Dear Mr. Clark:
Pursuant to Section 21.2.7 the Board of Zoning Appeals approval of Docket No. SU- 198 -00
expired Tuesday, January 22, 2002. However, if a written request for extension is made promptly,
the Director may consider approving a six -month extension of this approval to Monday, July 22,
2002.
Pursuant to Section 30.5.5 the approvals of Docket Nos. V- 199 -00, V- 200 -00, V- 201 -00,
V- 202 -00, V- 203 -00, V- 204 -00, and V- 205 -00 will expire Tuesday, March 26, 2002. This letter
serves to inform you that you may still make a written request for a six -month extension of these
approvals to Thursday, September 26, 2002.
Such extensions are non - renewable. If extensions are granted and continuous construction
has not commenced by Monday, July 22, 2002, these Items will have to return to the Board of
Zoning Appeals for re- approval.

The Note regarding the bufferyards makes an incorrect citation. The bufferyards are not required
per Section 23B.10.2, as this property is not located in the US 31/Meridian Street Overlay Zone.
The bufferyards are required per Section 14.6 of the Zoning Ordinance. The note is not required
for approval, and may be either corrected or deleted.
Please submit a copy of the Covenants & Restriction for Hazel Dell Corner Subdivision for
inclusion in the file.
• The property owner's signature must appear on all mylars produced for signature by the
Department. The Board of Public Works will not consider unsigned plats.
Once these changes have been made and comments addressed, please produce a mylar copy for signature
by this Department. Two paper copies of the plat must be filed with the mylar prior to recording, and
three paper copies and a mylar of the recorded plat must be submitted following recording.

Please correct the west side yard (Building Line) to 30 feet in width.

RE: Proposed OSCO at 131st and Hazel Dell Pkwy.: ADLS 181 -00
After meeting with Mr. Laurence Lillig and other staff of the Department of Community
Services, it was suggested that I provide this letter to discuss landscaping changes to the
proposed ADLS application. My comments for the changes are as follows:
1. On the landscape plans, the note titled "Existing Landscaping" that refers to
the removal, storage, care and replacement of the street trees already installed
within the right -of -way needs to have the final word "OWNER" replaced by
"CITY OF CARMEL OR PREVIOUS INSTALLATION CONTRACTOR."
2. If the required greenbelt is to be reduced to 20 feet in width, several changes
shall take place in the proposed landscaping within this area. These include
two of the Oak trees and one of the River Birch need to be removed from this
area and planted in the area on the corner where there are no trees . on the plan.
Care needs to be taken to keep the plantings out of the required line of sight
for vision clearance for the round about. The curve of the drainage swale
needs to be reduced near the ends. The bayberry plantings should be reduced
along the swale on 126th Street by 15 %.
3. Buffering landscaping that is planned to screen the loading dock from view of
neighboring residences on the west side of the access road should match
evergreen and shrub species already used on site as much as possible.
Douglas Fir and Norway Spruce are good choices for plant material to screen
views. Judd Viburnum, Dwarf Fountain Grass, and Spirea are also good low
maintenance shrubs to fill in gaps. The screening plant shall be shown on the
landscape plans and shall extend fifteen (15) feet to the north and to the south
of the access drive behind the Osco building.

Dear Commissioners:
In anticipation of the Commission's consideration of the above- referenced ADLS petition on its
Old Business calender on March 20th, I am forwarding you this material which has been compiled
and revised per the Conditions of Approval discussed and specified by the Special Study Committee
on March 6th. It is the goal of the Petitioner, my client, to construct for operation on Lot 1 of Hazel
Dell Corner (the lot comprising generally the Northwest quadrant of the 1315` Street and Hazel Dell
Roundabout) an Osco Drug Store. The property is zoned B -3/ business and the proposed Osco Drug
Store is permitted as a Special Use. Our Special Use request has already been granted.by the BZA.
The requirement for ADLS approval from the Commission stems from developer's Commitments
made in 1995 when this property, and the adjacent lots, were rezoned to the B -3 Business District
Classification.
You will note on the Department Report forwarded you for the Commission's March 20 meeting
that said Conditions of Approval were as follows:
"1. conventional brick to replace brick inlay
2. no ground sign adjacent to roundabout
3. off -site landscaping to screen loading area from west
4. rooftop h'VAC not to be visible
5. store not to be open 24 hours
6.. lights to dim after hours
7. no illumination of cupola
8. controlled lighting intensity
9. no outdoor storage."
We are able to accommodate these conditions with the exception of the third condition dealing
with off -site landscaping. We sought assistance from the off -site property owner but were unable
to obtain an enforceable commitment to allow us to utilize said property. We have however
attempted to bolster our landscaping in the north buffer area to address this concern:. As you May
recall, these commitments are iri addition to the ones we have already made in response to
recommendations made by the Staff including additional landscaping and landscape lighting;
repositioning the trash enclosure; addition to the structure of dormers; modifying the window
treatment (faux windows) and others.

