Explanation and Summary of Coinmitment Amendment
The Carmel Board of Zoning Appeals reviewed and approved use variance and
commitment amendment applications on November 26, 2012. At that meeting, the Board
discussed the need for lighting to address possible security and liability issues. At that time, the
petitioner did not believe that lighting was necessary. These applications were approved with a
commitment that "For as long as the Real Estate is being used as a surface parking lot for the
storage of motor vehicles, no lights will be installed on the Real Estate unless specifically
approved by the Carmel Board of Zoning Appeals."
As petitioner proceeded with the development of the lot and upon further consultation
with insurance and risk management advisors, it determined that lighting should be added. This
application seeks to modify this commitment in order to allow lighting pursuant to an approved
lighting plan with specific lighting fixtures as detailed under Tabs 8 and 9 respectively in this
information booklet.
The lighting plan which specifies the pole height and fixtures was specifically designed
to eliminate any light migration over the property lines. The selected fixtures have a zero (0)
rating for backlight, uplight and glare ("BUG") and is "Dark-Sky" certified to restrict light
trespass, glare and light pollution for neighborhood-friendly lighting. An explanation of the BUG
rating is contained under Tab 10.

STATEMENT IN SUPPORT OF COMMITMENT AMENDMENT
The purpose for seeking to modify this commitment is directly related to the security of
and general liability associated with the storage of vehicles on the approved surface parking lot,
The proposed lighting fixtures and the associated photometric plan (Tabs 9 and 8, respectively)
demonstrate that the lot will be adequately illuminated without illumination or light migration
beyond the property lines.

("Commitments") in compliance witli certain conditions made in connection with the approval of
that omdmJu Use \/adauoe granted by the Cuoocl Board of Zoning Appeals oou000liug the use
and development of the Real Estate under Docket Number: 12080016 UV. These Commitments
are intended to run with the land and are not personal to any owner of the Real Estate. As such,
these Commitments are binding upon the then current owner of the Real Estate and any other
party or entity that has any interest in the Real Estate (all such parties are hereinafter collectively
referred to an the°Owucr`).
STATEMENT 0PCOMMITMENTS:
l. No idling of motor vehicles will occur on site or on Day Drive in connection with the use

conducted by any entity affiliated by ownership or contract with.the Owner.
2. Either permeable pavement construction or an alternative method approved by the City of
Carmel Department of]Bugiucenng will bu utilized for storm water drainage on the Real
Bntutc and its use as u surface parking lot for the storage of motor vehicles being sold in
connection with the automobile sales conducted by any entity affiliated byownership or
contract with Owner.

automobile sales conducted by any entity affiliated by ownership or contract with Owner
(the "Required Maintenance"). In the event that Owner is unable to reach an agreement
for the Required Maintenance with the Day Drive Property Owners, Owner will
nevertheless be cornmitted to make the Required Maintenance. Provided, however, at
such time as Day Drive becomes a public street within the City of Carmel, Indiana and it
is accepted for maintenance as a public street,this commitment will expire.
4. For as long as the Real Estate is being used as a surface parking lot for the storage of
motor vehicles, no lights will be installed on the Real Estate unless specifically approved
by the Carmel Board of Zoning Appeals.
These Commitments may be modified or terminated only by a decision of the Carmel
Board of Zoning Appeals made at a public hearing after proper notice has been given.
These Commitments will be effective upon adoption by the Carmel Board of Zoning
Appeals of Docket Number 12080016 UV and the recording of these Commitments in the Office
of the Recorder of Hamilton County, Indiana.
These Commitments may be enforced jointly or severally by:
1. the Carmel Board of Zoning Appeals; and/or
2. any Day Drive Property Owner.

