Re: Vine & Branch, Inc. - Landscape Plan
1. Provide a Plant Schedule which notes: common and scientific name; size specified,
spacing (if applicable), and quantity.
2. DOCD Guidelines for buffering between land -uses will require a ten -foot landscaped
bufferyard between the single - family residential to the south and west, and your
retail /commercial use.
Landscape criteria for this bufferyard are: three (3) deciduous canopy trees, five (5)
deciduous understory trees, and fifteen (15) shrubs per each 100 linear feet of common
boundary. Coniferous trees may be substituted for one -third of the deciduous
understory trees only.
3. DOCD Guidelines for buffering between land -uses also requires a ten -foot landscaped

Re: Vine & Branch Landscaping
Pursuant to direction from Kenton C. Ward, Hamilton County Surveyor, detention will not be
required for this project at this time, However, if in the future this site undergoes an expansion,
thus creating additional hard surface, a complete drainage plan including calculations and
detention will be required for the entire site.
It should be noted that this project is still required at this time to submit an Outlet Request Permit
form for storm water discharge into the U.G. Mitchuer regulated drain, This is classified as an
indirect outlet. The current proposal will receive approval upon receipt of the completed permit
form,

Dear Mr. Scott:
It was a pleasure to meet with you this afternoon to
discuss your proposed project. This project is located on
your property consisting of approximately 1.9 acres making
up part of the E1 /2 of the NE 1/4, Sec. 20, T18N, R4E,
Hamilton Co., Indiana. I have considered your proposed
additions and have evaluated their affects on the surface
drainage of your property and the adjacent tracts.
It is my opinion that the proposed additions will increase
the volume of runoff from your property by approximately 5
(five) percent. This is because of the increase in
impervious areas (roofs) and gravel driveways. The peak
(maximum) rate of runoff should not be measurably affected
because the hydraulic path length and time of runoff
concentration will not be changed.
I did not perform any topographic surveys of the property,
but casual observation indicates that runoff water may
actually pond for a period of time in both the northeast
and northwest corners of the property along 146th street
and the former inter -urban railroad grade, respectively.
This would limit the affect of any additional runoff from
your property to the surrounding tracts.

The following are review comments /suggestions submitted to the petitioner on October 16.
The Department suggests the petitioner install a landscape buffer and/or privacy fence along
the south and west property lines which abut residenially zoned land. Special attention should
be given to future land uses in relation to the activity around the "shop ".

DOCUMENTS SIGNED BY KAISER REALTY AND MR. JUDSON INDICATE THAT THIS PROPERTY
WAS SOLD AS A COMMERCIAL SITE?
2. 146TH STREET IS A MAJOR TRAFFIC ARTERY. ANY BUSINESS /COMMERCIAL DEVELOPMENT
ALONG THIS CORRIDOR MAGNIFIES TRAFFIC PROBLEMS. TRUCKS AND EXCESSIVE AUTO
TRAFFIC ENTERING 146TH NEAR THE INTERSECTION OF GRAY ROAD WILL RESULT IN
MORE CONGESTION AND POSSIBLY INCREASE ACCIDENTS.
3. THE OPERATION OF A LANDSCAPE /MAINTENANCE OPERATION BELONGS IN AN
INDUSTRIAL AREA, NOT A RESIDENTIAL AREA. (BOTH CARMEL AND NOBLESVILLE
HAVE SPECIAL INDUSTRIAL PARKS FOR COMMERCIAL /INDUSTRIAL TYPE BUSINESSES).
4. THE OPERATION OF AN ANTIQUE SHOP BELONGS IN A BUSINESS /COMMERCIAL AREA.
THERE IS MORE THAN ADEQUATE. PROPERTY AVAILABLE AND ZONED FOR THIS ACTIVITY
WITHOUT CREATING RETAIL BUSINESS OPERATIONS IN A RESIDENTIAL AREA.
5. IN 1979 THE CARMEL /CLAY ZONING BOARD, BY LEGAL PROCESS, REQUIRED FIFTY
FEET OF RIGHT -OF -WAY (50' X 350') ALONG 146TH STREET AS A CONDITION BEFORE
ISSUING A BUILDING PERMIT TO BUILD A HOME ON THE ALBERSON'S EIGHT ACRES.
IS THE PRECEDENT SET FOR THE ALBERSON'S TO BE EQUALLY APPLIED TO MR.
SCOTT'S PROPERTY AT 4721 EAST 146TH STREET? TO ISSUE A BUILDING PERMIT FOR
A MAINTENANCE GARAGE /FACILITY WITH A FIFTY FOOT SET BACK ON THE SCOTT PROPERTY
COULD MAKE THIS PROPERTY INADEQUATE FOR VARIANCE REQUESTS AND HIS
INTENDED USES FOR THIS PROPERTY BECOMES INVALID (MOOT).
[IF FOR ANY REASON A BUILDING PERMIT IS ISSUED TO MR. SCOTT FOR THE
PROPERTY AT 4721 EAST 146TH ST. WITHOUT THE 50'OF RIGHT -OF -WAY BEING
REQUIRED, MR. & MRS. ALBERSON WILL NEED TO LEGALLY PURSUE FOR THE RETURN OF

6. A LANDSCAPE /MAINTENANCE /TREE TRIMMING OPERATION DOES NOT BELONG IN A
RESIDENTIAL AREA. THIS TYPE OF OPERATION IS INCOMPATIBLE WITH HOMES AND
HOUSING SUBDIVISIONS AND SIGNIFICANTLY LOWERS THE QUALITY OF LIFE AND
THE VALUE OF THE RESIDENTIAL REAL ESTATE. (DOCUMENT AVAILABLE)
SUMMARY
IT IS OUR CONTENTION THAT THERE IS NO LOGICAL REASON FOR THE CARMEL /CLAY
ZONING APPEALS BOARD TO APPROVE MR. SCOTT'S REQUESTS FOR VARIANCES.
PROVIDING THE ZONING BOARD DESIRES TO CONTINUE 146TH STREET AS A RESIDENTIAL
AREA /CORRIDOR IN CLAY TOWNSHIP, IT WILL DENY THESE VARIANCES AND MR. SCOTT WILL
CREATE BUSINESS OPERATIONS IN THE AREAS OF CLAY TOWNSHIP CURRENTLY FULLY ZONED
FOR HIS BUSINESS OPERATIONS-

The Use Variance application filed for the Vine and Branch has been reviewed by our
office. The following comments need to be addressed and plans updated accordingly:

•The required parking needs to be shown on the plan. Each space is to be shown as at
least 180 square feet.
•The antique shop is required to have 1 space per 300 square feet of floor area.
•The landscaping business is required to have one space per 300 square feet of indoor
space plus one space per acre.
•The parking lot is required to be paved and curbed.
•A detailed landscape plan needs to be provided showing location, type, and number.
•Any proposed lighting on site needs to be provided.
•A sketch of the proposed sign needs to be submitted.
•The right -of -way line for 146th Street needs to be shown on the site plan.
•The required yard setbacks need to be shown on the site plan.
-Correspondence from the members of the Technical Advisory Committee needs to be
provided to our office.
Once these items have been addressed and plans submitted, an additional review will be