We have attempted over the course of the last many months to address all architectural and design
issues. I hope you will agree after review of our amended plans that this use, and our specific design
and architectural proposals, are appropriate and that the subject ADLS petition should be approved.

Our original comment letter. dated December 18. 2000. was written at a time \\hen this office clicl not know
who was going to develop the site infrastructure. Nov that it has been determined that Plum Creek
Partners. LLC will be responsible for the site development. \yc offer these comments based upon the most
recent set of plans submitted for this project \yhich \sere received by this office on March 7. 2001. These
continents are based upon comparison of the plans for Lot n 1 with the master plan for 1-lai.cl Dell Corner.
\Vhich were received on February. 28. 2001.
PERFORMANCE GUARANTEE; REQUIREMENTS
I. The only Performance Guarantee requirements for this project will be for Monuments. Please provide
a Certified Engineer's Estimate of the cost of labor and materials for the installation of required
monuments for the project.

2. Since Plum Crock Partners will be obtaining Board approval for the Commercial Cnrb Cuts for Hazel
Dell Corner development. the following Board approval requirements renrain:
• Secondary Plat approval. Required I'crform:ince Guarantees must be posted prior to Board.

• Consent to Encroach Agreements. It appears there are several easement encroachments on the
plans. If there arc plans to irrigate this project and any portion of the system encroaches upon an
casement. an agreement will be required. Right of way encroachments require Board approval.
Water' and Sai itary Seaver Availability approval. Based upon the drawing and the Lacs that this
is a retail establishment. the tables from our utility ordinance are used for the following
calculations:
15.251 square foot retail building 1.0 EDUs per 1.000 square feet = 15.251 EDUs
Water Connection Fee = 15.251 EDUs $ 1.310.00 per EDU = $ 19.979.00
Sanitary Sayer Connection Fcc = 15.251 EDUs $ 795.0(1 per EDU = $ 12.125.00
Total Connection Fees = 15.251 EDUs $2.105.00 per EDU = $32.104.00

CERTIFIED CONSTRUCTION DRAWINGS
9. This Department will require live -sets of certified construction drawings when all agreed revisions
(including Carmel Utilities) have been incorporated into the drawings. The drawings \\ill be stamped
as approved and signed by the City Engineer and by the Director of Cannel Utilities. Onc approved
set will be returned to the Developer and must be maintained on the construction site at all limes. Two
approved sets are retained by Carmel Utilities. One approved set is given to our Public Works
Inspector While the final approved set is maintained in the Department of Engineering.
SEWER PERMIT REQUIREMENTS
10. All water mains, sanitary sewers ancl storm sewers muss be installed with acceptable test results
obtained prior to this office approving the issuance of a sewer permit. In addition. the commercial
curb cuts and asphalt paths must be complete. We Will not approve a temporary construction entrance
other than the entrance approved on the West Side of Lot #2 on 131' Street. The sewer permit, a
recorded secondary plat. five -sets of certified construction drawings and payment of Water and
Sanitary Sewer Connection Fees are requirements to initiate the pre - submittal meeting with Permit
Services. The pre - submittal meeting is the commencement of the process required to obtain a Building
Permit. All Engineering Department requirements must be satisfied before Permit Services will
schedule the pre - submittal meeting.
All constriction that involves existing landscaping associated With Hazel Dell Parkway and 131" Street
must be coordinated with the City of Cannel Urban Forester. No trees are to be removed without prior
approval from the City.

I have spoken with others in the Department regarding the right -of -way on 131S1 Street.
Although it was not raised as an issue during the initial phases of the Hazel Dell Corner
development, the ADLS as submitted is inconsistent with the Thoroughfare Plan. We
continue to recommend that the Thoroughfare Plan, which calls for a 50' half right -of-
way, is followed.

