(V) Morse Pool Setback, Woods at Williams Creek,Lot 24. The applicant seeks the following development standards variance approval for a new pool: Docket No. 14050018 V ZO CH: 25.01.01.C.8.a.iii: 3 ft Min Pool Setback from Easement,pool deck requested in easement. The site is located at 485 Wetherby Lake Drive. It is zoned S-1/ROSO III. The minimum setback from an easement for a pool is 3 feet, and the petitioner is requesting the pool deck encroach into the drainage and utility easement by 4.5 feet. The applicant seeks the following development standards variance for new ground sign height: Docket No. 14050024 V PUD Z-344, Sec. 11.3.C.3: 10 ft.Max Ground Sign Height, 13 ft requested. The site is located at 14480 Lowes Way. It is zoned PUD, Ord. No. Z-344. Filed by Paul Reis with Krieg DeVault, LLP on behalf of Kite Greyhound, LLC. Present for Petitioner: Kevin Buchheit, Krieg DeVault,LLP • Last month received approval for number of signs and this sign in right-of-way • Sign in right-of-way (Lowe's Way and 146th Street) o Sign will be 13 feet tall to accommodate grade in right-of-way Public Hearing closed. The applicant seeks the following development standards variance for a new garage: Docket No. 14060001 V ZO CH: 25.01.01.B.5: Max Ground Floor Area 720 sq. ft.; 820 sq. ft. requested. The site is located at 741 1s` Avenue NW. It is zoned R-2/Residential within the Old Town Overlay Character Sub-Area. Filed by Matt Huffman with Old Town Design Group on behalf of the owner Pete Driscoll. Present for Petitioner: Justin Moffett and Matt Huffman, Old Town Design Group • Legal drain runs northeast through property (awkward angle) o Tough for redevelopment o Not good enough condition for rehab o Drain has 30-foot easement o Dictated house and garage placement Page 2 of 3 Carmel Board of Zoning Appeals Hearing Officer Meeting June 23,2014 • Home in front of lot on west side of utility easement/storm drain o Garage detached on east side of drain • Most clients prefer attached garage o Large 40-inch pipe, 15 feet underground • Under Ordinance, if garage is attached there is not a restriction on maximum square footage of garage o Detached is 720 square feet maximum (detail buried within Ordinance) • Difficult for three-car garage • Original garage much larger than proposed side-load, three-car garage • Meets architectural requirements of Old Town Overlay, 100 square feet larger than maximum permitted • Original garage and house could not be rehabbed • Anything placed over easement would risk being removed if County needs access to drain o Sidewalk from house to garage, landscaped patio, and driveway over easement o Anything would need to be removed and replaced at homeowner's cost o Buried pipe, 15 feet underground; not an open swale o 30 feet is plenty for County to do any work o Common condition in Old Town Public Hearing closed. Department Report: I Angie Conn • 100 square feet expansion • Prior garage was larger and in bad shape • Will match and complement the new house • Received email from neighbor, Cynthia and David Wichman, 721 1st Avenue NW, in favor of variance Department recommended approval. Action: Mrs. Plavchak APPROVED Docket No. 14060001 V,Driscoll Garage,741 1st Avenue NW, for maximum ground floor area for detached garage (720 square feet permitted, 820 square feet requested).
