Filed by Justus Investment Co. Report to be submitted by Subdivision Committee, Town Engineer and Building Commissioner. Phil Nicely, attorney. for Justus Co., appeared to answer questions. Subdivision Committee Report,by Stephens; there seems to be some question on drainage. Drainage going East flows onto Am. Aggregates property. -Is there some agreement with Am. Aggregates? Are streets to be dedicated? Nicely - streets are not to be dedicated. 'He-suggests that if they do not come up to Town requirements their building permit could be revoked. He states this is a high class development and it in turn will attract high class buyers and they will all have legal counsel of their own before closing. Builder could also post a bond to the Property Owners Association. William Karns of American Aggregates was introduced. He states that Am. Aggregate has a project of an 88 acre lake. Legal documents have been - drawn for easements of surface drainage to run into this lake. Town Engineer Report attached to file Summary; storm drainage satisfactory, sanitary sewers-do not meet full town requirements, streets not strictly within town specifications, water hydrants oked by fire chief, Construction Bond should be 100% until completion and Maintainence Bond for a period of 3 years. - - • Spencer asked why street would not be dedicated. Nicely stated, people who live in the development will own all land collectively. Control is through the Association. There will be no cars on the street. - The Association will be able to keep people out if they so desire. This would afford more privacy for the residents. Rumler questioned garages. A. There will be a two car garage for each apartment and no sidewalks 'or curbs and gutters. Burgher asked if school buses would be allowed to be on the streets. A. Private and quasi-private vehicles would have access. Town Engineer stated sidewalks should be provided on Gray Rd. and 126th Street. Swift feels, fire hydrants should be Association owned if the streets are private. - Building Commissioner recommends consideration of a passing lane on North side of-126th Street. Kern will look into the legal side of a passing lane. Stephens moved that Brookshire 1st section, Phase One Application of Plat or Replat be approved subject to recommendation from the special committee consisting of Subdivision Committee, Town Board and Town Engineers re- commendation of 2nd stub outlining to tie into 3rd section and 8" main be completed to tie in at Gray Road.
