The regular meeting of the Carmel Plan Commission was called to order by Richard
Albright, President, at 7:30 P.M. November 17, 1987 at the City Meeting Hall. The meeting
opened with the Pledge of Allegiance.
The roll was called and members present were as follows: Richard Albright, Jeff
Davis, Ila Badger, Minnie Doane, Vaughn Story, Bob Boone, Sandra Long, Max Moore, Henrietta
Lamb, Jim Schneider, Paul Ayers, Sue McMullen (arriving at 8:25 P.M.) and Jim O'Neal
(arriving at 8:50 P.M.) .
Staff members present were Chuck Kiphart, David Cunningham, Rick Brandau, Gordon Byers,
Dorthy Neisler and Rosalind McCart.
There should be two dates regarding the fifth paragraph of the October 20, 1987
minutes and it should be amended to read.: at the meeting on September 29 the Estate Type
Zoning was discussed and on the October 6th meeting Traffic Studies for designated areas
were discussed.
All amendments for the Zoning Ordinance will be drafted and recodified.
Mrs. Badger moved that the October 20, 1987 minutes be approved as amended.
Seconded by Mr. Boone.
The motion was carried.
Mr. Albright read a letter from Charles E. Wilson regarding the Pittman Property
(which is a part of the official minutes and attached to the Master Copy) .
Mr. Albright also read a letter that he received from Browning Investments regarding
improvements at I-465 and Meridian (which is a part of the official minutes and attached
to the Master Copy) .
Mr. Albright announced that a letter was received from Stan Neal of Weihe Engineering,
Inc. requesting, on behalf of Larry Dunkerly, that item 3g be tabled until the December
meeting.
G. Public Hearings
lg. 7:30 P.M., Public Hearing on Docket No. 99-87 Z, Rezone Application for
113.8 acres of land located at the Southwest corner. of Haverstick Road and 106th
Street, Carmel, IN. Petitioners requests a change in zoning from S-1 to S-2
from the development of a future subdivision.
Filed by Mr. Mark Boyce for C.P.Morgan, Inc..
The public hearing opened at 7:44 P.M. with Jim Nelson making the presentation.
Present were Mark Boyce, Director of Land Development, and representatives from
Schneider Engineering.
An aerial photo was presented to show the location.
The request for rezone from S-1 to S-2 is to provide an exclusive residential
subdivision.
There will be 185 lots for single family dwellings ranging from 12,000 square feet
to 35,000 square feet with an average of 15,000 square feet. These home sites will be
serviced by Carmel Sanitary Sewer Systems.
This subdivision will be divided into 2 parcels.
Parcel one will contain 80 acres which is presently owned by the Hensel family.
This parcel is surrounded by residential development.
Parcel two will contain 33 acres and is owned by the Morgan family. This parcel
will be surrounded by residential and contemplated commercial.
Surrounding land uses and zoning classifications were presented. The purpose of
the S-2 residence classification is to provided for low density, single family
residential development.
A single primary entrance will be from East 106th Street with a dual lane boulevard.
A secondary entrance will be from Vail Drive.
There will also be a 5 acre lake, a 3 acre lake, a swimming pool, tennis courts,
walking pathes and a club house.
When homes are completed they will range from $150,000 to $400,000.
They will be single family detached homes, not apartments, condominimums or cluster
housing.
It is proposed that on 106th Street additional right of way will be dedicated so
that the right of way that will be available to the public will be 50' half right of way
that runs in front of this development.
Len Bland, Vice President of Woodlands Homeowners Association, wants to make sure

