Love, Barbara Eden, Phil
Warrenburg of Weihe Engineers, and Gary Linder of Merchants Square.
Carrabba's is leasing this parcel from Merchants Square. The parcel is adjacent to Keystone Ave.
and the intersection of Keystone Way and Keystone Way East.
The neighboring uses were reviewed: Sears Hardware; MCL Cafeteria; Pier One Imports; Tucker
Real Estate; Noble Roman's Pizza; and Jiffy Lube.
Referring to the site plan, the building is oriented north/south. The entry to the south is facing
Keystone Way East and will have a significant amount of landscaping in addition to the 30 foot
greenbelt provided along Keystone Avenue and within the parking area. The stand of trees
discussed is actually on the Tucker site.
The design provides for easy identification of the site. The building materials are compatible with
Tucker, MCL Cafeteria, and Merchants Square. The trash refuse is located on the west side of
the building. Different elevations were shown.
The roof garden is an important identifying concept for Carrabba's and the plant material has been
reviewed by Scott Brewer, Urban Forester. Carrabba's commits that only live plant material will
be used; dead or dying species will be replaced with live plant material. If Carrabba's should
vacate, The Linder Company, owner of the land, would recapture the property and raze the
building if necessary. Linder's cost basis is in the land, not the building. Linder would take full
responsibility for maintaining until re- leased or razed.

Jon Dobosiewicz distributed copies of the commitments. The Department recommended sending
this item back to the Plan Commission with a favorable recommendation.
The caliper of the spruce trees will be increased; the spruce trees will be 12/15 feet in height.
Regarding the signage, the letters will be individually mounted, internally illuminated. The level of
illumination will be in balance with the size and character of sign.
Nick Kestner questioned the commitment for re -use and would like to see something done within
one year in the event Carrabba's would close. Gary Linder reiterated that he has recapture rights
of the land and the building and would be responsible for the maintenance until re- leased. The
roof top garden is covered in the commitments.
Linda Flanders suggested plantings be placed in front of the brick area of the trash enclosure to
shift focus. The petitioner agreed to install two or three tall spruce trees in order to screen the
trash refuse and service area.
Paul Spranger said the Plan Commission is not in favor of wall packs on the building; the
petitioner commits not to use wall packs.
Pat Rice moved to recommend approval to the full Commission conditioned upon the following:
the area north of Keystone Way entry having 15 foot high spruce trees; the level of illumination of
the wall sign will be suitable and satisfactory to the department; the petitioner will install two or
three tall spruce trees at the southwest corner of the building to screen the trash refuse area; the
petitioner will find an alternative to traditional wall packs to be used in lighting the service area,
emphasizing down lighting; seconded by Paul Spranger. Recommended for approval 7 0.
5. Docket No. 40 01 ADLS; Merchants' Pointe Lot 2, O'Charley's
Petitioner seeks Architectural Design, Lighting, Landscaping Signage approval for a
restaurant. The site is located southwest of East 116th Street and Keystone Avenue. The
site is zoned B- 8/business.

Jim Nelson present for petitioner. Commitments are of record as to no fast food restaurants. The
site plan and lighting approved as part of master plan.
The building material is predominately muted red brick, sample displayed, with ceramic tile at the
entry. The green neon accent band on the building has been eliminated and the alternative, fiber
optic cable, green in color, linear in character, was displayed to the committee.
Jon Dobosiewicz reported the Department's concern with the green band and the color
combination in regard to the adjoining buildings as a backdrop. There is a concern in the blend of
the proposed building with the other buildings.
Barbara Eden of Carson Design said the brick is compatible but not the same; the scale of brick is
also looked at. There are brighter tones of red and greens, and the colors are balanced.
Pat Rice asked about the awnings and the lighting. Also, the look of the green band, neon or fiber

optic, is not what the Commission wants. The petitioner said the awnings are metal, solid green is
standing seam metal, the lighting is by "crook lights" above the awnings.
Jim Nelson said the petitioner is willing to eliminate the fiber optic band. There are two signs, one
ground sign perpendicular to Keystone, and one on the building. The sign casting of letters is all
white, red outline, NOT illiuminated (opaque). The petitioner is willing to commit to non
illuminated red.
The petitioner agrees to make the red opaque and level of illumination acceptable to the
Department's review.
Wayne Wilson moved for a favorable recommendation with conditions stated (red opaque and
level of illumination of signage acceptable to the Department, and the elimination of the green
band on the building), seconded by David Cremeans. Recommended for approval 7 0.
6. Docket No. 41 01 ADLS; Merchants' Pointe Lot 3, Longhorn Steakhouse
Petitioner seeks Architectural Design, Lighting, Landscaping Signage approval for a
restaurant. The site is located southwest of East 116th Street and Keystone Avenue. The
site is zoned B- 8/business.

