FINDINGS OF FACT- DEVELOPMENT STANDARDS VARIANCE

Petitioner: JOHN T. LOGAN •
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
* The proposed structure will be built to city code requirements.
* The structure will be approximately 140' from .the street.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
* The structure will..be built to city code requirements.
* The proposed garage will tie in architecturally with the existing home.
* The structure will be approximately 26' from the adjacent property line.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
* It will destroy large, beautiful mature trees with the current zoning
requirement.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board,which are incorporated herein by reference and made a part hereof.

STATEMENT OF VARIANCE
The following Standard Variance is being requested:
Construct detached exterior garage/woodshop forward of home rather than setback 25'
behind front of home.
STATEMENT OF SUPPORT
The following are statements of support for the variance requested:
• The home is on 4.7 acres and is not part of a development.
• The structure will be 26' from the adjacent property line.
• The structure will be 110' from the adjacent house.
• The structure will be 140' from the street.
• We will not need to remove eight (8) large, mature trees (>30') and can maintain
the integrity of the current landscaping.
• The garage door will not face the street.
• The structure will be built to city code requirements and tie in architecturally with
the existing home.
• It will be utilized for personal use and house personal items.
• The structure will be appropriately landscaped.