that good environment is continued and maintained.
The homeowners association is asking that the Zoning Commission include in the plat
that all building materials extend to ground level and be of brick, stone, brick veneer or
combination of the same. Also minimum floor plans for one story on ground level should
be a minimum of 2,000 square feet excluding garage, 12 story ground floor minimum of
1700 square feet excluding garage, and a 2 story ground floor minimum of 2400 square
feet, excluding garage. The doors for entrance of garage shall not face the front lot
line and lots are to have at least a 2 car garage and no detached garages or carports.
Sidewalks shall be constructed of concrete or paved driveways.
John Kassis, Lakeshore Dr. , asked two questions; 1) Do you have an environmental
impact statement and will it be available for the publics review? 2) Why isn't the
entrance off of 96th Street instead of 106th Street?
Bill Murphy, of Briarlane Estates, 3479 Sugar Loaf Court, welcomes development of
high quality single family homes adjoining their neighborhood but they said they would not
like to see the only southern exit off of Vail Drive. Mr. Murphy said they would like to
suggest that the petitioner eliminate, or drastically reduce, the single exit on Vail
Drive by adding another exit on Gray Road or directly on to 96th Street. They would
like lots to be reduced from 185 lots to 100-120 and would like to see minimum size of lots
remain at the 1500 square feet level.
Ray Heinman, Vail Drive, would like the city to review the entrance on Vail Drive,
and would like to see an entrance on 96th Street.
Mr. Albright read a letter received from Richard and Sue Di Marchi, 3815 Wolf Creek
Drive stating that they strongly oppose this rezoning and do not want lower priced houses
boarding theirs. They also oppose making Vail Drive a through street. This letter is
a part of the official minutes and attached to the Master Copy.
Cindy Dube' , residing in 104th block of Lakeshore Drive East, would like to see an
exit on 96th Street.
Andy Cook, 106th Street, related 2 concerns, 1) would like to have traffic problem
East of Keystone Avenue addressed, and 2) drainage problem where the ditch from Jordon
Woods, south of 106th Street collects drainage off of 431 and from streets of Carmel.
Carol Warner, 122 Brunswich Court in Woodlands, expressed concern about the traffic
on 106th and the safety of the children in the neighborhood.
Gary Mattingly, 10248 Otter Place, questioned if there would be independent contractors
or just C.P.Morgan and expressed concern for selling out to a substandard developer.
Don Swank, adjoining property owner, expressed concern for lot size and asked how
many of the lots will actually be 100' X 120' . Mr. Swank feels the quota of lots in the
area should be examined and that there should be at least 4 or 5 entrances and exits out
of the subdivision and that part of the traffic should go out Gray Road to the east.
Glen Reager, 4322 Breckenridge Circle, wants insurance to the public that this will
be a quality development and asked that strict guidelines be put on the phases of this
development.
Cathy Horton, Briar Creek II Subdivision, expressed concern for traffic and the safety
of the children.
Jim Reed, 43317 Idlewild Lane, expressed concern about the density being heavier than
Blue Creek and asked who is going to build the houses and the average sales price of
C.P. Morgan homes in the last 12 months.
Jim Dickmier, 2436 Taho Road, expressed concern for congestion in the community.
Jim Nelson made rebuttle comments stating that this is a rezone from S-1 to S-2 this
evening only. Regarding Vail Drive, the current policy of Carmel is to have interconnecting
subdivision. Mr. Nelson said that they do not have an environmental impact study and they
do not have access to the site from 96th Street.
Mr. Nelson said there will be a number of different builders and predominanently
C.P.Morgan and that the density is substantially less than in surrounding areas. The traffic
report was done by Pflume, Klaussmeier and Wagoner.
Mr. Story questioned if any portion was in flood zone. •
John Schneider of Schneider Engineering said there is a flood way that must be
considered, the Flood Way of Carmel Creek, and it will be restricted in terms of any —�
development in that area.
Mrs. Badger asked how many acres are there in common area.
Mr. Nelson said approximately 23 acres are in common area and they feel that because
a substantial portion of the site is devoted to amenity areas that S-2 is more appropriate.

= Mr. Nelson said the surrounding areas are developed S-2 and there is no specific
hardship.

2g. 7:30 P.M. , Public Hearing on Docket No. 100-87 P.P. Primary Plat/cluster develop-
ment application for Walden Pond Subdivision consisting of 126 lots on 40.9 acres ,
of land. Site is zoned S-1 and located at the northeast corner of 99th Street and
Westfield Blvd., Clay Township.