Jim Nelson petitioner. resented the etitioner. The front elevation faces 116 Street. The drawings

incorproate stone as requested by the Plan Commission. The building material is concrete and
appears as wood. There is stacked stone on the chimney and wainscot around the entire side.
The neon accent has been eliminated. There is No Logo (bull's head) as part of the sign. The red
paint is muted, paint chip displayed.
Department Report: Jon Dobosiewicz said the applicant has addressed all identified concerns.
Signage: The signs are individual letters, internally illuminated, one ground sign, two wall signs.
The red, neon lighting will be eliminated.
The petitioner agrees to white face, individual letters, internally illuminated; the wall sign will be
flush with the building and suitably softly illuminated.
Nick Kestner suggested uniformity in signage for Merchants Pointe, one ground sign for each
restaurant.
The landscape plan is part of the overall project. However, small foundation plantings around the
buildings are included and a list of the plantings has been furnished to Scott Brewer, Urban
Forester.
Nick Kestner requests sidewalk cut for all properties facing 116thStreet and striping to designate
path. Gary Linder said that is not a problem except for the corner lot due to the elevation;
petitioner agrees to stripe path.
Wayne Wilson moved to recommend approval to the Commission with conditions stated,

7. Docket No. 42 -01 DP /ADLS; Meridian at 465 Heart Hospital and Medical Office
Building
Petitioner seeks Development Plan and Architectural Design, Lighting, Landscaping
Signage approval for a hospital and medical office building. The site is located at the
southwest corner of 106th Street and US 31. The site is zoned B -6 Business and within
the US 31 Overlay Zone.

Paul Reis present for petitioner. A Variance is being requested to construct parking within the 90
foot, build -to line. The hospital is designed from the inside out. The petitioner has had a number
of discussions with the neighbors and has worked out the landscape detail to screen the facility
from neighboring residents.
Julie Christiansen of REI said the loading berth has been eliminated. The generators and cooling
towers are fully enclosed and screened from view.
Department Report: Jon Dobosiewicz said the applicant has addressed concerns. Landbanking on
Illinois Street has been eliminated. The Board of Zoning Appeals approved the encroachment of
the parking into the 90 foot, build -to line. The buffer has been reviewed, and issues addressed.
At this time, the Department is recommending forwarding to the full Plan Commission with a
favorable recommendation.
Julie Christiansen said that after several meetings with the neighbors, they are now in favor. The
petitioner will add tall Colorado and Blue Spruce trees for additional screening. The lighting is
below the requirements and the neighbors are satisfied. The petitioner is not cutting all of the
trees at the pond. Some trees are being added to the pond area. The petitioner will prune trees
appropriately. The trash pickup area will be fully enclosed.
Ground signs
Paul Spranger moved to recommend approval with the conditions as stated, seconded by Pat
Rice. Recommended for approval 7 -0.
8. Docket No. 43 -01 ADLS; Merchants Square, Donatos Pizza Restaurant
Petitioner seeks Architectural Design, Lighting, Landscaping Signage approval for a
restaurant. The site is located at 1422 Keystone Way. The site is zoned B- 8/business and
is located partially within the SR 431/Keystone Avenue Overlay Zone.

