• The Park Board requests that the City review the impact fee to determine if it should be changed
• Park Board passed Resolution 10-14-03-02 attached as Exhibit A.
• DOCS prepares a Council Resolution similar to Resolution CC-04-17-00-02 (requests DOCS to take
all necessary steps to review the impact fee)attached as Exhibit B for Mark Westermeier to present at
the 3-9-04 meeting of the Council's Park,Recreation and Arts Committee and to request that Rick
Sharpe sponsor such at the 4-19-04 Council meeting;
• Parks works with DOCS on the current analysis and prepares the amended zone improvement plan;
• 3-26-04: 9:00 a.m.meeting in DOCS conference room to coordinate data and finalize analysis for
future presentations;
• 4-12-04: Mark Westermeier to present current analysis to Park,Recreation and Arts Committee;
• 4-19-04: Council passes Resolution
• The Mayor appoints an Impact Fee Advisory Committee(IFAC),having from 5 to 10 members,with
at least 40%of the members representing the development,building,or real estate industries. (The
Mayor may designate an already established body, such as a committee of the Plan Commission,to
serve as the Advisory Committee if it meets the membership requirements.) The Advisory
Commission is to provide advice and assistance to the community but is not required to take a formal
vote on the proposal.

• Jerry Chomanczuk(manages Conseco's property portfolio)
• Mark Ratterman(Council appointment and real estate appraiser)
• Diana Knoll
• Rick Ripma
• Leo Derkman
• DOCS prepares ordinance amendment;
• 4-20-04: IFAC meets at at which DOCS and Mark Westermeier presents;
• DOCS notices a public hearing on the amended ordinance;
• 5-18-04: The Plan Commission holds a public hearing on the proposed amended ordinance and
thereafter certifies its approval on the amended ordinance to the Council for its 6-7-04 meeting;
• The Commission may certify the proposed amendment to the Common Council,but only if it
receives a favorable recommendation from a majority of all the members of the Commission.
• 6-7-04: Council considers the Commission's recommendation(First Reading and sent to committee).
• (At its first regular meeting after receiving the certified proposal from the Commission,the
Council must either(1)adopt,reject,or amend the proposal,or(2)defer action and schedule a
public hearing and further action on the proposal within a 90-day period after the Commission's
initial certification. The Council is mandated to take a vote on the proposal within the 90-day
period.)

• If the Council adopts the proposed ordinance as it came from the Commission,it becomes an
ordinance as any other ordinance of the community. In Carmel,as of the present date,an impact
fee ordinance is not subject to the Mayor's veto.
• If the Council fails to act within the 90-day period(despite the mandate to take a vote),the
ordinance is deemed to have been adopted on the 90th day.
• If the Council rejects or amends the proposal,the Council is required to return the proposal to the
Commission along with a written statement of the reasons for its rejection or amendment.
• Within 45 days after receiving the proposal back from the Council,the Commission must
reconsider the amended ordinance and file a written report with the Council.
• If the proposed ordinance is amended by the Council,the Commission's report may simply
accept the amendment, in which case the ordinance is effective as of the date of the
Commission's report. If the Commission fails to act,such failure is deemed to be acceptance of
the amendment on the 45th day.
• If the proposal is amended by the Council but the Commission disapproves of the amendment,
the Council may still pass the amended ordinance over the Commission's objection. The Council
must,within 45 days after receiving the Commission's report,pass the ordinance a second time
(with its amendment)after considering the Commission's report.
• If the Council fails to confirm its amendment by passing the ordinance a second time,the
proposed ordinance is deemed to have been adopted(on the 45th day)as originally certified by
the Commission.
e 6-7-04: Park,Recreaiton and Arts Committee considers the Amended Ordinance;
• 6-21-04: Council hears second reading of the Amended ordinance and.votes.
• 12-21-04: Amended Ordinance earliest effective date.
• The amended ordinance takes effect on the effective date specified in the ordinance,but not
earlier than 6 months after the date on which it is adopted by the Council.
