The site is located in the U.S. 31 Overlay Zone and has the B-5 and S-2 underlying zoning districts. The proposed use is not permitted in either zoning district. Petitioner is also seeking certain Development Standards Variances for: (a) minimum tract size (less than five (5) acres due to acquisition of real estate by the State of Indiana to upgrade U.S. 31 to freeway status), (b) no perimeter buffer yard, (c) no greenbelt landscaping, and (d) no protection of existing trees in order to prepare the site and to allow for the construction and use of the Helipad in accordance with Federal Aviation Administration ("FAA") requirements. The Helipad will be used for the emergency transport of heart patients by helicopter to the St. Vincent Heart Center of Indiana(the "Heart Hospital"). Due to the location of the Heart Hospital near a residential area, the installation of a helipad at the Heart Hospital is not possible. With the upgrade of U.S. 31 to freeway status, the construction of a new interchange with Interstate 465, and the resulting acquisition of additional real estate to allow for such construction, the Pilgrim Lutheran Church, located immediately north of the U.S. 31 / Interstate 465 interchange, was forced to relocate to a new site. A small parcel of land, a little over one acre in size, became available for purchase. The remaining church property is being sold to the owner of the GEICO office building for additional parking. (Please see the aerial photo under TAB 8 of this information booklet showing the location of the site and the proposed Helipad.) The site is ideally suited for establishing the Helipad because: (a) it is close to the Heart Hospital which will allow for the rapid transport of patients without the need to travel on U.S. 31 and/or on several local roads; (Please see the map under TAB 9 of this information booklet showing the relative straight line distances from the current Helipad option and from the proposed Helipad site to the Heart Hospital.); (b) it is over 1,100 feet from the closest residence and is buffered by commercial office buildings and uses; (e) it is within 600 feet of U.S. 31 and within 800 feet of Interstate 465 which, with the ambient noise level from the truck and vehicle traffic on those freeways, will help buffer the sound level at landing and takeoff at the Helipad; and (d) it allows the flight paths to the Helipad to avoid the residential areas located immediately 0 Krz1EGJ:3EVALJL7,.
