In accordance with Title 865, Article I, Rule 12 of the Indiana Adm inistrative Code, the following observations
and opinions are subm itted regarding the various uncertainties in the locations of the lines and corners
established this survey as a result of uncertainties in reference m onum entation; in record descriptions and
plats;in lines of occupation• and as introduced by random errors in m easurem ent ( "Theoretical. U ncertainty ").

of uncertainty along any line equal in magnitude to the discrepancy in the location of the lines of possession
from the surveyed ]in es
There m ay be differences of deed dim ensions versus in easured dim ensions along the boundary lines shown
hereon and,1ikewise,thcre m ay be found survey in arkers near,but not precisely at, sour e boundary corners. In
cases where the m agnitude ofthese differences arc less than the'ThcoreticaI U n certain ty stated below, less than
the Positional Tolerance, and less than the uncertainty identified for the reference m onum ent ation (discussed
below), the differences rn ay be considered insignificant and arc shown only for purposes of in athem aticaI

P u r p o s e:
The purpose ofthis survey was to retrace and m onum ent the boundary ofa the real estate described hereon
under "Land Description." The real. estate described hereon under "Land Description" is the real estate
described in deeds to Jam es Shelley recorded as Instrum ent N um bers 8707391 and 870393 in the Office ofthe
Recorder of H am ilton County, Indiana
Reference Monum entation:
N o original m onum ents were called for within the plat for Orin Jessup Land Company's First Addition to the
Town of om e Place. M onum ents found within the block in which the subject real estate is located controlled
the survey. These m onum ents were: ])one- halfinch iron pipe found at the Northwest corner ofLot 174 ofsaid
plat; 2) one -half inch iron pipe found at the Northwest corner of Lot 175 of said plat; 3) a rebar found at the
Southwest corner of Lot 172 ofsaid plat;4) a 518 inch rebar found at the Southwest corner ofLot 223 ofsaid
plat.
A survey by W eihe E ngineers, Inc., certified M arch 20, 1987, was used to create the boundary for the real estate
described in Instrument N um ber 870393, and said survey noted iron pipes set at the corners. The corners for
this parcel were held per rebars found.
D i s c r e p a n c i e s in record descriptions and plats:
Based on current research for the subject and adjoining real estates there are no deed gaps or overlaps

As a result of the above observations, it is m y opinion that the uncertainties in locations ofthe lines and corners
established on this survey are as follows:
a) Variance in reference m onum ents: 0.8'N orth & 0.5'W esI.
b) Discrepancies in record descriptions and plats: None found.
c) Inconsistencies in lines of occupation: None observed.
d) Theoretical Uncertainty (due to random errors in m easurem ents) of the corners of the subject tract
established by this survey is within the specifications of Class B survey ( +/ -0.25 feet) as defined in I.A.C. 865

The within plat and survey were prepared without benefit of current evidence of source of title for the subject
tract or adjoiners and are therefore subject to any statement of facts revealed by examination of such
docum ents.
Along any line where a deed gap or overlap or inconsistency in line ofoccupation occurs,unwritten rights in ay
be available to the subject and /or the adjoining real estates.
The subject tract is zoned R -3 Residential. The various zoning restrictions for a R -3 Residential district,
together with any m odifications to those restrictions that in ay have been agreed to at the tim e of approva1,m ust

extension of the South line of said Lot 175 to the W est line of the former Indiana Union Traction Company
right -of -way, said W est line being the East line ofI.0 .T. Boulevard, and to a point on a non - tangent curve whose
radius point bears South 51 degrees 22 in inutes 35 seconds E ast 3852.72 feet from said point; thence
N ortheasterIy on said W est right -of -way line an arc distance of 136.36 feet; thence N orth 90 degrees 00 m inutes
00 seconds W est parallel with the South line of said Lot 175 a distance of 78.64 feet to the E ast line ofsaid Lot
175 and a point on a non - tangent curve whose radius point bears South 50 degrees 05 in inutes 57 seconds East