condition to the approval of a use variance and commitment amendment affecting certain real
estate located in City of Carmel, Hamilton County, Indiana, having a common address of 3130
East 96th Street, Indianapolis, Indiana 46240, (the"Real Estate") contained within Docket
Numbers 21080016 UV and 12080017 CA concerning the use and development of the Real
Estate as follows:
STATEMENT OF TERMINATION OF CONDITION OF APPROVAL:
1. Eliminate Condition 5 of the approval of special exception Docket Numbers 21080016
UV and 12080017 CA, which reads, "No lights on the parking lot itself."
This condition is embodied in the recorded Commitments Concerning The Use Or Development
Of Real Estate Made In Connection With The Approval Of A Zoning Variance" as commitment
number 4, which reads, "For as long as the Real Estate is being used as a surface parking lot for
the storage of motor vehicles, no lights will be installed on the Real Estate unless specifically
approved by the Carmel Board of Zoning Appeals."
This TERMINATION OF CONDITION shall run with the land, be binding on the Owner of the

The lumens within each LCS solid angle provide data that can relate to an evaluation of light
trespass and sky glow.
As illustrated in Figure 1, the primary solid angles defined by the LCS are:
• Forward Light
• Back Light
• Uplight

The sum of percentages of lamp lumens within these three primary solid angles is equal to the
photometric luminaire efficiency.

Forward Light
Forward light describes the lumen distribution in front of the luminaire. The forward light solid
angle is defined between 0 and 90 degrees vertical,and 270 to 90 degrees horizontal in front of
the luminaire. The forward light solid angle is further refined into four vertical secondary solid

angles to evaluate the distribution of light in front of the luminaire. The forward light secondary
solid angles(see Figure 3)are defined as follows:
• Forward light low secondary solid angle(FL)- Percent lamp lumens between 0 and 30
degrees vertical (or luminaire lumens within that solid angle) in front of the luminaire. This
is the light emitted from directly below the luminaire to 0.6 mounting heights away from
luminaire.
• Forward light mid secondary solid angle(FM)- Percent lamp lumens between 30 and 60
degrees vertical (or luminaire lumens within that solid angle) in front of the luminaire.This
is the light emitted from 0.6 to 1.7 mounting heights away from the luminaire.
• Forward light high secondary solid angle(FH)- Percent lamp lumens between 60 and 80
degrees vertical (or luminaire lumens within that solid angle)in front of the luminaire. This
is the light emitted from 1.7 to 5.7 mounting heights away from the luminaire.
• Forward light very high secondary solid angle(FVH)- Percent lamp lumens between 80
and 90 degrees vertical (or luminaire lumens within that solid angle)in front of the
luminaire. This is the light emitted beyond 5.7 mounting heights away from the luminaire.

Backlight, Uplight,and Glare(BUG) Ratings
The following Backlight, Uplight, and Glare ratings may be used to evaluate luminaire optical
performance related to light trespass, sky glow, and high angle brightness control. These ratings
are based on a zonal lumen calculations for secondary solid angles defined in TM-15-07. The
zonal lumen thresholds listed in the following three tables are based on data from photometric
testing procedures approved by the Illuminating Engineering Society for outdoor luminaries(LM-31
or LM-35).

Notes to Tables A-1,A-2,and A-3:
(1) Any one rating is determined by the maximum rating obtained for that table. For example, if the BH
zone is rated B1, the BM zone is rated B2, and the BL zone is rated B1, then the backlight rating
for the luminaire is B2.
(2) To determine BUG ratings, the photometric test data must include data in the upper hemisphere
unless no light is emitted above 90 degrees vertical (for example, if the luminaire has a flat lens
and opaque sides), per the IES Testing Procedures Committee recommendations.
(3) It is recommended that the photometric test density include values at least every 2.5 degrees
vertically. If a photometric test does not include data points every 2.5 degrees vertically, the BUG
ratings shall be determined based on appropriate interpolation.
(4) A"quadrilateral symmetric" luminaire shall meet one of the following definitions:
a. A Type V luminaire is one with a distribution that has circular symmetry, defined by the
IESNA as being essentially the same at all lateral angles around the luminaire.
b. A Type VS luminaire is one where the zonal lumens for each of the eight horizontal octants
(0-45, 45-90, 90-135, 135-180, 180-225, 225-270, 270-315, 315-360)are.within±10
percent of the average zonal lumens of all octants.
