1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because.
This lot is one of the shallowest lots in the area,therefore doesn't allow for the additional non-pervious area.
The frontage of the lot is consistent with the remaining homes in the area,and with the addition of the rain
garden we will be able to make up for the non-pervious area needed and still provide an aesthetically
pleasing landscape to help enhance the highly visible corner of the lot.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The home that we are proposing is designed to highlight the highly visible corner by taking advantage of a wrap
around porch and a mixture of materials and colors. The new custom home will be a considerably higher value
than the existing home. The rain garden will address the transfer of excess water runoff while still providing an
beautiful landscape to be viewed by all in the area.
3 The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
The current custom home that we have designed is not an excessively large home,and to be able to design a
home that would fit within the existing 45%coverage range would result in a much smaller home that would not
be able to support the investment being made for a home of this caliber. Without this approval the existing lot
does not lend itself to a new home investmentDECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.

Statement of Variance
My name is DB Klain, and I am currently working with a client, Ms. Rembusch,
that would like to demolish the existing home located at 410 1st Ave. NW with the
intention of constructing a new custom home in place of the older structure. The new
home is going to be built with the intention of blending with the current architecture
along the street,while still incorporating current day construction materials and designs.
The current lot is considered one of the smallest lots along the street, so therefore we are
seeking a variance from the current Development Standards of 45% lot coverage to 59%
lot coverage to allow for the new structure to be built on this lot. As you can see the lots
to the north and south of our property are double the size of our lot. Our current lot is
5,564 square feet and with our proposed new home we will have a lot coverage of 59%.
If this same home were to be built on any of the lots to the north or south it would only
have a lot coverage of approximately 29%.
In order to achieve the additional lot coverage, we are proposing to install a rain
garden that will help eliminate any concerns of water runoff and will also enhance the
landscape on the southeast corner of the lot for everyone that lives in the area to enjoy as
they walk or drive by the home. The proposed home will maintain all of the current
setback requirements shown on the proposed plot plan, so the amount of lot coverage is
the only variance we are seeking.

Statement of Support
Due to the fact that the lot is approximately half the size of all of the other lots on
the street, it is our belief that the variance is necessary to feasibly build a new home on
this lot. The proposed home is within the similar size range of other new homes being
built in the area and will help enhance the overall streetscape and values in the area. The
home will blend nicely and will have the same proportions of other homes as it relates to
the front and side yard setbacks. If this home were to be built on any of the lots to the
north or south we would only be covering 29%of the lot.
In order to eliminate the engineering departments concerns about water runoff, we
propose to install a rain garden on the south east corner of the property and to comply
with the city engineering departs rain garden requirements. The rain garden would be
similar to what was recently approved and constructed at 32 First Street NE for a
commercial office building to be able to achieve their variance for lot coverage.
. It is our intent to construct a home that will help enhance the community and
increase the home values in the area. The overall investment my client is proposing to
invest in this home is approximately four times the value of the existing home and will
therefore produce a significant increase in property tax income for the city. Thank you
