Carmel Science & Tech Park, Blk 12, lot 5 - Velocity Sports Performance The applicant seeks use variance approval for an athletic training facility. Docket No. 05120006 UV ZO Chapter 20D.Ol permitted uses The site is located at 1402 Chase Ct. and is zoned M-3/Manufacutring. Filed by Charlie Frankenberger of Nelson & Frankenberger for BP Sports, LLC. General Info: The petitioner is seeking use variance approval to use an existing building as an athlete performance training facility. This use is not allowed in the M- 3/Manufacturing district. This item has appeared before the Technical Advisory Committee to address all technical Issues. Analysis: The uses adjacent to the site are a professional school of dance to the north, a wall climbing business so the south, and just to the west of the site is a residential townhome development. The parking, landscaping, and lighting are already in place on this site. Additional screening will surround the new HV AC units, and additional pavement will provide more parking opportunities for patrons, as well as meet the parking requirements for this use. The proposed sign will need a sign permit. It is smart and efficient to reuse an existing building, rather than construction a new building on a new site, or tearing down this existing building and rebuilding. Findings of Fact - Use Variance 1. The grant of this variance will not be contrary to the public interest, due to the existence of special condition(s) such that enforcement of the zoning ordinance will result in unnecessary hardship because: The existing building/site is now a vacant warehouse building, suitable for the use proposed. The existing warehouse building can be reused, instead of tom down. 2. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The athletic performance training facility will reside within an existing building. 3. The use or value of the area adjacent to the subject property will not be substantially affected in any adverse manner because: The Comprehensive Plan 1997 Land Use Map shows the area in question to be suitable for low intensity region/commercial employment areas. The use proposed fits the Comprehensive Plan and may not be an imposition to neighboring uses. 4. The need for the variance arises from a natural condition peculiar to the subject property because: The site is within the Carmel Science & Technology Park, zoned primarily for manufacturing uses. The site is also close to Carmel's city core. 5. The granting of this variance does not substantially interfere with the Carmel/Clay Comprehensive Plan because: The Comprehensive Plan 1997 Land Use Map shows the area in question to be suitable for low intensity region/commercial employment areas. The use proposed fits the Comprehensive Plan and may not be an imposition to neighboring uses. Recommendation: The department recommends positive consideration of Docket No. 05120006 UV.
