15 and 16. 1 would: recommend that a straight non - segmented lot lion be considered. A
single lot line, would be easier to establish and be maintained by future lot owners.

Our office has reviewed the Replat application filed for Brooks Landing at Prairie View,
Section 1, Lots 15 & 16. The following are comments that need to be addressed and plans updated
accordingly:
Application:
• The filing fee for the Replat is $400.00.
Secondary Plat:
• Please label the lots "15a" and "16a."
• The monuments and markers indicated on the plat do not meet the standards set by the
Carmel/Clay Subdivision Control Ordinance. Please refer to Section 8.2 for guidance.
Materials and dimensions of all required markers and monuments should be included in the
Legend. If corner markers were not set with this Section of Brooks Landing, they should be
set for these two lots at this time.
• The Source of Title has not been included on the replat.
• Telephone numbers for Owners, Subdividers, and Surveyors are required to appear on the
plat.
Procedure:
• Please prepare a Certified mailing to all property owners within Brooks Landing at Prairie
View, Section 1, and any Interested Parties as defined in the Plan Commission's Rules of

"Lowe Gray Steele & Darko, LLP represents Buce Zeller, a custom homevuilder, who built a spec home on a lot
in Section 1 of Brooks Landing at Prairie View. The home was located and constructed on the lot pursuant to a
building permit. Subsequent to the completion of the home, it was discovered that a portion of the home was located
and constructed approximately five and one -half (51/2) feet from its southern boundary line, which comprises one of
the side yards of the lot. The required side yard for the lot is ten feet as required by the Carmel /Clay zoning
ordinances.
In order for the home to conform to the applicable carmel /Clay zoning ordinances, one of two actions needs to be
effected. The first involves obtaining a varinace of the 10 -foot side yard requirement through the zoning process.
This is not ideal because of serious time constraints and the potential loss of a buyer for the home.
The other and better alternative for all concerned involves obtaining a small sliver of ground from the adjoining
lot ownere (approx. 148 sqft) and reestablishing the side yard of our client's lot. In doing so, the plat of each of these
lots should be revised solely to establish the lots as reconfigured by the conveyance of the sliver of ground. No other
changes would be required. The revised plats for these lots would be prepared by Weihe Engineers in cooperation
with our client and the ownere of the adjoining lot.
Given the minor nature of the change to the common boundary line between the two lots, we felt that an
administrative approvla of the revised plats would not be unusual under the circumstances. However, we need to
first confirm that an administrative approval of the plats is available. If available, we would then by able to have
revised plats prepared and presentd for approval much sooner compared to the time involved in completing the
variance process. This would then provide our client the ability to market the home without the concrn as to whether
a variance would be granted and without the tiem issues involved in the zoing process. "