Signage Criteria
1. Artwork is to be approved by the Landlord prior to fabrication and installation.
2. All lettering must be individual letters internally illuminated.
3. All letters must be surfaced mounted, no raceways allowed.
4. All letters must have 5" returns (dark bronze) and 1" trim caps (dark bronze).
5. All signage must be in accordance with UL Rules and Regulations per below.
6. Sign height should not exceed 36" and must be in accordance with the Town of
Carmel specifications. Special considerations have been made to allow the average
of sign area based on 101' - 300' from 106th Street, which allows 40 SF to 105 SF of
the maximum sign area based on store frontage.
7. Logos shall not exceed 25% of the sign area and will be approved at the discretion of
the Landlord.
8. Sign colors will be chosen from the attached West Carmel Tenant Color
Specifications list.
9. Sign brightness will be determined by the chart below.
The sign wiring must be in accordance with Underwriters Laboratory Rules &
Regulations and shall carry UL authorized labels on the sign letters visible from the
ground. All sign letters shall employ the use of PK housings with metal connectors and
flexible metallic tubing or electrical metallic tubing encasing the high tension cable.
The high tension cable will be the type that uses a Silicon insulator that will meet or
exceed the voltage requirements of the sign. The high tension cable will contain no
splices, except where absolutely necessary. If a splice is required, only "Faskonek"
manufactured by Signeon Corp. will be accepted.
All transformers must be concealed in metal transformer boxes. In addition to
the metal conduit and metal connectors, each individual letter is to be grounded
separately to a common grounding block using twelve gauge copper wiring. The
additional grounding will be achieved by running a stove bolt through each letter with
the wire attached to the stove bolt with proper fasteners on the back side of the sign. It
is imperative that all letters and transformer boxes be mechanically grounded in this
manner. No plastic cables or connects will be permitted. The installer will supply the
grounding block.
The Landlord reserves the right to inspect the sign wiring. The Tenant shall
make connections at its expense to make the sign comply with any of the above
specifications. Landlord is to receive forth -eight (48) hours prior notice to the
installation of the sign.

Dear Dick,
Please find attached, revised civil construction plans for the above- referenced project located at
1315L Street and Hazel Dell Parkway. I have waited until the revised overall plans for this
development were re- submitted to your office before resubmitting this project. Hopefully that
will clear up some of the confusion you experienced in your review of the prior submittal. As
you are aware, Plum Creek Partners is responsible for the infrastructure improvements for this
development. Therefore, the scope of work for the Osco site will be limited to the area within
the access drives to the west and north and the public right -of -way to the south and east.
Review comments were received from the following TAC agencies and the drawings have been
revised accordingly.
Panhandle Eastern Pipeline Company — has no company facilities involved in this project.
Clay Township Regional Waste District — does not serve the project area.
Hamilton County Highway Department — states that the project lies within the City of Carmel
limits.
Hamilton County Health Department - does not have any comments regarding sewer and water
as the site is served by sanitary sewer and public water. They do advise that the facility will
require an operating permit as a retail food vendor prior to opening. NOTE: All food sold on the
premises will be pre - packaged. No food preparation will take place on the premises.
Hamilton County Sheriffs Department — finds no public safety issues that would affect services.
They also note that public safety services will be provided by Carmel.
Hamilton County Soil & Water Conservation District — requests that information regarding the
sequence of erosion and sediment control measures and perimeter sediment control measures be
added to the plans. This information has been added to the plans, but may be more applicable to
the overall plans for the development.

Carmel Police Department — sees nothing in the plans that would hamper law enforcement
efforts.
Carmel Fire Department — requests that a fire department connection be shown on the plans. A
remote fire department connection has been added in the landscape area north of the building. In
addition, the department has requested that a Knox Box be installed on the building. A Knox
Box will be located to the right of the receiving area doors at the rear of the building.
City of Carmel, Urban Forester — requested several modifications to the planting notes on the
Landscape Plan. These modifications have been made. In addition it was requested that a note
be added regarding removal/replacement of existing plantings in the public right -of -way. This
note has been added.
City of Carmel Wastewater -Water Utilities — requested several modifications to the layouts and
details of the water and sewer systems proposed to serve this site. Again, these modifications are
more applicable to the overall plans than to the Osco plans and therefore have been made on
those plans.
For your reference, I have included copies of the review comments from all of the above -
referenced agencies. I have also included a copy of the rational method calculations for the on-
site storm sewer design.

