MEETING MINUTES
Date: Wednesday, July 16, 2014
Place: Dept. of Community Services Conference Room, 3rd Floor, Carmel City Hall.

9:10 a.m. Docket No. 14060012 SP: The Retreat of West Clay, Secondary Plat only.
The applicant seeks secondary plat approval to create 32 lots on 23.5 acres. (The construction plans will be
submitted later, under a separate application.) The site is located northeast of 141st St. and Little Eagle Creek
Ave., at approximately 14291 Little Eagle Creek Ave. It is zoned S-1/Residence, ROSO III. Filed by Ashley
Bedell of Pulte Homes of Indiana, LLC.
Ashley Bedell with Pulte Homes and Dennis Olmstead with Stoeppelwerth & Associates presented the project.
Ms. Bedell said the Retreat at West Clay actually came in with the primary plat several years ago, so this is
bringing the project back through and making a few minor modifications, such as aligning and changing name of
the street currently called “Haven Way”. This will be lined up more closely with the development to the north,
adjusted with the right-of-way along Eagle Creek, and adjusting the right-of-way along the streets. Ms. Bedell
said the overall goal would be to make the street layout of the subdivision a little more consistent.

- The secondary plat looks good now, although there may need to be minor changes when the department
receives construction plans.

9:20 a.m. Docket No. 14060013 SP: Nathaniel Creek, Secondary Plat.
The applicant seeks administrative secondary plat & construction plans approvals for 2 lots on 5 acres. The site is
located at 14050 West Rd. It is zoned S-1/Residence. Filed by Ben Deichmann of SJCA Surveyors & Engineers,
on behalf of Jay Gaddy, landowner.
Landowner Jay Gaddy and Ben Deichmann of SJCA presented the project. Mr. Deichmann said this location is
currently a 5-acre parcel that the owner is looking to subdivide into 2 single family residences. Mr. Deichmann
said the developer has submitted secondary plat construction documents for infrastructure to support this project.

9:30 a.m. Docket No. 14060014 SP: Ashmoor, Secondary Plat.
The applicant seeks administrative secondary plat & construction plans approvals for 52 lots on 39.19 acres. The
site is located at the southwest corner of 131st St. and Shelborne Rd., at approximately 13000 Shelborne Rd. It is
zoned Ashmoor PUD/Planned Unit Development (Ordinance Z-585-14). Filed by Keith Lash of Ryland Homes
of Indiana, LP.
Eric Gleissner with Civil Site Group and Wes Livingston with Ryland Homes presented the project. This project
is a 52-lot subdivision located at the southwest corner of 131st St. and Shelborne. Mr. Gleissner said this project
was originally 59 lots but lost seven lots during the zoning process. Another change is the entrance from
Shelborne Rd. that was not previously there.

- Ms. Hunter said several poles will need to be moved, but she is not sure where the final location will be. Mr.
Gleissner said he believes the plan on 131st Street will be to shift the asphalt path away from the right-of-way
1-3 feet. On Shelborne, the plan is for these to be located outside the right-of-way. Ms. Hunter asked the
petitioners to submit to Duke the home information, such as square footage, date of construction, and when
the builder will need power. Ms. Hunter said there is an issue of many electrical poles located next to trees,
and this is a problem.

- This project is being reviewed by Crossroads Engineers and a letter was sent on July 14. Mr. Gleissner said
regarding the bypass lane on Shelborne Road, the developers do not own the right-of-way and the neighbors
have not been cooperative in finding a solution. Mr. Jordan said the developers will need to contact Gary
Duncan to set up a meeting to discuss this.

- Mr. Mindham said regarding the trees being shown on the plans next to electrical poles, it may just be a
matter of substituting shade tree height for ornamental heights off the approved trees list.

- Mr. Littlejohn said if the path is located out of the right-of-way, that it be located in some sort of pedestrian
access easement. Mr. Gleissner said the car wash that was just completed at 98th & Michigan had the same

issue, with no way to get drainage in along with the sidewalk, so the sidewalk was placed on the property.