The public hearing opened at 8:43 P.M. with Mr. Nelson making the presentation.
Paul E. Estridge, Sr. , Paul E. Estridge, Jr. and Bruce Hagen, of Mid-States
Engineering, were present.
An aerial photo was shown for location.
Modern intensity residential is recommended for Land Use.
The plan under cluster option was presented.
The primary entrance is from Westfield Blvd. and a rendering of the main entrance
was shown to be a tapered boulevard, with extensive landscaping.
There will be no identification sign at main entrance.
The primary plat land plan was shown.
A white split, rail fence will be along Westfield Blvd. and there will be extensive
landscaping along East 99th Street.
A secondary entrance will be from East 99th Street.
Sidewalks will be along Westfield Blvd. and East 99th Street and along streets
in interior network.
Each unit will have a dusk to dawn light and there will be uniformity in mail boxes.
These will be single family detached homes and a rendering of one of the homes was
presented.
The homes will be 1200 to 1700 square feet and will be moderately priced from
$95,000 to $120,000.
Don Cosby, 2425 E. 91st Street, property owner in this area, questioned if his
property will be getting drainage problems.
Mr. Heddy, 2340 E. 99th Street, questioned what they are going to do along property
lines back there.
Edgar Fleener, 9900 Westfield Blvd. , questioned what type of fire protection in terms
of fire plugs, etc. , will be provided.
Mr. Nelson stated, regarding fire protection, that this will be taken up with the
fire chief.
Regarding drainage, Bruce Hagen spoke that all water will be taken back into the
pondage system.
A detailed plan is on file in the Department of Community Development.
The buffer along the eastern line will be seen at Subdivision Committee.
A method of funding maintenance for the fence will be needed at the committee
meeting.

3g. 7:30 P.M., Public Hearing on Docket No. 103-87 P.P. Primary Plat Application
for Newark Village Subdivision, replating of lots 61, 62, 63 consisting of 3
new lots on 1.49 acres. Site is zoned R-2 located at the northwest corner of
Winona Drive at Pawnee Road, Carmel, IN.

4g. 7:30 P.M., Public Hearing on Docket No. 105-8.7 P.P. Primary Plat Application
for Leising Estates Subdivision consisting of 3 lots on 3 acres of land. Site
is zoned S-2 and located at the South east corner of 104th and White Oak Drive,
Clay Township.

The public hearing opened at 9:12 P.M. with Dennis Grump, Schneider Engineering;
making the presentation.
Mr. Leising and Jack Southerland, of Schneider Engineering, were present.
The location was given.
1.03 lots' per acre are proposed.
Sub-Area 11 of the Carmel Comprehensive Plan states this area to be for
moderate intensity residential, suburban in character.
The petitioner does not object to annexation.
There will be no internal street systems.
There will be a •total of a 50 ft. dedicated right of way along 104th Street.
Domestic water will be supplied by Indianapolis. Water Co.
The stone sewer extension will be from 104th Street and swails leading to
Carmel Creek.
A dusk to dawn light will be on each lot.
The homes will be $175,000 in price.
There will be sidewalks on south side of 104th Street in front of each lot.
A variance for sidewalks is requested.
The public hearing closed at 9:21 P.M.
Mr. Story questioned the sidewalk variance requested and proposed that the
petitioner put in the sidewalks.
Mrs. Badger asked if the county has any plans for the improvement of 104th St.
Mr. Grump said they are required to pay a $3,000 impact fee to county for these
3 lots.
Mr. Kiphart added some background information regarding the sidewalk installa-
tions.

5g. 7:30 P.M., Public Hearing on Docket No. 108-87 D.P. Development Plan for Knowles
Office Center located at the southeast corner of Winona Drive and Range Line Road,
Carmel, IN. Site is zoned B-7, Proposed 3007 Square Feet Office building.
Filed by Mr. Al Hughey for Mr. William W. Knowles.