In anticipation of the Commission's consideration of the above - referenced ADLS petition on
February 20th, I thought it would be helpful to provide you with a little background on this case and
some recent information with regard thereto.
It is the goal of the Petitioner, my client, to construct for operation on Lot 1 of Hazel Dell Corner
(the lot comprising generally the Northwest quadrant of the 131" Street and Hazel Dell Roundabout)
an Osco Drug Store. The property is zoned B -3/ business which is a permitted as a Special Use. Our
Special Use request has already been granted by the BZA. The requirement for ADLS approval from
the Commission stems from developer's Commitments made in 1995 when this property, and the
adjacent lots, were rezoned to the B -3 Business District Classification.
This proposed project has already come under significant scrutiny within the regulatory process.
We have appeared twice before the Technical Advisory Committee (November 15 and December
20, 2000), with no additional TAC meetings scheduled. As set forth, our Special Use petition was
approved at the January 17 BZA hearing. There remain development standards variance requests,
primarily concerning signage, pending before the BZA, which have been tabled until resolution of
the ADLS petition. Regarding our sign issues, staff has taken the position in recent drug store cases
(i..e Walgreens, 106th & Michigan Road, approved last month by the Commission) with respect to
signage that only two wall signs and one pharmacy drive -thru sign, consistent in size with the square
footages set forth in the non - freeway sign chart issued by the City, should be permitted provided that
there would be the option to substitute one wall sign for a monument or ground sign. We concur and
agree with Staff's position with respect to signs and would commit to so limit the Osco signs
proposed for this site.

Furthermore, we have had a productive dialogue with the staff as to what design issues really
remain here. In this vein, attached you will find a letter from Laurence Lillig setting forth what he
and we believe are the remaining design issues. We are in substantial agreement with the additional
design modifications recommended in Mr. Lillig's attached letter and will commit appropriately to
amend our plans consistent with the Commission's ultimate decision. Unfortunately we have not
had time to modify our plans to include the amended plans in your packet of information. We fully
intend to present to you at the February 20 hearing amended renderings and elevations to detail how
exactly we propose to address Mr. Lillig's concerns as he expressed in the attached letter.
It is our intention to construct on this site one of the finest and most attractive drug stores in the
Osco family of stores. We have attempted over the course of the last many months to address all
architectural and design issues. I hope you will agree after review of our plans that this use, and our
specific design and architectural proposals, are exactly what the Commission had in mind when it
rezoned this Hazel Dell property to B -3 in 1995. Given the time constraints for development of this
site and the infrastructure for this and other contiguous business sites, I hope you will consider oo
February 20th a final vote on this project.

design of the Osco Drug to be built on Lot 1 of the Hazel Dell Corner Subdivision. The
Department makes the following suggestions:
• That on all sides the facade area currently proposed to be clad in brick inlaid precast
concrete panels instead use brick.
• That two dormers be added on the west where indicated on the attached exhibit.
• That a faux window treatment (consistent with the window style shown at the entrance) be
carried across the south and east arched wall surfaces currently specified as thorocoat finish.
• That the steel door located near midpoint of the east facade be of a residential character
rather than painted to match the brick.

Thank you for your phone conversation on Tuesday. This letter is intended to memorialize the
pertinent parts of our conversation, particularly with respect to the procedural elements of the above-
referenced land use matters.
As you know, we are scheduled to appear before the Board of Zoning Appeals ( "BZA ") on
January 8' relative to the pending Special Use and Variance petitions. These matters are listed on
the agenda I received in the mail on Tuesday as "Tabled Pending Resolution of ADLS Petition ". I
discovered this when I delivered our Presentation Packages to Sue Ellen on Friday, December 29`n
It is my understanding that despite the fact that the Special Use and Variances are being tabled, these
Presentation Packages were sent out to BZA members along with the January Stn Agenda. In any
event, it is my further understanding that the reason these matters are being tabled is that the BZA
has made it abundantly clear it doesn't want to hear variance cases until any ADLS Petition which
accompanies the variance request has been completed.
We are scheduled to appear before the Plan Commission on January 16`n with respect to our
ADLS Petition. It is my understanding from our conversation that our ADLS Petition will at that
time be sent by the Plan Commission to a Special Study Committee in order for resolution of the

each month and therefore we should expect to attend our Special Study Committee on February 6'
at 7:OOpm and present our case. We will at that time present information, plans, elevations, sign
renderings, etc. necessary in an effort to dispositively resolve all existing architectural and sign issues.
Assuming we are able to then resolve these issues, it is my understanding that we will be placed on
the calender of the next Plan Commission meeting. namely February 20`n at 7:OOpm, for final
resolution of our ADLS Petition.
We are hopeful that we can be placed on the calender of the BZA meeting immediately following
this February 20 Plan Commission meeting which subsequent BZA meeting I believe is scheduled for
February 26`n at 7 "00pm.

