At the meeting held Monday, March 24,2014,the Carmel Advisory Board of Zoning Appeals took the following action regarding the Developmental Standard Variances(V)filed by you for the property located at 3225 West 146`h Street. APPROVED:Docket Nos. 14010004 V through 14010008 V: Development Standard Variances for maximum density (one lot/acre required, 1.46 lots/acre requested[27 lots]);minimum lot area(15,000 square feet required, 14,000 square feet requested);minimum front yard(40 feet required,30 feet requested);minimum aggregate of side yard(30 feet required,25 feet requested)and minimum lot width(120 feet required, 100 feet requested)with attached Conditions: 1. Architectural standards including:no vinyl siding,exterior materials would only be masonry,brick or stone and fiber-cement board 2. Architectural elevations substantially similar to illustrated home elevations 3. Tree line preserved along eastern property(4 inches or greater in diameter within 15 feet of eastern property line)unless diseased,dying,court order or other infrastructure needed Please be advised that per Section 30 05.05 Time Limit of the Zoning Ordinance,the aforementioned Development Standard Variance approvals are valid for three(3)years.By that time,either continuous construction of the improvements must be underway,or a written request for a one-time,six-month extension of the approvals must have been received and approval granted by this Department. The expiration date of the approval is March 24,2017. Please include a copy of this letter with any permit application. Architectural Standards: A. Permitted Building Materials: Masonry, wood, cementitious board. At a minimum, a first floor brick or stone masonry wrap shall be provided on all elevations. B. Required Window Openings: A minimum of two (2) windows per façade shall be provided. In order to meet this requirement, each individual window, or set of contiguous windows, must be a minimum of nine (9) square feet. C. Garages: Garages shall be front-loaded, court-loaded or side-loaded garages attached to the Dwelling. All garages shall be a minimum of(i)a two and one half-car garage for a one-story dwelling and (ii) a three-car garage for a two-story dwelling. Front load garages shall be permitted on up to one half of all home sites. In addition, front load garages shall not be allowed on home sites which are located side by side or across the street from each other. D. Chimneys: Brick or stone masonry only and extended fully to ground; however, chimneys that protrude from inside the dwelling may also have cementitious board, synthetic stucco, and/or EIFS as their exterior building material. E. Porch: If a porch is provided,the porch shall be at least five feet (5') deep with consistent materials/design with dwelling. If no porch is provided,the entryway shall be covered and deep enough to provide shelter at the front door. F. Roofline: The primary roof shall have a minimum 6/12 pitch.The primary roof shall have a twelve inch (12") overhang after installation of siding or an eight inch (8") overhang after installation of brick or stone masonry. All,dwellings shall include dimensional shingles, however, cedar shake roofing or slate like roofing shall be a permitted alternative. G. Fences: Fences are permitted on individual lots and shall not be chain-link or coated chain-link. Perimeter fences, enclosing large areas on a lot, such as a rear yard, shall be black wrought iron or black wrought iron in appearance. Provided, however, that other materials, such as wooden shadow box fencing shall be allowed to screen smaller areas, such as patios and hot tubs. Fences shall be a maximum of 42" in a front yard and a maximum of 6' in side or rear yards. 'H. Architectural design shall be substantially similar in quality and character to the Illustrative Elevations depicted in Exhibit A. Tallyn's Ridge Conditions of Approval II. East Tree Line: The developer and builder shall not remove trees with a diameter at breast height ("DBH") in excess of four inches (4") (the "Protected Trees")within fifteen (15) feet of the Real Estate's east property line unless the tree is damaged, diseased, dead, or is to be removed in order to: (1) comply with safety requirements of any governmental agency; or(2)to accommodate the installation of drainage, utilities, street connections or other infrastructure. If a Protected Tree is damaged or otherwise removed by the developer or builder, except as permitted to be removed as listed above,then the developer or builder shall reestablish the Protected Tree with a tree or trees of combined equal or greater DBH subject to the availability of space for their healthy growth.
