Grant of Drainage, Utility and Sewer Easement vN&�0 SURV'� -.;: <'
The undersigned owner ( "Grantor ") hereby grants to the City of Carmel, Indiana and public utilities with the proper authorization and
franchises from the City of Carmel, Indiana and their successors and assigns ( "Grantee ") a non — exclusive easement under and across
those areas shown as "D.U. & S.E." on this plat ( "Easement Area) for the purpose of the construction, repair, replacement,
maintenance and operation of sanitary sewer, storm sewer, water, electrical, telephone and natural gas lines, equipment, fixtures and
attachments, including surface manholes, underground conduits, pipes and equipment, to provide such utility service to the property
platted hereby and adjacent property, together with the reasonable right of ingress and egress for the purpose of access to the
Easement Area across those portions of the land plated hereby that are not now or hereafter improved with buildings. The
easements granted herein shall be subject to the following terms conditions: (a) such easements are subject to all easements and
encumbrances of record; (b) all lines, equipment, fixtures and attachments placed within the Easement Area by Grantee, or its agents
or contractors, pursuant to this instrument ( "Grantee's Property) shall remain the property of Grantee and shall be located below
ground or at the surface of the Easement Area; (c) Grantor and its successors and assigns retain the right to full use of the
surface and subsurface of the Easement Area except where Grantee has placed Grantee's Property, provided, however, Grantor will not
erect any building or major structure within the described easement orea(s); (d) Grantee shall at oil times safely operate and maintain
Grantees Property within the Easement Areas and shall promptly repair and restore to its prior condition any paving, parking lot
striping or other improvements, (except buildings and other major structures existing within the Easement Area) which ore disturbed
by the construction or maintenance of Grantees Property by Grantee, or its agents or contractors; and (e) Grantee shall not in the
exercise of its rights hereunder unreasonably interfere or obstruct Grantor, or Grantors agents or contractors, in the location or
construction of any buildings located in the area adjoining the Easement Area, or unreasonably interfere with any business of Grantor;
provided, however that nothing in this subparagraph (e) shall allow Grantor or Grantors agents or contractors to construct a building
or other major structure within the Easement Area, or to unreasonably interfere with Grantee's rights to construct, operate and
maintain Grantee's Property hereunder.
Ingress & Egress Easement
Those areas on this plat shown as "Ingress /Egress Esmt.' Are subject to a non — exclusive ingress and egress easement as set forth
in that certain Declaration of Restrictions and Easements dated September 5, 2000 and recorded with the recorder of deeds of
Hamilton County, Indiana on September 7, 2000 as Document No. 2000 -44612 as amended by First Amendment to Declaration of
Restrictions and Easements dated September 5, 2000 and recorded with the recorder of deeds for Hamilton County, Indiana as
Document No. 2000 - 44613.
Building Line
All buildings located on the parcel of land platted hereby shall be setback from boundaries of said parcel by a minimum distance as
indicated by those lines shown on this plat as 'BL" (i.e., building setback line).
