Dear Mr. Neal:
Thank you for your August 24, 2000 request for information concerning a tract of land along Williams
Creek. Based on your description, the parcel, which lies in the SY2 of Section 22, Township 18N,
Range 3E; extends from West 1361h Street to West 141 sl Street and extends approximately 1,300
feet west of the east section line near Carmel, Hamilton County.
For your reference, the 1 DO-year frequency flood elevations have been determined for a portion of
Williams Creek, from approximately 250 feet north (upstream) of West 141 st Street to approximately
950 feet south (downstream) of West 136th Street. The modeling done by this office is based on a
1 DO-year discharge of 1250 cfs. The computed 1 DO-year frequency flood elevations are shown
below:

As a cautionary note, please understand that the development of the 1 DO-year flood elevations and
floodway boundary along Williams Creek was based on limited detailed information. Due to lack of
stream data upstream and downstream of your site, the computed flood elevations and floodway
delineation may be subject to adjustment in the future if a detailed floodway analysis is completed
for a longer reach of stream.
The yellow-shaded area on the attached floodplain map is determined to be the floodway of Williams
Creek. Portions of the site lie inside the floodway and construction in this area will require approval
by the Department of Natural Resources. IC 14-28-1 prohibits constructing abodes or residences
in or on a floodway and requires the prior approval of the Department of Natural Resources for any
other type of construction, excavation, or filling in or on a floodway. To be approvable a project
should be designed so that it will not restrict the floodway, be unsafe to life and property, nor
adversely affect the fish, wildlife, or botanical resources.
The blue-shaded area outside of the floodway and below the 1 DO-year frequency flood elevation is
called the floodway fringe area of Williams Creek. While these portions of the tract would be subject
to flooding, they are not required for the conveyance of flood waters during the 1 DO-year event;
therefore, approval by the Department of Natural Resources under Ie 14-28-1 for portions of the
project in this fringe area is not required unless a dam is to be constructed.
We recommend that any building which you propose for this site, noting again that residences are
prohibited in the floodway under the provisions of IC 14-28-1, be provided with a lowest floor set at
least 2 feet above the 1 DO-year frequency flood elevation. If a basement is included, the basement
floor should be considered to be the lowest floor.
If any existing or proposed building lies within the "Special Flood Hazard Area", as defined by the
Federal Emergency Management Agency, current or future owners may be required to purchase
flood insurance as a condition of obtaining a mortgage on the property. The final determination
regarding the flood insurance requirement is the responsibility of the lending institution. Flood
insurance might also be required for any direct federal assistance for this property, such as disaster
aid.
Depending on the type of building and the lowest floor elevation, including basements, flood
insurance premiums can be substantial under the regular phase of the National Flood Insurance
Program. The owner should discuss this matter with an insurance agent before starting any plans
for construction.

(4) No street, sidewalk, driveway, road, alley or curbing shall be constructed substantially
parallel to Grantees said lines and within the EASEMENT PARCEL. Nothing herein shall
preclude Grantor, its successors or assigns, from constructing any street, sidewalk, driveway,
road, alley or curbing across Grantee's said lines so long as said street, sidewalk, driveway, road,
alley or curbing shall cross Grantee's said lines at approximate right angles thereto; provided,
however, that if the proposed construction by Grantor, or its successors or assigns, of any street,
. sidewalk, driveway, road, alley or curbing across the EASEMENT PARCEL would, in Grantee's
opinion, imperil Grantee's said lines, then Grantor, and its successors or assigns, may proceed
with such proposed construction after (A) Grantor, or its' successors or assigns, has entered into
an agreement in form satisfactory to Grantee to pay to and reimburse Grantee for all direct and
indirect costs and expense of every sort and character which would have to be incurred or
expended by Grantee in connection with whatever protective work, for example, lowering,
encasing, adjusting or otherwise altering Grantee's said lines that might, in Grantee's opinion, be
required to protect Grantee's said lines from the consequences of such proposed construction and
(B) Grantee has had such reasonable period oftime as might be required by Grantee to complete
such protective work as may be covered by the aforesaid reimbursement agreement. In order to
facilitate the proper operation of this provision, Grantor shall give to Grantee a minimum of ninety
(90) days notice, in writing, prior to the commencement by itself or third parties of the types of
construction referenced in this Paragraph, and shall take such steps to protect Grantee's said lines
as Grantee may require.
(5) It is recognized by the parties hereto that one purpose of this directive is to facilitate
the development by Grantor oflands covered by all Agreement(s) and Grants as originally
executed. Grantor hereby agrees that should its development of such lands in any way or for any
reason compel or make reasonably necessary the expenditure of additional funds by Grantee, such
shall be reimbursed to Grantee by Grantor. Such expenditures shall include, but not be limited to,
added expenditures for marking or protecting Grantee's lines made necessary by such change in
land usage, whether such expenditures shall be demanded by governmental regulations or made
necessary, in Grantee's reasonable judgment, by the changed character and usage of the land.
