Break drainage at North property line and pick up as much of that drainage and take it to the Knotts 2. Need copy of Boundary Survey 3. Need drainage calcs 4. Has drainage in Phase II been changed over to Knotts and temporary outlet to U.S. 31 Right of Way been removed. Need letter from Engineer stating this. 5. Need to add free board to both ponds. High water elevation mark 845.0 is higher than top of casting in parking lot, 843.27. Water will be backed up and flood parking area. 6. Has R/W for Penn been dedicated? 7. Bucher DIRECTOR•DEFT.OF COMMUNITY DEVELOPMENT Dorothy].Hancock Ore(Pt MAYOR April 13, 1990 / b Di(E--Zit), Hamilton County Board of Commissioners Jeff Davis, President, Carmel/Clay Plan Commission We have been trying to work out a solution to a situation on Pennsylvania Steet as part of the Eaton & Lauth office building development. Several of us at the city and county level have discussed this situation and what needs to be done to resolve the matter. The following information is a brief explanation of the situation as we presently understand it. Situation: A ditch along the east side of Pennsylvania was approved by the C/C Plan Commission as part of this project. That ditch was not installed. A complaint by a neighbor prompted us to review the situation and make the following determination: 1) E & L is willing to construct the ditch that they had approved on plans and are only waiting for someone to tell them to do it. In fact, they have already paid the contractor. 2) The ditch that was approved is NOT shown to be a 10' ditch all along the road. In fact, it shows the neighbors property line projects about 6' into the ditch area at one point. 3) The survey of the road indicates it was constructed pursuant to plans as approved and does NOT encroach onto anyone's property as was alleged by an adjoining property owner. 4) If Eaton & Lauth are requested to put in a 10' ditch (again — not what was shown on the approved plans), at the request of one neighbor, the ditch would destroy many trees in the back yards of other neighbors. • 40 EAST MAIN STREET CARMEL,INDIANA 46032 317/844-6433 I " page 2 Since the Board of Commissioners has the ultimate authority to accept or reject this road, we wanted to bring this issue back to your attention and request that you direct the appropriate County department to make a recommendation to you concerning what is agreeable and workable to resolve this situation.