9:40 a.m. Docket No. 14060015 SP: Deer Run, Secondary Plat.
The applicant seeks administrative secondary plat & construction plans approvals for 18 lots on 8.25 acres. The
site is located at 10425 Westfield Blvd. and extends through to106th St. It is zoned S-2/ Residence. Filed by Ben
Deichmann of SJCA P.C., on behalf of Deer Run, LLC.
Ben Deichmann with SJCA P.C. presented the project, which is approximately 8.25 acres at the southwest corner
of 106th & Westfield Blvd. Mr. Deichmann said there are currently three existing residences on site, and one of
those three residences will remain. The other two residences will be demolished, and 17 new homes will be built.

9:50 a.m. Docket No. 14060016 DP/ADLS: Kingdom Hall, College Park Congregation of Jehovah’s Witnesses. The
applicant seeks site plan and design approval for a place of worship. The site is located at 10439 Commerce
Drive, at Retail Pkwy., and is zoned B-5/Business. Filed by David Shelton of DeFur Voran, LLP, on behalf of
College Park Congregation of Jehovah’s Witnesses.
David Shelton with the College Park congregation of Jehovah’s Witnesses, architect Steve Shaw, and engineer
Mike Carson presented the project. Mr. Shelton said this project is a little over 10,000 square feet, and Mr.
Carson added that the building will seat 441. Mr. Carson said this is actually two places of worship built nose to
nose, with the center core providing restroom facilities and other amenities that will be used by both buildings.
Mr. Carson said this facility will not have food preparation facilities on site, and added that there will be a break
room with microwave, but no food preparation will be done. Mr. Shelton said the construction is similar to a
residential style, but it will be built to specifications to withstand inclement weather, such as tornadoes.
Mr. Shelton said one of the remaining issues still outstanding is the issue of connectivity between this property
and the property immediately to the north. The developers are proposing a temporary or emergency gate that will
either be magnetic, or locked and able to be opened by the fire department. Mr. Shelton said religious uses such
as this are off-peak by nature, while office buildings are used during peak times. For this reason, the developers
are proposing an emergency exit only. In trying to come up with a plan that everyone can support, the developers
are proposing the sidewalk shown on the plans, as a way to increase pedestrian connectivity.

- Plan review comments were provided to the petitioners, but will be emailed soon. Mr. Hoyes said the
project will require an outlet permit, and also requested that the mound around the lake remain relatively flat,
because that is the Surveyor’s Office’s access easement. Mr. Hoyes said on the Cool Creek master drainage
plan, this drainage was supposed to go to the south lake, so this may need to be reversed to go to the south
lake instead of the north lake. Mr. Carson asked about the previous comment that the mound around the lake
needs to remain relatively flat. Mr. Hoyes said trucks can be driven on a 5-to-1 slope and this appears to be
close to the limit.

- Mr. Mishler said when the project reaches the point that it is ready for permitting, the builders can meet with
building inspectors to review the inspection procedures. Mr. Shelton said the builders are proposing an
insulated concrete wall system for added strength.

10:00 a.m. Docket No. 14060017 Z: Grannan Grove PUD Rezone with Primary Plat.
The applicant seeks approval to rezone 9.774 acres from S-1/Residence to PUD/Planned Unit Development. The
applicant also seeks primary plat approval for 14 lots with Common Area, as part of that PUD Ordinance. The
site is located at 3739 W. 141st St. Filed by Jim Shinaver of Nelson & Frankenberger, on behalf of Grannan
Grove Development, LLC.
Jim Shinaver with Nelson & Frankenberger and Dennis Olmstead with Stoeppelwerth & Associates presented the
project. Mr. Shinaver said this project is approximately 9.7 acres, and sits on the south side of 141st Street west
of Shelborne Road. Mr. Shinaver said the developer is seeking a rezone to a PUD zoning.

- Letter sent. Mr. Hoyes said there are no concerns on the primary plat, but there will need to be a discussion
on the outlet plan because there have been lots of complaints. Mr. Olmstead said there have been discussions
with the person who owns that property that would need to be encroached upon for the outlet permit, and he is
open to allowing the developers to go through this area as long as it is cleaned up afterwards. Mr. Hoyes said
luckily the developers are dealing with only one property owner instead of the entire subdivision, because that
is where the issues would come up.

- Ms. Hunter said she is not sure if this is Duke’s territory because it is right on the border with IP&L. Mr.
Olmstead said this property lines up directly with Overbrook Farms. Ms. Hunter said if that’s the case, she
must have had this confused with another development, and it would in fact be Duke’s territory.
