HomeMy WebLinkAboutFindings of Fact CARMEUCLAY ADVISORY BOARD OF ZONING APPEALS FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE Docket No 14060001V Petitioner Old Town Design Group, LLC 1 The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because the Variance would allow for the replacement of a garage that was removed from the property because of its advanced state of disrepair The new garage will be smaller than the garage that was removed 2 The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because. the Variance would allow for a new three car garage that replaces an even larger garage on the property that was a hazard to the neighborhood because of its advanced state of disrepair (roof collapsing, inhabited by wild animals, filled with debris) 3 The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: there is a large storm sewer pipe on the lot that requires the garage to be detached and set back from the house If the garage were able to be attached to the house a variance would not be required as the ordinance only limits garage size when the structure is detached.
