2i. Docket No.186-00 Z;DePauw Rezone
Petitioner seeks favorable recommendation of a rezone from the S-2/residence district to the B-5/business
district on 1.87±acres. The site is located northwest of West 1315t Street and North Meridian Street. The site
is zoned S-2/residence.

Petitioner seeks favorable recommendation of a rezone from the S-2/residence district to the B-5/business
district on 10.02±acres. The site is located northwest of West 131st Street and North Meridian Street. The site
is zoned S-2/residence within the US 31/Meridian Street Overlay Zone.

The Special Studies committee voted 5 to 1 to recommend approval of the Rezone applications of CMC and CH
Land to the full Plan Commission. However,they tabled the DePauw petition until they and the City of Cannel are
able to come to an agreement on the reservation of property for future road development. It is the Department's
understanding that the favorable recommendation by the Special Studies Committee of the CMC and CH Land
petitions hinge on, among other things,a successful resolution of negotiations between the petitioner and the City of
Cannel(see attached letter from the applicants' attorney dated May 2,2001.
It is based on this understanding that the Department recommends that the Plan Commission table the CMC
and CH Land petitions(187-00 Z and 186-00 Z respectively)until the Special Studies Committee returns the
DePauw petition(188-00 Z)back to the full Plan Commission.

J.KATHRYN JENKINS This letter is to confirm the Special Study Committee's action at its meeting
DANIEL E.COOTS held May 1,2001 on the captioned applications,based upon the following conditions:
*CERTIFIED MEDIATOR
1. The DePauw 10.2 acre tract (northern tract) is tabled until DePauw
University and the City of Carmel are able to work out.a stand still agreement
reserving necessary property for future road development, such agreement to be
completed promptly.
2. Review and approval by the Carmel City.Engineer of the proposed
Meridian Corners Boulevard intersection with the entrance road to the CMC
(approximate 9 acre)tract.
3. The filing and approval of a Development Plan and Architectural
Design, Lighting,Landscaping and Signing Application to be filed on behalf of both
the CMC tract and CH Land (1:8 acre)tract.
Premised upon the foregoing, the Committee voted 5 to 1 to recommend
approval of the Rezone Application of CMC and CH Land to the full Plan
Commission.
