COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard, Council President W. Eric Seidensticker, Council Members Sue Finkam, Carol Schleif, Richard L. Sharp, Luci Snyder,Ronald E. Carter, Kevin D. Rider, Clerk-Treasurer Diana L. Cordray and Deputy Clerk Lois Craig. Mayor Brainard called the meeting to order at 6:00 p.m. Councilor Rider pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: There were none. APPROVAL OF MINUTES: Councilor Schleif made a motion to approve minutes from the July 7, 2014 Regular Meeting. Councilor Rider seconded. There was no Council discussion. Council President Seidensticker called for the vote. Minutes were approved 6-0 (Councilor Finkam abstained). Mayor Brainard addressed the Council regarding the proposed above ground Sewage Storage Tanks at 106th &Keystone being considered by the Clay Township Regional Waste District. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: John Accetturo addressed the Council in opposition of Ordinance D-2154-13 (Storm Water User Fees). The following individuals addressed the Council opposed to the proposed above ground Clay Township Regional Waste District Sewage Storage Tanks at 106th &Keystone: Jim Dickerson(representing Lakewood Gardens) Vince Artale (representing Milbrook Woods HOA) Jan Douglas Chris Kniola(representing Woods Swim Club HOA) Matthew Modleski addressed the Council opposed to the City's debt and spending. Stephen Brooks addressed the Council regarding transparency and spending. 1 COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: Councilor Sharp addressed the Council regarding Mr. Brooks' comments. Councilor Snyder addressed the Council regarding the Hamilton County Humane Society. Councilors Carter and Rider addressed the Council regarding the placement of the proposed Sewage Tank at 106th &Keystone. Mayor Brainard and Council President Seidensticker addressed the Council regarding Mr. Accetturo's comments. ACTION ON MAYORAL VETOES: There were none. CLAIMS: Councilor Finkam made a motion to approve payroll in the amount of$1,544,074.66 and general claims in the amount of$3,361,351.86. Councilor Snyder seconded. There was no Council discussion. Council President Seidensticker called for the vote. Payroll and Claims were approved 7-0. Wire Transfers: Month of June 2014. Councilor Finkam made a motion to acknowledge wire transfers in the amount of$6,012,508.01. Councilor Snyder seconded. There was no Council discussion. Council President Seidensticker called for the vote. Wire Transfers were acknowledged 7-0. COMMITTEE REPORTS: Councilor Snyder reported that the Finance, Administration and Rules Committee had met and discussed Ordinance D-2172-14 and Ordinance D-2173-14. The committee report will be given when the item appears on the agenda. Councilor Sharp reported that the Land Use, Annexation and Economic Development Committee had not met. Councilor Carter reported that the Parks, Recreation and Arts Committee had not met. Councilor Schleif reported that the Utilities, Transportation and Public Safety Committee had met and discussed Ordinance D-2154-13 and Ordinance D-2162-13. The committee report will be given when the item appears on the agenda. Report from the Cannel Redevelopment Commission. No report was given. Tania Castroverde Moskalenko, President/CEO; The Center for the Performing Arts presented a report along with a video and was available for questions of the Council. There was no Council discussion. OLD BUSINESS Council President Seidensticker announced the Eighteenth Reading of Ordinance D-2154-13; An Ordinance of the Common Council of the City of Cannel, Indiana, Establishing a Department of Storm Water Management and a Storm Water District, and Adopting and Approving Storm Water User Fees. Councilor Schleif presented the Utilities, Transportation and Public Safety Committee report to the 2 Council and made a motion to amend Ordinance D-2154-13 by submitting in whole Ordinance D-2154-13 As Amended; OPTION A. Councilor Rider seconded. Councilor Sharp made a motion to amend the amendment by substituting in whole Ordinance D-2154-13 As Amended OPTION B; July 21, 2014 at 6:00 p.m. Councilor Snyder seconded. There was Council discussion on OPTION B. Councilor Carter referred to Briane House, Attorney, House Reynolds &Faust to address the Council. Mayor Brainard addressed the Council. Council President Seidensticker called for the vote to amend OPTION A(controlled by the Board of Public Works)to OPTION B (controlled by the Common Council). The motion was approved 6-1 (Councilor Carter opposed). There was no Council discussion. Council President Seidensticker called for the question to amend Ordinance D-2154-13 As Amended OPTION B. The motion was approved 7-0. Council President Seidensticker referred to City Engineer, Jeremy Kashman, to address the Council. Councilor Rider made a motion to amend Ordinance D-2154-13 As Amended by striking on line 149 the start date of the fee structure and collection start date of January 1, 2015 and inserting the date November 1, 2014. Councilor Sharp seconded. There was brief Council discussion. Clerk-Treasurer Diana L. Cordray addressed the Council. Council President Seidensticker called for the question to amend the operations date. The motion was approved 5-2 (Councilors Seidensticker and Sharp opposed).
