HomeMy WebLinkAboutFindings of Fact CARMEL BOARD OF ZONING APPEALS CARMEL, INDIANA Docket No 14040030 V— Number of Monument Signs Petitioner Kite Greyhound, LLC and Kite Realty Group Variance PUD Ord Z-344, Sec 11 3 C 1 To allow three (3) signs (one (1) sign allowed) FINDINGS OF FACT- DEVELOPMENT STANDARDS VARIANCE 1 The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because it works to address the negative impacts of road upgrades to 146th Street and US 31/North Meridian Street along the north and west boundary lines of Greyhound Commons commercial center, which has created problems in visibility of and navigation/access to the center The proposed multi-tenant monument signs will enhance the public health, safety and general welfare of the community by allowing the traveling public greater time and distance for locating and navigating through traffic to the commercial tenants within the center, which, in turn, will also benefit the community by enhancing the value of the property and the ability to attract new tenants to the remainder of the available land in the center 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because the proposed signs will adequately identify the center, promote the existing tenants' business and foster business attraction to the remaining developable land in the center with sign locations that are internal to the larger regional commercial node and not adjacent to residential uses 3 The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because of the significant detrimental impact otherwise imposed on Greyhound Commons due to the lack of adequate identification of the center and its tenants within a regional commercial node resulting from the widening of and additions to the adjacent 146th Street and Lowes Way and the upgrade of U S 31 to interstate highway status DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No 14040030 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof � Adopted thi �T day of A- , 201 I C IRPERSON, Ca mel Board of Zoning Appeals . / SECRETARY, Carmel Bo:rd •,f'oning Appeals Al A, - i 44 Conditions of the Board are listed on the back. (Petitioner or his epresentative o sign) 0 KRIEG I JEVAULT- CARMEL BOARD OF ZONING APPEALS CARMEL, INDIANA Docket No 14040031 V—Sign Located in the Right of Way Petitioner Kite Greyhound, LLC and Kite Realty Group Variance 25 07 01-06 h) To allow for sign in the right of way FINDINGS OF FACT- DEVELOPMENT STANDARDS VARIANCE 1 The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because it works to address the negative impacts of road upgrades to 146th Street and US 31/North Meridian Street along the north and west boundary lines of Greyhound Commons commercial center, which has created problems in visibility of and navigation/access to the center The proposed off premise monument sign will enhance the public health, safety and general welfare of the community by providing better advance notice of the commercial center to vehicular traffic along 146th Street and allowing the traveling public greater time and distance for locating and navigating through traffic to the commercial tenants within the center Additionally, this sign is subject to the express approval of the Hamilton County Highway Engineer and Department to ensure the safety of the general public 2 The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because the proposed sign will adequately identify the center, promote the existing tenants' business and foster business attraction to the remaining developable land in the center with sign locations that are internal to the larger regional commercial node and not adjacent to residential uses 3 The strict application of the terms of the.Zoning Ordinance to the property will result in practical difficulties in the use of the property because of the significant detrimental impact otherwise imposed on Greyhound Commons due to the lack of adequate identification of the center and its tenants within a regional commercial node resulting from the widening of and additions to 146th Street and the upgrade of U S 31 to interstate highway status This road construction has substantially increased the elevation of the adjacent roadway from the elevation grade at the base of the proposed sign making this sign and the location of the sign within the right of way critical to properly identify the center and the tenants within the center DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof dopted this day of/144120 i' gilW / c ' CH RPERSON, Carmel :oard of Zoning Appeals ae)-74-44—c..1 -SECRETARY, Carmel Bo d of! ning Appeals Tri--(3. � ; ,II Condtion .f the Board are listed on the back.
