1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
All safety standards put in place to prevent nhstructinn of sight
lines and driver vision by objects placed near right-of-ways or
intersections will be maintained.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The sign itself is attractive and will be constructed of quality
materials . Its placement within the right-of-way will not inhibit
any use nor will it negatively affect values in adjacent areas .
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because.
The strict application of the terms of the Zoning Ordinance could
impact the vehicular access to the site, especially for larger vehicles
like fire trucks . It would also reduce the visibility of the signage .
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
Docket No. 1312 0 0 03 V is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.

The requested variance will actually improve stnrmwatPr quality and
in doing so provide a benefit to public health, safety, morals and
general welfare .
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The requested variance provides for minimal revision to the huilt
environment . Further the revisions exist entirely within our site
on private streets . These revisions will be almost imperceptible.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because.
Stormwater drainage will he addressed in a more traditional manner
without the benefits of natural systems to improve water quality and
the aesthetics of these necessary systems .
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
Docket No. 14 02 0 0 01V is granted, subject to any conditions stated in the minutes of this
Board,which are incorporated herein by reference and made a part hereof.

Docket Number: 13120003V—Sign Placement in the Right-of-Way
Statement of Variance for Docket Number: 13120003V
The applicant seeks to locate a Permanent Residential Complex Sign within the right-of-
way for Westfield Boulevard. A variance from Section 25.07.02-01(e)1 is requested by
the applicant. This standard requires the sign to be located five feet from the ROW.

All required Vision Clearance Standards per Chapter 3 of the Zoning Ordinance will be
maintained with the requested sign location.
Docket Number: 14020001V-Removal of Curbing from Private Internal Streets
Statement of Variance for Docket Number: 14020001 V
The applicant seeks to remove curbing from private,internal streets to improve
stormwater quality and drainage. A variance from Section 27.03.02 and 6.03.20(5) is
requested by the applicant. These standards require curbing in the areas proposed for
removal.
Statement of Support for Docket Number: 14020001V
The removal of curbs in these areas will allow for an improvement in stormwater quality
as the stormwater will be able to sheet flow into vegetated swales thereby allowing the
stormwater to permeate through the vegetation and soils, naturally reducing the amount
of sediment, suspended solids and other elements that negatively impact stormwater
quality.
