Ballot Sheet I/3527267.1 DETAILED DESCRIPTION OF VARIANCES REQUESTED FOR MERIDIAN MARK I AND MERIDIAN MARK II Zeller Carmel, LLC, the Petitioner, is seeking variances of development standards to allow for reductions in varying widths of landscaping along U.S. Highway 31, and a reduction in varying widths of the bufferyard along 116th Street and Pennsylvania Street. These variances are needed due to the inability to comply with the City of Carmel Zoning Ordinances regarding landscaping and setback requirements along U.S. Highway 31 and the bufferyard along 116th Street and Pennsylvania Street, which have occurred as a result of the expansion of U.S. Highway 31 North. The takings and expansion, and resulting inability to comply with such zoning ordinance requirements are described and depicted on Exhibit A and Exhibit B attached hereto and made a part hereof. The right-of-way takings make it impossible to meet the requirements of the U.S. Highway 31 Corridor Overlay Zone Landscape Requirements and Landscape Requirements for Perimeter Bufferyard. The variances regarding parking and bufferyards were legally, pre- existing non-conforming uses before the right-of-way takings along U.S. Highway 31 and 116th Street, as a result of their being compliant prior to the adoption of the U.S. Highway 31 Corridor Overlay Zone. Zeller-Carmel also seeks variances with respect to parking and bufferyards along U.S. Highway 31 to allow for the replacement of certain parking lost due to the State's taking. The variances being sought are as follows: Along US Highway 31 1. allow for parking spaces to be located in the greenbelt along US 31 for Meridian Mark I (otherwise not permitted) (Chapter 27.02.03) 2. allow for parking spaces to be located in the Greenbelt along US 31 for Meridian Mark II (otherwise not permitted) (Chapter 27.02.03) 3. allow for a reduction in the Greenbelt along US. Highway 31 for Meridian Mark I and Meridian Mark II varying from 6.2 feet to 23.4 feet (30 feet required) (Chapter 33.06(C)(1)) Alonji Pennsylvania Street 1. allow for parking spaces to be located in the perimeter bufferyard along Pennsylvania Street for Meridian Mark I (otherwise not permitted) (Chapter 27.02.03) 2. allow for parking spaces to be located in the perimeter bufferyard along Pennsylvania Streets for Meridian Mark II (otherwise not permitted) (Chapter 27.02.03) 3. allow for a reduction in the bufferyard along Pennsylvania Street for Meridian Mark I and Meridian Mark II ranging from 2.1 feet to 20.5 feet (15 feet required) (Chapter 33.05(A)(5)) Northern Property Line of Meridian Mark I 1. allow for parking spaces to be located in the perimeter bufferyard along the northern property line (otherwise not permitted) (Chapter 27.02.03) 2. allow for a reduction in the bufferyard along the northern property line for Meridian Mark I of 0 feet (15 feet required) (Chapter 27.02.03) Northern Property Line of Meridian Mark II 1. allow for parking spaces to be located in the perimeter bufferyard of the northern property line (otherwise not permitted) (Chapter 27.02.03) 2. allow for a reduction in the bufferyard along the northern property line for Meridian Mark II of 0 feet (15 feet required) (Chapter 27.02.03) Southern Property Line of Meridian Mark II 1. allow for parking spaces to be located in the perimeter bufferyard of the southern property line (otherwise not permitted) (Chapter 27.02.03) 2. allow for a reduction in the bufferyard along the southern property line for Meridian Mark II of 0 feet (15 feet required) (Chapter 27.02.03) Miscellaneous 1. allow for 710 parking spaces, which is a reduction of 24 spaces from that required by ordinance for Meridian Mark I (Chapter 27.08) 2. allow for 520 parking spaces, which is a reduction of 312 spaces from that required by the ordinance for Meridian Mark II, with adding 31 additional spaces will result in 551 parking spaces, which is a reduction of 281 spaces from that required; see Attached parking Exhibits (Chapter 27.08) 1/3528223.1 I:zj- +-j c m r-i dJ O C: z O 06 4- Q c W 'DN0 322J-N8L1-S£ '03S ---7/L-M'S-=3N11 '3 N N L ,9Z 9 - M-011,90.00N L-'8# '1SNI NC LL£'O L C M/? 031V01030 :i.p n.-{ivHdavi Q L tk• n; .k}33t a •L V h .. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The requested variances allow for the continued operation of multi-tenant office buildings. The use of the subject real estate will remain the same as it has existed for many years and therefore the grant of the variances by their very nature will not effect nor be injurious to the public health safety, morals and general welfare of the community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The variances allow for the continued operation of existing multi-tenant office buildings, which have existed for many years in this location, with no adverse impact on the adjoining areas. Continuing the same use will have no substantial adverse impact on the use or value of the areas adjacent as the same use will remain intact. Moreover, the surrounding areas are business offices in nature, and the reduction in landscaping and parking will have no impact on these adjacent office buildings, as the parking for Meridian Mark is self contained with the exception of one area of parking by non-exclusive cross easement. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The need for the variances arise solely from the takings of the right-of-ways along U.S. 31, 116th Street and Pennsylvania Street by the Indiana Department of Transportation. Changes in the U.S. 31 Overlay zone and the right-of-way takings make it impractical to meet the requirements where inadequate rooms exasts for the required landscapin8. The parking variance was a legally existing non-conforming use prior to the right-of-way takings. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. SEE ABOVE is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. Adopted this day of 20 14 CHAIRPERSON, Carmel/Clay Board of Zoning Appeals SECRETARY, Carmel/Clay Board of Zoning Appeals Conditions of the Board are listed on back. Petitioner or representative to sign.
