He can be reached at 317- 571-2450. Regarding the permit that was issued, I think it was just a coincidence that at that exact time we had a permit ready to pick-up for “37 E. Main St.”, and since anyone can pay for a permit, we wouldn’t have questioned someone coming in with a check to pay for a permit, since it happens dozens of times per day. We will do our best to get this out but the first thing is to get your state release. I learned today the permit issued was mistakenly issued to us by the city and was intended for the property at 37 East Main st. I'll try to summarize here. I have been using an architect who is a friend of mine in Minneapolis. He recommended a construction manger that he knows there to help me with the permitting and hiring of subcontractors. Because I am local, I have been his eyes and ears here and have helped coordinate with the subs. 2 The plumber we hired, Carlisle Plumbing, said he checked on our permit and was told by your office it was ready to pick up. However, he did not have the funds to pay for it at the time. I was out of town on vacation and told him I would pick it up when I returned. I came into the office in Carmel and indicated I was there to pick up the permit for the Peace Water Winery project at 37 W. Main St. I was handed a permit, wrote a check (which was cashed by the city), and headed straight to the site to give it to our plumber. It was posted and I assumed we were good to go. I had no reason to believe otherwise. We began construction based on that assumption. Since that time we have also started HvAC and electrical work and completed basic framing of the office, bathroom, and prep/storage areas. Only rough in has been completed to this point. As you know, today we learned we had erroneously been issued the permit by the city and were ordered to stop work. We complied. Obviously the first thing I did was contact our construction manager. He had been told by the subs that the permit was onsite so he was also under the assumption all was good. Our architect likewise was under the same assumption. Frankly no one had reason to wonder or be concerned with who had filed for the permit, we had a permit we thought was valid so each reasonably assumed it had been taken care of. Bottom line, we have drawings ready to submit that apparently never were submitted because all thought we had been issued a valid permit by the city. That is where we stand today. Unfortunately, this setback is threatening to delay our opening on July 19th. That is the date of the Carmel Wine Festival where 12,000 wine drinkers attend, sample and buy wine. Clearly that is an important date for the only winery in Carmel to have its doors open .... Especially when the festival is literally out our front door. So that brings me to the question, what can we do to expedite the process of obtaining our permit so we can finish construction? I know we can get state approval in one day if I pay an extra fee. Once we have that how quickly can Carmel issue a permit? I understand we are responsible for obtaining a permit. However, I would certainly hope the fact we are in this situation, at least in part, due to the city's error would be taken into consideration and that process could be expedited as quickly as possible. Please let me know what we can do to be sure that happens. We look forward to working with you to resolve this as quickly as possible and becoming another asset to the Arts and Design District. Ellison - I noticed in an email correspondence below that you mentioned our new store "may be a change of use" and I was looking for some clarification. Specifically, what is the definition of "change of use"? As background, we are a retail wine store that will offer wine tastings where a person can walk in and buy a bottle of wine and/or have a tasting of the wines we sell before purchasing. We are not producing any wine on site, simply selling retail to the public. We have been told the retail use fits the current zoning. Anyway, my architect is trying to get a firmer understanding of his design requirements and he tells me the "change of use" may require a more extensive update to the plans. Any clarification on how that term is defined would be greatly appreciated. I want to be sure my architect knows what standards he needs to design to. Thanks!
