Dear Jon:
First, thank you for your prompt response of June 25, 2001, regarding Worldwide Motors. With
respect to signage, I acknowledge on behalf of Worldwide Motors that signage was not a part of the Special
Use Approval, and as of this date, no signs are approved. If at a later date signage is desired then an
amendment to the Special Use,Approval will be required. Should they exceed the size and number permitted
under the sign ordinance, a variance would also be required. Again, thank you for your help and assistance

Dear Mr. Neal:
Sections 14.4.3: Minimum Side Yard and 14.4.4: Minimum Aggregate of Side Yard read:
14.4.3 Minimum side yard:
residential uses — ten (10) feet;
any business use located in a block or parcel which includes or adjoins a
residential district or use or which is located on a corner lot — thirty (30)
feet;
any business use which does not meet the above qualifications - none.
14.4.4 Minimum aggregate of side yard:
residential uses — twenty (20) feet;
any business use that requires a minimum side yard of thirty (30) feet (14.4.3
above) — thirty (30) feet;
all other uses - none.
I have bolded the subsections that apply to Block Al. As you can see, a minimum side yard of
thirty (30) feet is required on any block or parcel that adjoins a residential district or use, as Block Al
does to both the north and east. However, Section 14.4.4 indicates that the same standard (thirty (30)
feet) applies to the aggregate, meaning that so long as the minimum 30 -foot setback is met on the side
adjoining the residential district or use, a zero -foot setback can be applied to a side yard that does not.
Therefore, the Indiana Basketball Academy building located on Block Al does not violate any B-
3/business district setback requirement by virtue of its being located less than thirty feet off the west lot

Members of the Carmel Clay Plan Commission
C & G Realty, Inc., (World Wide Motors) has agreed to purchase from Indiana Basketball
Academy, a part (1.54 acres) of the 3.46 acre parcel of real estate owned by it and located in Bauer
Commercial Park with a common address of 3800 Bauer Drive West, Indianapolis, Indiana. On
November 21, 2000, World Wide Motors will present to the Plan Commission its request for its
Primary Plat Amendment permitting the division of the real estate into two lots to be known as
"Block A -1" and "Block A -2 ". World Wide Motors contemplates using the real estate to construct
a building 7,500 square feet in size to be used in connection with its Mercedes -Benz dealership
pursuant to the plans on file with the Department of Community Services. Enclosed for your review
is information detailing this request. 1 look forward to seeing you on the 21" of November, 2000 and

As a follow -up to the TAC meeting on the above- entitled matter, please find enclosed a
revised drawing of Primary Plat Amendment showing the entirety of Block A and its division into
two parcels: Block A- I and Block A -2. Also please find enclosed the secondary plat for the division
of Block A. By way of a copy of this letter to Scott Brewer, I am also providing him with a copy of
the revised drawing which, at his request, includes identification of the existing treeline along the
north property line and a footnote that construction fencing will be installed prior to development
along such treeline: In addition, a note has been added providing for four street trees parallel and
adjacent to Bauer Drive West. Based upon these amendments, I have caused notice to be published
and mailed providing for a November 21, 2000 public hearing before the Carmel Plan Commission
on the Primary Plat Amend Application and a November 27, 2000 public hearing before the Board