The public hearing opened at 9:30 P.M. with John Hughey making the presentation
for an office building.
An elevation drawing was shown.
A sample of the brick to be used was shown.
The site plan was shown and the Landscape Plan presented.
There will not be any lighting in the parking area.
A rendering of the sign was shown.
A tree will be planted every 50 ft. around the perimeter of the property.
A variance from the rear yard set back and from the green belt buffer on the
south side will be before the Board of Zoning Appeals this month.
The drainage on the property was presented.
The sidewalks will be put in if required along Winona.

6g. 7:30 P.M. , Public Hearing on Docket No. 110-87 Z Amendment to the Carmel-Clay
Zoning Ordinance Z-160 as amended. Adding a new section to the Carmel/Clay
Zoning Ordinance establishing a Michigan Road (S.R.421) Corridor Overlay Zone.
This request was originated by the Carmel/Clay Plan Commission.
Filed by Carmel/Clay Plan Commission.
This item was tabled as proper notice was not given for this hearing.
Mr. Byers said that this is the 421 Overlay Ordinance and some wording needs to
be changed. An accurate legal description of the area in question is needed. Mr. Byers
addressed the items that needed to be discussed.
Mr. Albright said that these matters should be discussed at the Committee level.
Mrs. Badger will call the committee together for this meeting with Mr. Byers.

1h. Commission to consider Docket No. 59-87 Z, Rezone Application for 68.568 acres
located at S.E. corner of 116th Street and Spring Mill Road. Petitioner requests
a change from the existing S-2 zoning to B-6 Zone District for a proposed multi-
building office complex. Petitioner also commits to certain covenants and
conditions as part of the rezone request.

This item remains tabled.
Mrs. McMullen said she feels this item should be withdrawn and not continued to be
tabled. This item will be having another public hearing and will be noticed.
Mr. Nelson said he has no problem with this and will consider this suggestion of
refiling.
2h. Commission to consider Docket No. 90-87 Z OA., amending Section 29.6 filing fees,
Carmel/Clay zoning and subdivision Ordinance, Z 160 as amended. This request
was originated by the Carmel City Council for Plan Commission consideration.
Filed by Carmel Planning Commission.
Mrs. Badger gave the Land Use Committee Report (which is a part of the official
minutes and attached to the Master Copy) . The committee recommended approval per
Committee Report and Mrs. Badger so moved.
Dr. Long seconded.
The motion for the amendment carried and a favorable recommendation will be
forwarded to the City Council.
3h. Commission to consider Docket No. 6-87 Z, Rezone Application for 64.13 ,acres
of land located north I-465 between College and US 31. Petitioner request a
change in zoning from S-2 and R-1 to B-5; B-6; B-7 Zones for hotel and office
space.

Mr. Nelson and Mr. Gillespie were present.
Mr. Davis assumed the chair for this item.
Mrs.Badger gave the Land Use Committee Report (which is a part of the official

Seconded by Dr. Long.
The roadway improvement plan was shown.
Mr. Story questioned the traveling east on 103rd Street and is it diverted.
Jim Klausmeier commented onthe travel on 103rd Street and said the design is to
discourage all but the residents to proceed in a residential neighborhood.
Mr. Story said he is opposed to the diverting of the existing street sytem.
Mr. Moore said Hamilton County needs to better the North-South and East-West roads
and feels that Penn Street should be extended South.
Mr. Albright referred to traffic impact study for this project at 103rd Street and
said he feels that certain other developments have not been taken into consideration with
this. Mr. Albright questioned do we have room for all this traffic on Meridian. The
road system will not support this.
Mr. Story asked Mr. Kiphart if it is possible that we have funding in order to get our
own traffic study.
Mr. Kiphart said yes there is money in the consulting fund if the Commission wishes
this study.
Mr. Story moved to table this petition until the Planning Commission engages and
obtains results of a traffic study of our own on this project.
The motion died for lack' of a second.
Mrs. McMullen questioned how thoroughly the Commission studied this traffic issue.
Mrs. Badger said it was addressed but they are not experts.
The Technical Advisory Committee minutes of October 27, 1987, as it related to

