The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The variance will not affect the general welfare of the community because the property is on a 3 acre property. It is not near any easements, utilities, adjoining properties, or other structures. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The new garage is over 119'from east property line. 192' from north property line. and 132'from west property line. The structure will be built to blend with similar details of the existing home.-The garage will add value to the property. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: If the variance is not allowed a large healthy tree would need to be removed. This tree can not be moved or replaced. Would require the garage to be moved west 8' and will block desired views the home owner would like to maintain. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. 14040032V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
