1. Docket No. 05080016 PP, 05080017 SW, and 05080018 SW: Windsor Grove 2
The applicant seeks to plat 30 lots on 30.056 acres with the following subdivision
waIvers:
Docket No. 05080017 SW: 6.03.19 - Access to Arterials, Parkways, and Collectors
To seek relief from houses fronting collector streets/200 foot required separation from
collector streets.
Docket No. 05080018 SW: 6.03.21 - Points of Access
To seek relief from providing 2 points of access into the subdivision.
The site is located at 3105 106ht St. West and is zoned S 1.

The applicant is proposing a 30 lot subdivision on 30.56 acres requiring the approval of two
subdivision waivers. Please see the original information packet provided by the applicant for
details. The public hearing for this item was held at the September 20, 2005, Plan Commission
meeting. Several people spoke in opposition to the project. Concerns were as follow:
1. The subdivision waiver for points of access was opposed. Some residents feel that not
connecting to 106th Street in this section of the subdivision will channel too much traffic
through the existing section 1. There was also some concern over emergency access into
the section if there is only one point of access granted for the entire subdivision.
2. Adjoining property owners voiced their desire to see increased landscaping along the
southern and western boundaries to provide an adequate buffer from the rear yards of
houses.
3. Further details on the potential of retention ponds affecting the water table/existing wells.
Staff along with the Hamilton County Highway Department request a connection to 106th Street
that lines up to the existing entrance on the north side (entrance to King's Mill Subdivision).
Connecting to 106th street is more desirable from both a traffic circulation and safety standpoint.
As such, we do not support this waiver request.
We have received a letter from a lot owner in Section 1 that is in support of the proposed design
(see attached)
Ifthis connection is not made, the petitioner will need to file a cuI de sac length waiver as well
(to allow a cuI de sac in excess of 600 feet). If there is reason to support the cul-de-sac design,
accommodations should be made for emergency access as well as convenient pedestrian access to
the trail along 106th Street.

The applicant seeks to plat 15 lots on 12.045 acres with the following subdivision
waIvers:
Docket No. 05080022 SW: 6.03.19 - Access to Arterials, Parkways, and Collectors
To seek relief from houses fronting collector streets/200 foot required separation from
collector streets.
The site is located at the NW Comer of W. 121 st St. and Shelborne Rd and is zoned S 1
(ROSa).

Background
The applicant is proposing a 15 lot subdivision on 12 acres requiring the approval of one
subdivision waiver. Please see the original information packet provided by the applicant to view
the proposed layout. The public hearing for this item was held at the September 20, 2005, Plan
Commission meeting. Several people spoke in opposition to the project. Concerns were as
follow:
1. The subdivision waiver was opposed - with a desire to see the homes on lot 1 and 15 face
Shelbome Road.
2. Landscape plan and tree preservation needs to be revised to show only the subject
property and not what is on adjoining lots.
3. Further information on where sewer service accesses this property, and the potential for
neighboring properties to tap into the system.
Previous Approval
Kendall Wood originally received primary plat approval in January 2005 for 17 lots on 18 acres.
At this time they also received a subdivision waiver approval from 6.03.19 - Access to Arterials,
Parkways, and Collectors. This approval allowed the required 200' bufferyard along Shelborne
Rd. to be reduced to 25'. With these approvals the petitioner committed to the following:
1. The applicant agreed to additional landscaping ($5,000 per lot and plantings within the
rear yards).
2. Exclusively wood fence of the same type along the west property line and a maximum of
three street lights at the entrance in addition to dusk to dawn yard lighting.
Amended Plan
The petitioner has revised the approved plan to accommodate a smaller site. The new plan has 2
less lots and 6 less acres. This revised plan adheres to the ROSa standards. Like the previous
approval, the applicant seeks a waiver from 6.03.19 - Access to Arterials, Parkways, and