traffic, was read by Mr. Kiphart. These minutes are a part of official minutes and attached
to the Master Copy.
Mr. Ayers said he feels this is not resolvable this evening.
Mr. Nelson made statements supporting their position in this matter.
Mr. Klausmeier spoke, showing an official thoroughfare plan, and-related the road
improvements proposed by Trammell Crow.
Discussion by the members followed.
Mr. Gillespie commented.
Mr. Nelson said they have done all they could to prepare this presentation for
consideration. If more traffic information is needed, they will provide and pay for.
Mr. Albright said he feels we have all the information we need to make a decision.
The vote tonight is to recommend to the City Council regarding the Rezone Application.
Paper ballots were cast.
Mr. Schneider and Mr. Boone asked to abstain.
The vote was 8 for, 3 against and 2 abstaining. Mr. Albright, Mr. Moore and Mr. Story
voted NO.
The motion carried and a recommendation of approval will be sent to the City Council.
Mr. Davis returned the chair to Mr. Albright.
4h. Commission to consider Docket No. 87-87 Z Rezone Application for .24 acres of land
located at 82 Sixth Street, Carmel, IN also know as Lot 9 of David Kinzer Sub-
division. Petitioner requests a change in zoning from R-2 to B-1 for the elimination
of an use Variance BA-16-76.
• Filed by Dr. Linderman, Owner.
Dr. Linderman Was present.
Mrs. Badger gave the Land Use Committee report (which is a copy of the official
minutes and attached to the Master Copy) stating that no vote was taken at the committee.
Mr. Kiphart said that Dr. Linderman has submitted a letter, which is in the file,
asking that this rezone request be changed to a B-7 instead of a B-1.
Mrs. McMullen said she feels this should be readvertised for public hearing and
moved that Dr. Linderman readvertise for public notice that he wants this request to be
changed to a B-7 Zone.
Seconded by Mr. Boone
The vote was 6 for and 4 against, a non-decision vote. (Mrs. O'Neal, Ms. Lamb,
Mr. Schneider and Mr. Albright voting NO.)
Mr. Boone moved to approve Docket No. 87-87 Z to a B-1 Zone.
The motion failed for lack of a second.
Dr. Linderman withdrew his petition and will readvertiase and come in with a new
petition.
5h. Commission to consider Docket No. 95-87 P.P., Primary Plat application for
Crossfields Subdivision consisting of 101 lots on 153.2 acres of land. Site is
zoned S-1 and located West of Towne Road between 126th and 116th Streets.
Filed by William Olson, Developer.
Stan Neal was present with Mr. Olson.
Mr. Ayers gave the Subdivision Committee Report (which is a part of the official
minutes and attached to the Master Copy) .
The Committee moved to approve with: 1) D & R approval of 10 gallon per minute well,
2) Following the guidelines for sludge, 3) 50 ft. away from mound, and Mr. Ayers so
moved.
Seconded by Ms. Doane.
Mr. Albright said there is some other information to relate. Mr. Albright met with
petitioners. There were concerns. The letter from Mr. Updegraft said the waste treat-
ment might work if there is positive subsurface drainage in the soil. Mr. Albright was
concerned that there was nothing to indicate there would be positive subsurface drainage
from under ground drains and retention ponds. My concern was this could not be drained
well enough for those to work. This was reinforced by Dr. Yonner.
Mr. Bryan House representing Clay West Property Owners Association, said there are
public health and
certain points, the Commission should consider regarding concerns of

'welfare and the fact that the soil is unsuitable for septics in this area.
Mr. Neal said he related to Mr. Albright that every lot in this subdivision had
access to a subsurface drain or storm sewer and therefore each lot would have an
adequate subsurface drainage around the septic field.
Mr. Albright said his concern was that as flat as that field is that there might
not be enough slope that those drains would work.
Mr. Neal said a subsurface drain will work with virtually no slope. Field tiles
are laid flat in farm fields for drainage and they work very well if there is a hydraulic
grading.
Mr. Albright said if subsurface drain storm doesn't work and the ground doesn't
drain the septic system won't work.
Booklets passed out to each member.'
Dr. Joe Yonner, Purdue Agronomist, stated that with this density with a high water
table and this soil type (compact till( that we're treading on thin ice here: Dr.Yonner
said there will be problems and the mound system would be better to use here.
Mr. Olson said the Hamilton County Board of Health has responded and said that this
can work if engineered properly.
Discussion by Plan Commission members followed.

