RE. VV Amendment to Thoroughfare Plan-Proposed Illinois Street Corridor Alignment
Attached with this memo is a copy of the Draft Technical Memorandum for the Illinois Street
Corridor Alignment, which has been noticed for Public Hearing at Tuesday's regular Plan
Commission meeting.
The U.S. 31 Overlay Zone Task Force has been working with John Myers and Kimberly Lutz
from the firm of Parsons Brinkerhoff to fine tune the alignment for Illinois Street within the
context of our overall study of the U.S. 31 Corridor.
The format for this report is simple and user friendly. The use of aerial photography provides
good context to assist in your review of this proposal.
John Myers will be present at the meeting to present an overview of the study, and answer any
questions, which arise.
Please note that the proposed alignment found on page 15 of the report will be more clearly
defined, and a new page provided to you at Tuesday's hearing.

To Whom It May Concern:
This letter is to advise the Cannel Plan Commission that the Indiana Department of
Transportation ("INDOT") has met with Duke-Weeks Realty Corporation relating to Duke's
desire to rezone and develop property that is located between Spring Mill Road and Meridian
Street, south of I-465 and north of 96`b Street, in Hamilton County, Indiana (the "Development
Property"). INDOT has determined that approximately 7'/z acres of property (the "Expansion
Area") within the Development Property will be needed for the programmed expansion of the
interchange at U.S. 31 and.I-465. The attached drawing marked Exhibi.t A depicts the Expansion
Area as it relates to the Development Property. Duke has advised INDOT that Duke's proposed
development will be outside of the Expansion Area, thus leaving sufficient property for INDOT
to complete the programmed interchange expansion. Therefore, INDOT does not believe that
the rezoning of all of the Development Property (including the Expansion Area) will binder
INDOT's future plans in the area so long as the actual development occurs outside the Expansion
Area.

RE: Proposed Thoroughfare Plan Modifications

Dear Commission Members:
As you are aware, your currently proposed modification to the Thoroughfare Plan, reserving
Right-of-Way for a potential interchange at US 31 and 131st St. has significant impacts upon
some of the adjoining properties. As the owners of the southwest quadrant of that
intersection, we are seriously concerned about the negative impacts that we believe that the
proposal will have. Attached, for your review, is a plan that we prepared which overlays the
currently proposed interchange plan with our current development plan. The interchange
plan, as currently proposed impacts both of the two remaining buildings as it takes
approximately 4.5 acres from the site. Building No. 5, for which we have ADLS Approval,
have spent in excess of $100,000 in the preparation of construction documents, and intend
to commence construction in the spring of next year, is effectively eliminated.
While we understand the City's desire to appropriately protect necessary public areas, the
reservation of this Right-of-Way is a taking as surely as if the buildings existed today. We
have numerous questions that are unanswered at this point, including; (1) How much land
might actually be acquired, and what would be it's final configuration? (2) How would we be
reimbursed for the developed value of the property? (3) What would be the time frame of a
proposed acquisition? — Without answers to the above, we are not able to evaluate our
resultant economic position, nor can we determine an appropriate
development/redevelopment strategy.
As a result, we ask that this item be continued at this evening's Commission Meeting, and
remain continued until these issues can be resolved and analyzed. We would hope to be
extended the courtesy of a personal contact to explain what the City of Carmel is prepared to
do given our intent to begin construction of Building No. 5. We appreciate your consideration
of this matter.
