COMMITM}ENTS CONCERN~G THE USE
AND DEVELOPMENT OF REAL ESTATE
Pittman Partners, Inc., an Indiana Corporation, its nominee or assignee (hereafter,
"Owner"), thc Owner of the real cstat¢ located in Hamilton County, Indiana, and
described in Extfibit "A" (hereafter, "Real Estate"), makes the following Commitments to
the Carmel Plan Commission (hereafter, "Commission"). ~90400o1666i~

Statement of Commitments For ~e Property Described '.re. Exhibits A;,
A. Thc Owner will install and professionally landscape and maintain a mound 3
to 5 feet in height in the common area east of and adjacent to and north of and
adjacent to 4524 W. 13 l"t Strcct. Exact location and details of mounding and
landscaping of these common areas will be shown on the final landscape plan
approved by thc Department of Community Services.
B. The Owner will either repair or replace, where necessary, thc existing woven
wire farm fencing that separates the Real Estate from properties identified as
13232 West Road, 13280 West Road and 13326 West Road
C. The Owner will install and professionally landscape and maintain a mound
with a minimum average 'height of 3' in the common area adjacent to 13232
West Road in the common area between West Road and lot #I. In addition,
. the Owner will install five Norway Spruce or Blue Spruce tr¢cs that are a
minimum of 15' in heist.
D. The Owner will install three 8'-10' Blue Spruce or Norway Spruce per lot in
the rear building setback area on lot numbers 9, 10, 11, 12, 13 and 14.
Binding on Successors and Assiens_: These Commitments are binding on the
Owner of the Real Estate, each subsequent Owner of the Real Estate, and each
other person acquiring an interest in the Real Estate, unless modified or
tonninat~ by th~ Commission. These Commitmonts may be modified or
terminated fi'om time to time only by a decision of the Commission made af~
notice and a public hearing as provided by thc rules of thc Commsssion.
Effective Date: The Commitments contained herein shall be effective upon thc
final aP~val ~f thc Primary Plat for thc Real Estate by the Carmel/Clay Plan
Commission.

Recording: The undersigned hereby authorizes the Secretary of the Commission
to r~~ these commitments in the Office of the Reeordcr of the Hamilton
CotmVy, ~diana, following the Effective Date.
Enforcement.'. These Commitmcnts are enforccablc by the Commission and the
City of Carmel, Indiana.