Kevin Cavanaugh was present on behalf of the petitioner. There is no ground sign intended for
this site; the ground sign shown on the drawings is in error. The landscape plan was reviewed at
the Technical Advisory Committee by Scott Brewer and approved at that time. The building is
brick, split face block, with gray metal roofing; standard Donatos Pizza awning.
Department Report: Jon Dobosiewicz said the color of the awnings is a concern. The sample of

the awning shown is agreeable. Signage: Donatos oval on tower and channel sign on front of
building, plus one directional sign. A Variance is needed for two signs. The front faces east; the
main oval and directional are red and face Keystone.
The petitioner commits to opaque red, backlit, channel letters; the logo is internally illuminated.
Landscaping: Some existing trees are being preserved; the landscape plan has been upgraded; a
privacy fence along the west property line is being added.
Paul Spranger moved to recommend approval with conditions as noted above, seconded by Pat
Rice. Recommended for approval 7 -0.
9. Docket No. 47 -01 CA; The Retreat
Petitioner seeks Commitment Amendment approval to revise the approved Preliminary
Site Plan and No Build Zone. The site is located north of I -465 and west of Westfield
Blvd. The site is zoned R -4 Residential.
Filed by Harry F. Todd of Gibraltar Properties for Gibraltar Properties, Inc.
Harry Todd present for the petitioner. At the time of approval of the preliminary site plan and no-
build zone, certain commitments were made. A 2.7 acre site was dedicated for a trailhead for the
Monon Trail. Ground was donated for a neighborhood park and money was given for the
construction of the park plus neighborhood access. The petitioner committed to develop in
accordance with the preliminary site plan that stated no building would be constructed within site
of 465.
At this time, the petitioner is requesting the following amendments to the commitments: The
elimination of the path -there is no room; Re- location of the tennis courts; elimination of the pier
in the lake; and approval for the maintenance building on the southern edge of the property that
encroaches on the 150 foot no -build zone and is visible from 465. The maintenance building is all
brick, except above the doorway it is hardy plank.
Nick Kestner has a definite concern with eliminating the path along Westfield Boulevard.
Department Report, Jon Dobosiewicz said he would like to research the issue of the sidewalk or
path along Westfield Boulevard. Jon requested the petitioner submit a commitment regarding the
no -build zone rather than a revised description.
David Cremeans said the rear of the maintenance building is visible from 465. The building is
sparsely landscaped and must be landscaped to provide year round visual screening so that it
cannot be seen from the interstate. Dave requested 14 foot spruce trees for that purpose.
The Department is recommending this item be forwarded to the full Commission subject to
County Highway determination of the feasibility for path or sidewalk along Westfield Blvd.
Nick Kestner requested that the City Engineer also look at the situation and provide feedback.
Pat Rice recommended approval of commitment amendments 1, 3, and 4 (City Engineer is to

provide feedback on the path/sidewalk); item 2 is to be tabled and will be subject to commitments
for landscaping the maintenance building, seconded by Dave Cremeans. Commitment
Amendments 1, 3, and 4 Recommended for Approval 7 -0, Amendment 2, maintenance
building, Tabled 7 -0.
10. Docket No. 49 -01; Michigan Road Self Storage ADLS Amend
Petitioner seeks Architectural Design, Lighting, Landscaping Signage Amendment
approval for a commercial business. The site is located at 9830 North Michigan Road.
Filed by Michigan Road Partners.
Reed Carlson appeared on behalf of petitioner. Current request is for a canopy (Hunter Green)
and green lettering to match existing; wrought iron with automatic arm- -not visible from US 421.
Department, Jon Dobosiewicz says the only change affected is the fence and it is not visible from
US 421.
Dave Cremeans moved for approval of Docket No. 49 01, Michigan Road Self Storage, ADLS
Amend, seconded by Pat Rice. APPROVED 7 0.
11. Docket No. 53 -01 ADLS Amend; Parkwood Crossing, Building 7 Morgan Stanley

In attendance: Steve Granner of Bose McKinney and Blair Carmosino of Duke Realty. The
petitioner is requesting a change in the signage from Morgan Stanley Dean Witter to Morgan
Stanley. The square footage remains the same, colors will match the existing.

and 54 -01.
There was no discussion on the sign.

Steve Granner appeared on behalf of petitioner. As of July first, "Weeks" will be eliminated from
the existing sign and it will read only "Duke."

Items for Discussion:
Ritz Charles would like to make some changes; would be considered for ADLS review. The
proposed changes for the Ritz Charles will be formally submitted and reviewed at the July
Committee Meeting July 3 at 7:00 PM in the Caucus Rooms of City Hall.
Lowe's Building is requesting approval for a change cornice is needed to discourage nesting
birds; it was the consensus of the Committee that this could be handled by the Department.
Paul Spranger moved to allow the Department discretionary approval on Lowe's request for a
cornice. APPROVED 7 0.