As you may recall, the above referenced Special Use and Variance cases were originally
scheduled for hearing before the BZA on November 27, 2000. The required notices were sent at that
time as well as advertised in the Noblesville Ledger. I would also again like to confirm that additional
notice will not be required for these Special Use and Variance cases, nor for the ADLS Petition.
In this vein, please also advise if the files of the BZA, the Plan Commission, or your Department
relative to the above - referenced matters are lacking any information you or other appropriate
individuals feel is required or needed to expeditiously move toward final resolution of these matters.

1. Doug Floyd failed to get his packets in by mailing deadline on Friday. I gave them until 9 am on Tuesday and

2. Murray Clark was by with his packets for items on Osco. He was absolutely surprised to hear that the items
were to be tabled pending ADLS resolutions. I agreed to go ahead and mail the packets to the BZA, and have you call him
on Tuesday AM to clear up matters. He will want to know when the ADLS matters will be heard. Sue Ellen and I could not
determine that for him. He will also seek you help in allowing this matter to still be heard at the Jan 8 meeting. I explained
to him the "which came first, the chicken or the Egg" issue with these type actions. He understands the delema, but may

4. Street Cut /Right -of -Way Permit and Bonding requirements
Any work in dedicated right-of-way will require a permit and the posting of on appropriate license and
permit bond. There is no charge for the permit and the foram is available from this office. Bonding for
this project is yet to be determined. Please bc advised that all pavement cuts require a separate
approval from our Board of Public Works and Safety.
5. There remains confusion regarding the construction of infrastructure for the Hazel Dell Corners
development. Normally, the developer would be expected to construct and install Water Mains,
Sanitary Sewers, Storm Sewers, Streets, common area sidewalks acel /deccll lanes, etc. and pay the
Availability Fees for the entire project. •The individual lot developers would pay thc Connection Fccs
in order to obtain a building permit. Since this is a commercial subdivision, Certified Engineer's Cos(
'Estimates and Performance Guarantees would be required for these improvements. The \Voter Mains.
Sanitary Sewers and Storm Sewers would be required to be complete including pressure testing.
chlorination, mandrel pull, etc.. prior to individual building permits being approved. The confusion
results from previous discussions \Vhcre it Was indicated that individual developers 1yithin the overall
development \would be responsible for thc infrastructure construction, bonding. posting of Performance
Guarantees. etc. This issue needs to bc resolved as soon as possible so that this. and the remaining
lots. can be reviewed and approved in a timely manner. In this regard, I am including copies of
previous project review comments for Hazel Dell Corners and for the Children's Learning Center to
give you some idea of the issues involved in this project. Our overall comments on the Osco project
will be limited until the issues outlined above have been resolved and responsibilities determined.

These comments concern the landscape plans for the above property:
1. Installation and maintenance specifications need to be included on the final plans. The
specifications need to include, but are not limited to, nursery stock quality, substitutions, irrigation
(watering schedule for new plantings), and a maintenance plan for the first year (including removal
of any stakes and guy wires).
2. Removal of any existing Street Trees along Hazel Dell Parkway must be approved by the Urban
Forester for the City of Carmel. Any trees to be temporarily removed and stored for replanting
after construction is finished must be clearly marked on site before construction starts. A plan
shall be submitted for approval that clearly specifies those trees and the details of their digging,
maintenance, and replanting.
3. Drainage swales must be clearly marked on the landscape plans. Plant material should not be

storm water attenuation.
4. Recommended Species issues:
A. An alternative should be selected for Acer rubrum — Red Maple. It is widely overplanted and a
very weak tree subject to a variety of injuries and health problems. Alternatives could include
Shummard Oak, Shingle Oak, Ginko (male only), Black Gum, London Planetree, Norway
Maple, or Dawn Redwood.
B. An alternative should be selected for Pinus nigra — Austrian Pine. Two needle pines are
subject to a variety of stress complexes in this area (soil ph, drainage, drought, tip blight,
borers, etc.). Alternatives for evergreen screening could include White Fir, Douglas Fir, and
green Spruce species.

Could you please review the attached plan showing a 50% reduction of the 30' green belt required by
the approved site plan. Please note the large landscape area at the corner and within the parking field.
Additionally, we would be open to increasing the landscape planting requirements along these areas.
Would you generally support such a reduction, or do you believe it would probably be denied. As I
have explained, this is a critical issue for us to continue with this site. Your prompt response is greatly
