During the negotiation process, the Owner rejected the offer stating that the proposed right-of-way will encumber a portion of their interior drive. The Owner requested the proposed right-of-way be revised to eliminate any encumbrance on their interior drive. The proposed right of way was revised and reduced by 0.091 acres or 3,964 square feet, resulting in a new right-of-way totaling 0.255 acres. Based on the City's original fair market value determination, the value of the revised proposed right-of-way was calculated to be $81,975.00. We believe it is in the best interest of the City to settle this matter by acquiring the new right-of- way for 581,975.00.