Mr. Boone moved that the petition be tabled.
Mr. Schneider seconded.
The motion carried with Miss Doane, Mr. O'Neal, Mr. Ayers and Mr. Schneider voting
NO.
This item will go back to Land Use Committee for December 1, 1987 at the City
Meeting Hall.
6h. Commission to consider Docket No. 91-87 ADLS, Architectural Design, Lighting and
Signage review for the Maple Leaf Nursing Home, consisting of 110 beds, 44,596
square feet on 6.2 acres, located within the Meridian Technology Park, north of
116th and west of Technology Street. Site is zoned B-6.
Filed by Mark David Jones, Architect for Paul A. Ormond, President.
Mr. Miller and Mark Jones were present.
Mr. Boone gave the Industrial and Commercial Committee Report (which is a part of
the official minutes and attached to the Master Copy) . The committee recommended
approval subject to: 1) The dumpster enclosure will be brick and will have a roof, 2) The
roof on the building will be changed from an asphalt shingle to a standing seam metal
roof on a similar color.
Mr. Boone so moved.
Seconded by Mr. O'Neal.
The dumpster will be totally enclosed.
Samples were shown of the standing seam metal roof.
Mr. Boone expressed concern regarding the parking area location. The parking
area was shown on the Landscape development lighting plan.
The motion was unanimously carried.
I. New Business

li. Commission to consider Docket No. 101-87 DP/ADLS. Final Development Plan
and Architectural Design, lighting and signage for Summer Trace Retirement
Center. Petitioner asks to add two covered parking structures. Site is zoned
B-2 located at 131st and Pennsylvania St., Carmel, IN.

Chris White, of Paul I. Cripe, Inc., made the presentation.
Ellen Jay was present.
The carports will be constructed of a brick material with a flat roof.
The canopy will be burgundy in color with a cream colored stripe.
A rendering of the building was shown and location was pointed out.
Mr. Moore moved to suspend the rules and vote tonight.
Mrs. Badger seconded.
The motion carried.
Mr. Moore moved to approve as presented.

2i. Commission to consider Docket No. 102-87 ADLS Signage Application for One
Meridian Plaza located at 10585 N. Meridian. Petitioner wishes tb establish a
new sign package for One Meridian Plaza. Site is zoned B-5, and located at the
south east corner of Meridian Street and 106th Street, Clay Township.

3i. Commission to consider Docket No. 107-87 ADLS, Signage Application for Three
Meridian Plaza located at 10333 N. Meridian. Petitioner wishes to establish a
new sign package for Three Meridian Plaza. Site is zoned B-5 and located at the
northeast corner of Meridian Street and 103rd Street, Clay Township.
Filed by Mr. Rusty Richardson.
Both 2i and 3i were presented together.
Mr. David Coots made the presentation.
In addition to the sign package for the ground sign and entry signs there are
proposed the same color identification signs on the building. Those plans have been
submitted to Mr. Kiphart's office.
Mr. Coots asked to combine these petitions and refer them to the Industrial and
Commercial Committee as submitted.
These items were sent to Industrical and Commercial committee for review on

Petitioner request signage approval and approval for a change in the lighting
plan. Site is zoned B-8, Cannel, IN.

John Schmidt made presentation for a sign 271/2" in height by 13' in length which
complies with the sign ordinance. The sign will be approximately 12' off the ground in
front of the building and with internally illuminated letters installed on top of a
fabricated aluminum raceway. The letter channels are fabricated aluminum and finished
with a MAP coating. The letters are 25" in thickness out of red plexy glass.
A picture of the sign was shown.
The lighting standards location change was-shown.
Mr. Boone moved to suspend the rules.

The motion was carried.
Mr. Boone moved to approve with the assurances of the Director of Community
Development.

Northwest corner of Pawnee and Winona, Cannel, IN.
