Chairman Clerk/Treasurer We, the undersigned, , owners of the real estate shown and described herein, do hereby certify the we have laid off, platted, and subdivided, and do hereby lay off, plat and subdivide, said real estate in accordance with the within plat. The subdivision shall be known and designated as North Haven, an addition to the City of Carmel. Front and side yard building setback lines are hereby established as shown on this plat, between which lines and property lines of the street there shall be erected or maintained no building or structure. This Secondary Plat is recorded in connection with a Declaration of Covenants, Conditions and Restrictions. Restrictions contained within said Declaration are supplemento; to those contained herein. There are strips of ground as shown on this plat and marked "Easement ", reserved for the use of public utilities for the installation of water and sewer mains, poles, ducts, lines and wires, subject at all times to the proper authorities and to the easement herein reserved. No permanent or other structures are to be erected or maintained upon said strips of land, but owners of lots in this subdivision shall take their titles subject to the rights of the public utilities. Additional right —of —way, to 70 feet and shown herein, along Gray Road is hereby dedicated to the public. The Owner /Subdivider and any and all successors and assigns hereby waive all rights to petition the Hamilton County Highway Department, the Hamilton County Board of Commissioners, or Hamilton County, or the successor unit of government to be responsible for the maintenance of the ingress— egress easement, or to have the easement considered a public road necessitating maintenance by any unit of government. Common Area, Block A. as shown herein, is an Ingress /Egress easement with rights reserved for the Owners, Tennonts, Invitees, etc. of Lot 1, Lot 2 and Block D. The 7 Non Access Easement" is to limit possible points of entry into the property to the Ingress /Egress Easement. The right to enforce these provisions by injunction, together with the right to cause the removal by due process of low, of any structure or part thereof erected or maintained in violation hereof, is hereby dedicated to the public, and reserved to the several owners of the several lots in this subdivision and to their heirs and assigns.
