Public Hearing:
1. (V) Rogers Pool Setback, Woods at Williams Creek,Lot 22.
IThe applicant seeks the following development standards variance approval for a new pool:
Docket No. 14060011 V ZO CH: 25.01.01.C.8.a.iii: 3 ft. min. pool setback from easement; Pool
decking requested in easement.
The site is located at 509 Wetherby Lake Drive. It is zoned S-1/ROSO III. The minimum setback from an
easement for a pool is 3 feet and the petitioner is requesting the pool deck encroach into the drainage and
utility easement by 2 feet. Filed by Marge Mikels of Pools of Fun, on behalf of Angela and Joseph Rogers,
owners.
Present for the Petitioner:
Mike Grant, Pools of Fun, and Angela Rogers, owner
• Pool will not be in easement
• Only concrete deck will encroach one to two feet
Public Hearing closed
Department Report:
Alexia Lopez
• Accessory structures, including pools, are required to be three feet from easement
o Only concrete pool decking in easement
o No equipment or pool footer will be within easement
• City Engineering Department supports encroachment
o Grade elevation cannot be changed in any manner
• Homeowners Association approval submitted to Department
• Variance needed from Board of Public Works to be within easement
o Engineering Department will help with that approval

Department recommended approval with the Condition approval is obtained from the Board of Public
Works for the encroachment.
Discussion:
• Mrs. Rogers stated they had started process with Engineering Department
• Neighbor to east has similar situation with their pool
• Contours of site make the decking push into easement
• Slight concern grade breaks away from pool area to retention pond
o Constructed so that decking will not change grade
• Decking will be thicker to prevent change in grade; will be recorded
Action: Mr. Lockwood APPROVED Docket No. 14060011 V, Rogers Pool Setback, Woods at Williams
Creek, Lot 22, for 3 feet minimum pool setback from easement, requesting pool deck to encroach 2 feet into
drainage and utility easement with the Condition approval is obtained from the Board of Public Works for the
encroachment.
Adjournment:
The Hearing Officer adjourned the meeting at 5:36 p.m.
